Unemployment Compensation; Relief from Charges

[Saturday, September 2, 2023]The purpose of this notice is to announce the following amendments to the act of December 5, 1936 (2nd Sp. Sess., 1937 P.L. 2897, No. 1), known as the Unemployment Compensation Law (UC Law) (43 P.S. §§ 751—919.10), as provided for under the act of March 27, 2020 (P.L. 25, No. 9).
Article III. Contributions by Employers and Employes
Section 302.1. Relief from Charges.
Subsection (b)(2)(i) of section 302.1 of the UC Law (43 P.S. § 782.1(b)(2)(i)) is amended to extend the time period for an employer to request relief from charges on the basis of a separation that occurs on or before the date the claimant files an application for benefits or on the basis of continuing part-time work from 15 days to 21 days after the date of the earliest notice issued by the Department under section 501(a) of the lUC Law (43 P.S. § 821(a)) indicating that the claimant is eligible for benefits under section 401(a) of the UC Law (43 P.S. § 801(a)) .
Subsection (b)(3)(i) of section 302.1 of the UC Law (43 P.S. § 782.1(b)(3)(i)) is amended to extend the time period for an employer to request relief from charges on the basis of a separation that occurs after the claimant files an application for benefits from 15 days to 21 days after the date of the earliest notice issued by the Department indicating that the claimant is claiming benefits subsequent to the separation.
Under section 6(2) of the act of March 27, 2020 (P.L. 25, No. 9), the previously referenced amendments to the UC Law are effective upon publication of this notice in the Pennsylvania Bulletin.
