NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS
FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, 717-787-3483. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin. Plan Description:

Fox Hollow Sanitary Sewer Line Extension, M6-21-272. The proposal consists of the decommissioning and removal of the existing Fox Hollow Sewage Treatment Plant, PA0217476, and the construction of a sanitary sewer line extension to the West Hills Area Water Pollution Control Authority (WHAWPCA) collection system. The existing sewage treatment plant (STP) and sanitary sewer line extension are located along Toy Road, Booher Road, and Claypoole Road. A total of 44 homes will be served, generating 17,600 gallons per day of sewage to be conveyed to the WHAWPCA Wastewater Treatment Facility. The project must be completed in accordance with the Corrective Action Plan (CAP) made between the Department and East Franklin Township as approved by letter dated December 2, 2021. Alternatives considered included rehabilitation and upgrade of the existing STP (most expensive), extending sewers to the North (grinder pumps and/or a pump station would be needed with projected farm impacts), and doing nothing. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

The planning module for the Long Family Holdings Duplexes, DEP Code No. A3-07919-187-2, APS ID 1070101, consisting of two residential duplex's on 2.0-acres totaling 1600 gallons per day, using an on-lot sewage system and a well, is disapproved. The proposed development is located at 142 Rebecca Furnace Road, Martinsburg, PA. This plan is disapproved because planning module failed to include a preliminary hydrogeologic evaluation to address the known geological conditions for the proposed site that may contribute to the potential for groundwater pollution from the system.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Following Plans and Reports Were Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Department Has Taken Action on the Following Plans and Reports Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.

 6. Remove existing culverts and stream enclosures,

 7. Construct and maintain 22-foot wide reinforced pre-cast concrete box culverts with fish baffles at Lincoln Avenue, Jefferson Avenue, Madison Avenue, Johnson Court, and Washington Avenue, and

 8. Construct and maintain a 0.75-acre mitigation site to enhance ecological sediment transportation and alluvial fan geomorphology near the confluence with the Lackawanna River.  2. The roadway diet project will also include floodway activities within the floodway of Rapp Run (TSF-MF) associated with the construction and maintenance of a portion of the CCT, roadway reconstruction, and water main installation resulting in 10,162 square feet of temporary floodway impact and 2,123 square feet of permanent floodway impact.

 3. Activities within the floodplain of Pine Run (TSF-MF) include the construction and maintenance of the CCT, road-diet, drainage network, and water and sanitary force mains, and will result in 159,955 square feet (3.67 acres) of temporary floodplain impact and 2,234 square feet (0.05 acre) of permanent floodplain impact. This activity also includes the reduction of impervious space for open space.

 4. Activities within the floodplain of Rapp Run (TSF-MF) include the construction and maintenance of the CCT, road-diet, drainage network, and water and sanitary force mains, and will result in 64,470 square feet (1.48 acres) of temporary floodplain impact and 4,680 square feet (0.11 acre) of permanent floodplain impact. This activity also includes the reduction of impervious space for open space.

 This project completes the missing ''middle'' segment within Greater Fort Washington (GFW) District, totaling the Cross County Trail length to a continuous 2.1 miles stretch from the PA 309 overpass along Commerce Drive to Susquehanna Road and will implement a road-diet to narrow Delaware and Virginia Drive from four to three lanes to provide one through lane in each direction and common center turn lane to accommodate the proposed trail. Box # 44, Delmont, PA 15626, on behalf of Robert J Hanyok, Jr., 215 North Main Street, Carrolltown, PA 15722 submitted a Remedial Action Completion Report concerning remediation of soil and groundwater contaminated with unleaded gasoline. The report residential demonstrated attainment of the Statewide health standards and was approved by DEP on January 13, 2023.

Covered Device Prohibited from Sale under Sections 302 and 507 of the Covered Device Recycling Act, Act 108 of 2010.

 The Department of Environmental Protection (Department) hereby announces that a certain manufacturer of covered devices is not included on the Department's list of registered manufacturers, maintained by the Department under sections 302 and 507 of the Covered Device Recycling Act (CDRA). Accordingly, under Section 302 of the CDRA, no retailer may offer these manufacturers' products for sale within the Commonwealth.

 Manufacturers of new covered devices, such as televisions, laptop and desktop computers, tablets, etc., offered for sale in Pennsylvania are required to register with the Department prior to commencing sales per Section 304 of the CDRA. Manufactures must also pay an annual registration fee and submit a recycling plan and annual report. Section 302 of the CDRA prohibits the sale of covered devices in the Commonwealth by unregistered manufacturers.

 The Department is required to maintain a list of registered manufacturers per Section 302(b) of the CDRA. The list can be accessed by visiting dep.pa.gov.

 The following manufacturer is not included on the Department's list and are therefore considered out of compliance:

AWOW Tech

 Due to its non-compliant status and non-inclusion on the list of registered manufacturers, the Department is notifying the public, in cooperation with covered device retailers, that the CDRA prohibits the sale of devices manufactured by AWOW Tech within the Commonwealth, and that the sale of such devices would constitute unlawful conduct under the CDRA. Non-compliant manufacturers may once again be included on the Department's list of registered manufacturers, and their devices offered for sale in the Commonwealth, if the manufacturers return to compliance with all the applicable provisions of the CDRA.
