The Department of Environmental Protection (Department) hereby announces that a certain manufacturer of covered devices is not included on the Department's list of registered manufacturers, maintained by the Department under sections 302 and 507 of the Covered Device Recycling Act (CDRA). Accordingly, under Section 302 of the CDRA, no retailer may offer these manufacturers' products for sale within the Commonwealth.
Manufacturers of new covered devices—such as televisions, laptop and desktop computers, tablets, etc.—offered for sale in Pennsylvania are required to register with the Department prior to commencing sales per Section 304 of the CDRA. Manufactures must also pay an annual registration fee and submit a recycling plan and annual report. Section 302 of the CDRA prohibits the sale of covered devices in the Commonwealth by unregistered manufacturers.
The Department is required to maintain a list of registered manufacturers per Section 302(b) of the CDRA. The list can be accessed by visiting dep.pa.gov.
The following manufacturer is not included on the Department's list and are therefore considered out of compliance:
Supersonic, Inc. (Supersonic), Due to its non-compliant status and non-inclusion on the list of registered manufacturers, the Department is notifying the public, in cooperation with covered device retailers, that the CDRA prohibits the sale of devices manufactured by Supersonic within the Commonwealth, and that the sale of such devices would constitute unlawful conduct under the CDRA. Non-compliant manufacturers may once again be included on the Department's list of registered manufacturers, and their devices offered for sale in the Commonwealth, if the manufacturers return to compliance with all the applicable provisions of the CDRA.

47-00001: In accordance with 25 Pa. Code §§ 129.96—129.115, the Pennsylvania Department of Environmental Protection (DEP) has made a preliminary determination to approve an alternative Reasonably Available Control Technology (RACT 2 and 3) plan and seeks an approval of an amendment to the State Implementation Plan (SIP) for the Montour, LLC Steam Electric Station (SES) located in Derry Township, Montour County. And in accordance with 25 Pa. Code § 127.521, the Department of Environmental Protection intends to modify the facility's Title V Operating Permit. The proposed permit revision also includes applicable presumptive RACT 3 requirements for other existing sources at the facility. The facility is located at 18 McMichael Rd, Washingtonville, PA 17821. The facility's representative to contact concerning this application is Ms. Kathleen Potter, Senior Environmental Professional. The facility's major emission sources include two tangential bituminous coal-fired boilers with nominal maximum heat inputs of 7,317 and 7,239 MMBtu/hr, two #2 fuel oil-fired auxiliary boilers rated at maximum heat inputs of 249 and 269 MMBtu/hr, as well as emergency diesel engines and fire pumps.
The proposed SIP revision does not adopt any new regulations. It incorporates the provisions and requirements contained in the amended RACT 2 and 3 approval for the facility, which are intended to satisfy the requirements for the 1997, 2008 and 2015 National Ambient Air Quality Standard (NAAQS) for ozone. The proposed amendments to the RACT 2 and 3 determinations, if finally approved, will be incorporated into a revised operating permit (47-00001) for the facility. The relevant RACT 2 and 3 requirements will be submitted to the U.S. Environmental Protection Agency (EPA) as a revision to Pennsylvania's State Implementation Plan and will remain in effect until replaced pursuant to 40 CFR 51 and approval by the EPA. Requirements that are not part of the RACT 2 or 3 determination will be excluded from the SIP submittal; this includes the provisions of the Department's presumptive RACT 3 requirements in accordance with 25 Pa. Code § 129.112, as they apply to existing sources. The emission limits, throughput limitations and work practice standards along with testing, monitoring, recordkeeping and reporting requirements have been included in the operating permit to ensure the facility complies with all applicable Federal and State air quality regulations.
The following is a summary of the proposed amendments to the RACT 2 and 3 determination for this operation that will be submitted to the EPA as a SIP revision:
• The total combined NOx emissions from Units 1 and 2 shall not exceed 0.100 lb/MMBtu on a 30-operating day rolling average.
• Daily NOx emissions from Unit 1 shall not exceed 17,561 lb per unit operating day.
• Daily NOx emissions from Unit 2 shall not exceed 17,374 lb per unit operating day.
• Units 1 and 2 may not fire coal after December 31, 2025.
• The permittee shall utilize the following methods when determining compliance with the NOx RACT emission limits: (a) For 30-operating day rolling average NOx emission limit, 40 CFR parts 60 and 75, appendix F, Procedure 1; (b) For the Unit-specific Daily NOx Mass Emission Limits, 40 CFR part 75; and (c) All monitoring and testing shall be conducted in accordance with 25 Pa. Code Chapter 139, Subchapter C.
• The permittee shall: (a) Operate the SCR systems associated Unit 1 and/or 2 at all times the source is in operation and it is technically feasible to do so in accordance with manufacturer specifications for the SCR systems and sound engineering principles. This requirement applies regardless of the fuel type being combusted in the boiler. (b) Utilize reagent in the SCR systems at a rate that its optimized to maximize the degree of NOx control while minimizing ammonia slip, and (c) Operate and maintain the SCR systems in accordance with manufacturer specifications and good operating practices for the control of the NOx emissions.
• The permittee shall create and maintain records of: (a) the hourly heat input for each unit; (b) The specific hourly ammonia injection amounts for each unit; and (c) The specific hourly NOx emission rate for each unit. Records shall be retained for at least five years.
• The permittee shall electronically submit a periodic report, within thirty days after the end of each six-month reporting period. The periodic report shall contain data for each Operating Day during the reporting period, including, but not limited to: Facility ID; Facility name; Unit ID; Date; Unit-specific total Daily Operating Time; Unit-specific Daily NOx Mass Emissions; Unit-specific total Daily Heat Input; Unit-specific Daily NOx Emission Rate; Facility-wide 30-Day Rolling Average NOx Emission Rate; Owner; Operator; and Representative (Primary and Secondary). The periodic report shall be certified by the Responsible Official for the facility.
• The permittee shall be in compliance with the case-by-case NOx RACT requirements within 45 days of the effective date of the modified TVOP 47-00001, except for the Facility-Wide 30-Operating Day Rolling Average NOx Emission Rate Requirement, for which the compliance date is the day that the permittee has operated for 30 operating days after, and possibly including, the initial compliance date.
• Units 1 and 2 are also subject to a Federal Implementation Plan for NOx RACT 2, which is codified in 40 CFR 52.2065. In the event there is a conflict between the FIP requirements and the conditions in TVOP 47-00001, the permittee shall comply with the more stringent provision.
A public hearing will be held if requested by August 18, 2023 to accept oral comments on the proposed operating permit revision and the proposed SIP revision. The hearing will be held, if requested, on August 30, 2023, at 1:00 PM at the DEP Northcentral Regional Office, 208 West Third Street, Suite 101, Williamsport, PA 17701-6448. In accordance with the Pennsylvania Municipal Waste Planning, Recycling and Waste Reduction Act, Act 101 of July 28, 1988, P.L. 556, No. 101, 53 P.S. §§ 4000.101, et. seq. (''Act 101'') and § 272 of the Pennsylvania Rules and Regulations, 25 Pa. Code, Chapter 272, as amended, the Monroe County Municipal Waste Management Authority is hereby soliciting proposals for municipal solid waste disposal capacity for all municipal solid waste (MSW), including construction/demolition waste (C/D) and municipal sewage sludge (Sludge) generated from within Monroe County for a minimum of ten (10) years commencing January 1, 2025. This volume of material is for the sole use of the Monroe County Municipal Waste Management Authority and must be reserved for their use as stated herein and is to be utilized as part of an Integrated Waste Management System for the benefit of the residents of Monroe County.

The Berks County Solid Waste Authority (the Authority) has begun the process of revising the Berks County Municipal Waste Management Plan (the Plan), pursuant to Title 25, Chapter 272, Subchapter C of the Pennsylvania Department of Environmental Protection (''PADEP'') Rules and Regulations. The Plan is intended to ensure that the County has sufficient processing and disposal capacity for municipal waste generated in the County during the period beginning on October 7, 2024 and extending ten years from the date of approval of the Plan by PADEP (the Plan Period).
The Authority is hereby soliciting proposals from Disposal Facilities for the provision of non-exclusive disposal or processing capacity for municipal solid waste, including construction/demolition waste and sewage sludge, generated within Berks County (the County) during the Plan Period.
Berks County does not flow control waste and does not intend to flow control waste during the Plan Period. The County cannot guarantee the disposal of any minimum quantity of municipal waste at any Disposal Facility. The County and the Authority are searching for Disposal Facilities interested in entering into agreement(s) to provide non-exclusive disposal capacity for waste generated in Berks County during the Plan Period. Selected Disposal Facilities will be identified in the forthcoming Plan as facilities assuring disposal capacity.
Owners or operators of Disposal Facilities interested in assuring disposal capacity for waste generated in Berks County during the Plan Period shall submit a letter of interest to the Authority, to the attention of Executive Director, Jane Meeks, 633 Court Street, Reading, PA 19601, with an e-mailed copy to jmeeks@berkscswa.com. The letter of interest must be received by September 15, 2023 and shall include:
(a) The name, PADEP permit number, and location of the Disposal Facility;
(b) The company name(s) of the owner and operator of the Disposal Facility;
(c) The name, title, and contact information for an appropriate representative of the Disposal Facility; and
(d) The remaining capacity (in tons) and estimated remaining lifetime (in years) of the Disposal Facility, with mention of any reasonably anticipated expansions.
The County and the Authority reserve the right to reject any or all proposals, to waive any irregularities and/or information in any proposal, and to make selections in any manner, consistent with applicable laws, which is deemed to be in the best interest of the County.
