STATE CONSERVATION COMMISSION
PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed (National Pollutant Discharge Elimination System) NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.
Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. PUBLIC WATER SUPPLY PERMITS Under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17), the following parties have applied for Public Water Supply (PWS) permits to construct or substantially modify public water systems.
Individuals wishing to comment on permit applications are invited to submit statements to the office listed before the application within 30-days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding an application. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995
PREAMBLE 1
Acknowledgment of Notice(s) of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).
Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent (NOI) to Remediate. An acknowledgment of the receipt of a NOI to Remediate is used to identify a site where an individual proposes to, or has been required to, respond to a release of a regulated substance at a site. Individuals intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a NOI to Remediate with DEP. A NOI to Remediate filed with DEP provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. An individual who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by DEP. Furthermore, an individual shall not be subject to citizen suits or other contribution actions brought by responsible individuals not participating in the remediation.
Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the NOI to Remediate is published in a newspaper of general circulation in the area of the site. For the following identified site(s), proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30-days of the following specified date. During this comment period the municipality may request that the following identified individual, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

AIR QUALITY
PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS The Department of Environmental Protection (DEP) has developed an integrated plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for DEP, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.
The DEP received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, DEP's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate DEP Regional Office. Appointments for scheduling a review must be made by calling the appropriate DEP Regional Office. The address and telephone number of the Regional Office is listed before the application notices.
Individuals wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the DEP's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.

32-00449A: Gruppo EF Technologies USA, LLC, 12 East 10th Street, # 3R, New York, NY 10003, Center Township, Indiana County. Application received: May 19, 2022. Notice is hereby given pursuant to 25 Pa. Code §§ 127.44(b) and 127.424(b), the Pennsylvania Department of Environmental Protection (DEP) intends to issue a Plan Approval to Gruppo EF Technologie USA, LLC for the construction of a proposed biomethane digester facility at their site. The Plan Approval will subsequently be incorporated into the facility's Operating Permit through an administrative amendment in accordance with 25 Pa. Code § 127.450. Plan Approval No. 32-00449A is for the construction of a new facility, which will anaerobically digest biomass farm waste to produce biogas which will be sold to pipeline. The proposed facility will consist of two (2) parallel anaerobic digesters, associated raw material and digestate storage tanks, biogas treatment unit, emergency flare, 550 kW natural gas-fired combined heat and power unit, and 5 MMBtu/hr natural gas-fired backup boiler. Based on the information provided by the applicant and DEP's own analysis, the proposed facility will have potential emissions of 13.01 tons of carbon monoxide, 3.39 tons of nitrogen oxides, 4.56 tons of volatile organic compounds (VOC), 15.59 tons of sulfur oxides, 0.63 ton of particulate matter, and 1.52 tons of total hazardous air pollutants (HAP) per year. The Plan Approval will contain testing, monitoring, recordkeeping and work practice requirements designed to keep the facility operating within all applicable air quality requirements. The proposed combined heat and power unit will also be subject to the requirements of New Source Performance Standards, 40 CFR Part 60, Subpart JJJJ, for Stationary Spark Ignition Internal Combustion Engines. 21-05002C: Vitro Architectural Glass LLC (400 Park Dr, Carlisle, PA 17015-9271) for the installation of a Selective Non-Catalytic Reduction (SNCR) system for Glass Melting Furnace 1 (Source ID 101), and the incorporation of presumptive, and alternative RACT 3 requirements for various sources, at the facility located in South Middleton Township, Cumberland County.
In accordance with 25 Pa. Code §§ 129.111—129.115 (relating to additional RACT requirements for major sources of NOx and VOCs for the 2015 ozone NAAQS), the Pennsylvania Department of Environmental Protection (Department, DEP) has made a preliminary determination to approve a RACT 3 plan for the previously mentioned facility.
The RACT 3 plan approval incorporates provisions and requirements for the control of emissions of nitrogen oxides (NOx) and/or volatile organic compounds (VOCs). These provisions and requirements are intended to address the Commonwealth's RACT obligations under section 184 of the Clean Air Act for the 1997, 2008 and 2015 8-hour ozone National Ambient Air Quality Standards. The RACT 3 plan approval does not adopt any new regulations. If approved by the Department, this RACT 3 plan approval will be submitted to the United States Environmental Protection Agency (EPA) for approval as a revision to the Commonwealth's State Implementation Plan (SIP). Requirements that are not part of the RACT 3 plan approval will be excluded from the SIP revision submittal.
The following is a summary of the RACT 3 plan approval requirements for this facility that are proposed to be submitted to the EPA as a revision to the Commonwealth's SIP:
I. The following requirements constitute a case-by-case NOx RACT 3 determination for Furnaces 1 and 2:
(a) A glass furnace ''Operating Day'' is defined as any calendar day (i.e. period that begins at midnight local time and ends 24 hours later at midnight) in which glass is pulled from the furnace.
(b) A glass furnace ''Non-Operating Day'' is defined as any calendar day (i.e. period that begins at midnight local time and ends 24 hours later at midnight) in which glass is not pulled from the furnace.
(c) As of 1/1/23 for Furnace 2, and as of 8/3/24 for Furnace 1, the permittee shall comply with the following NOx emission limitations:
(1) During any Operating Days, the glass furnaces shall comply with the presumptive RACT 3 NOx emission limitation of 7.0 pounds of NOx per ton of glass pulled for flat glass furnaces based on a 30-day rolling average, pursuant to 25 Pa. Code § 129.112(i)(4).
(2) During any Non-Operating Days, the NOx emissions for each glass furnace averaged over consecutive non-operating days may not exceed the amount calculated using the following equation: Pounds per day emission limit of NOx = 7.0 pounds per ton of glass produced × Furnace permitted production capacity in tons of glass produced per day.
(d) The permittee shall keep the following records, which shall be retained by the permittee for a period of five (5) years and be made available to DEP upon request:
(1) CEMS data and calculations necessary to demonstrate compliance with the emission limitations previously listed.
(2) Documentation of all maintenance performed on control devices.
(3) All periods each control device was not operating while the associated furnace was operating, including:
(i) Start and end times of each period.
(ii) Explanation for the occurrence of each period.
(iii) Calculations or data of emissions which occurred during each period.
(e) Data or information required to determine compliance shall be recorded and maintained in a time frame consistent with the averaging period of the emissions limitation.
(f) Records, data, and calculations necessary to demonstrate compliance with the emission limitations above, shall be provided with the facility's annual emissions report required by Section B.
(g) As of 1/1/23 for Furnace 2, and as of 8/3/24 for Furnace 1, the permittee shall operate the glass furnace NOx control systems whenever technologically feasible during non-operating days (as defined previously) to minimize emissions.
(h) The permittee shall install, maintain and operate the NOx control devices in accordance with the manufacturer's specifications and with good operating practices.
II. Per 25 Pa. Code § 129.112(p), DEP hereby approves a RACT 3 alternative compliance schedule, and interim emission limitations for Furnace 1, as follows:
(a) By no later than 8/3/24, the permittee shall install and begin operating the necessary NOx controls on Furnace 1 in order to ensure that during any Operating Days, Furnace 1 complies with the presumptive RACT 3 NOx emission limitation of 7.0 pounds of NOx per ton of glass pulled for flat glass furnaces based on a 30-day rolling average, pursuant to 25 Pa. Code § 129.112(i)(4).
(b) Until Furnace 1 NOx controls are installed pursuant to II.(a), the permittee shall ensure that during any Operating Days, Furnace 1 complies with an interim RACT 3 NOx emission limitation of 23.0 pounds of NOx per ton of glass pulled for flat glass furnaces based on a 30-day rolling average.
(c) Until Furnace 1 NOx controls are installed pursuant to II.(a), the permittee shall ensure that during any Non-Operating Days, Furnace 1 complies with an interim RACT 3 NOx emission limitation calculated over consecutive non-operating days, not to exceed the amount allowable using the following equation: Pounds per day emission limit of NOx = 23.0 pounds per ton of glass produced × Furnace permitted production capacity in tons of glass produced per day.
Public Comment Details:
A 30-day public comment period is provided for persons wishing to file a written protest, objection, comments or additional information, which they believe should be considered prior to the issuance of a permit. The 30-day public comment period closes on June 12, 2023.
Each written submission must contain the name, address and telephone number of the person submitting the comments, identification of the RACT 3 plan approval, including the permit number, and a concise statement regarding the RACT 3 plan approval provision or requirement that the person is commenting on and the relevancy of the information or objections to issuance of the RACT 3 approval.
Public hearing. A public hearing will be held on June 13, 2023 at 10:00 AM at the DEP Southcentral Regional Office, 909 Elmerton Avenue, Harrisburg, PA 17110, to accept oral comments on the proposed permit action and the proposed SIP revision. The last day to pre-register to speak at the hearing will be the Friday before the hearing.
Oral testimony at the hearing will be limited to a maximum of 5 minutes per individual and two written copies of the oral testimony are requested. 30-00258: ECC Windsor, Inc., 1919 14th Street, Suite 700, Boulder, CO 80203, Richhill Township, Greene County. Application received: March 15, 2023. In accordance with 25 Pa. Code § 127.465, synthetic minor operating permit modification for a mine methane flaring project consisting of two (2) John Zink Company, LLC ZTOF6X30 enclosed flares located in Richhill Township, Greene County at coordinates 39.8994276, -80.483075. The facility's potential emissions are estimated to be 13.2 TPY NOx, 98.9 TPY CO, 2.8 TPY VOC, 4.4 TPY PM, and 34,947 TPY CO2e. This facility is subject to the applicable requirements of 25 Pa. Code Chapters 121—145. The proposed modification is to change the flare minimum operating temperature resulting in an increase of CO emissions. The flares are limited to a heat input not to exceed 18.8 MMBtu/hr. Additional monitoring and recordkeeping requirements have been included in the proposed modification to the synthetic minor State-Only Operating Permit. Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application may be submitted by any person or any officer or head of any Federal, State or Local Government Agency or Authority to DEP at the address of the District Mining Office indicated above each application within 30-days of this publication, or within 30-days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences). MINING ACTIVITY NPDES DRAFT PERMITS This notice provides information about applications for a new, amended or renewed National Pollutant Discharge Elimination System (NPDES) permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).
The Department of Environmental Protection (DEP) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.
Effluent Limits for Coal Mining Activities
For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).
The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.
Effluent Limits for Noncoal Mining Activities
The limits for noncoal mining activities as provided in 25 Pa. Code § 77.522 are pH 6 to 9 and other parameters DEP may require.
Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (DEP). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341), requires the State to certify that the involved projects will not violate the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), as well as relevant State requirements. Loyalsock Creek flows south along SR 87 through Montoursville to its confluence with the West Branch of the Susquehanna River. The creek makes a button-hook bend to the west across from the Loyalsock Valley Elementary School. This meander is immediately upstream of the Lycoming College Biology Field Station (LBFS), established in 2017 with the purchase of a 116-acre farm property along PA Route 87 in Upper Fairfield Township between Horn Road and Keebler Farm Road. The farm consists of two houses, a barn, several outbuildings, agricultural fields, and riparian/upland forests. A temporary canvas field monitoring station has also been added to the property. The LBFS is used by Lycoming College's biology department for courses in aquatic biology, ecology, plant science, vertebrate and invertebrate zoology, and environmental biology. However, since acquiring this property, flooding, nutrient/sediment loading, and streambank degradation has intensified. The meander of Loyalsock Creek just upstream of the LBFS is unstable, with several different alignments visible in the historic aerial photographs (see enclosure). Most of the alterations were in the channel path before it reaches the bend at the Lycoming College facility. The recent development of a channel avulsion bisecting the LBFS has escalated the erosion and sediment and nutrient input to the river system that includes the West Branch of the Susquehanna River and ultimately the Chesapeake Bay Watershed. Currently the flow in Loyalsock Creek is split between the original channel alignment and the newly formed channel avulsion. Left unaddressed, Loyalsock Creek could, in another major flood, make the channel avulsion the primary channel, abandoning roughly 4,250 ft of original channel. LBFS is proposing to be proactive in delivering solutions that restore and stabilize the degraded streambanks, treat runoff, and reduce nutrient and sediment loading. Specifically, the CAST model shows the Loyalsock Creek Restoration Project will reduce sediment input to the stream system by 276 tons/yr, accompanied by a nutrient reduction of 167 lbs/yr of nitrogen and 151 lbs/yr of phosphorus. In addition to the reduction of sediment and nutrients input into the stream system, the Loyalsock Creek Restoration Project will implement bank stabilization measures to reduce runoff volumes, increase infiltration, and improve water quality. The project will contribute to the implementation of the Countywide Action Plan as part of Pennsylvania's Phase 3 WIP. The project will also restore the natural floodplain to further improve water quality and wildlife habitat. The project proposes to install a bench that matches the existing banks on either side of the entrance of the channel avulsion, essentially shutting off stream flow to the avulsion channel under normal conditions. The bench will be constructed along the river left bank up to the existing bank elevation on either side of the channel avulsion. The bench will be constructed of material aggraded on the inside of the button-hook meander and fronted with an R-5 rock toe. This bench will be stabilized with the installation of hybrid log vanes along the bench and along the river left banks upstream of the bench. In anticipation of high flows that may overtop the banks and installed bench, several watershed protection BMPs will be installed along the avulsion channel to manage flood flows and minimize the erosion and sediment input during high flow events. The BMPs include the installation of hybrid log vanes on the outside of bends, log wall sills to prevent down-cutting of the banks and the formation of secondary flow paths. Channel blocks will be installed in potential avulsion channels to promote more flow over the flood plain, thus reducing the erosive energy of the flood waters. Log cribbing will be installed upstream of existing structures to route flow around the structures and minimize damage to the structures. A minimum of a 30 to 50-foot buffer will be established at the end of the project to reduce nutrient and sediment loading. The total linear feet of the channel avulsion that will be converted to flood plain is approximately 2,225 feet. The original channel length that will be preserved as the primary channel is 4,250 ft.
