[Saturday, December 9, 2023]Formal complaints have been issued by the Pennsylvania Public Utility Commission. Answers must be filed in accordance with 52 Pa. Code (relating to public utilities). Answers are due December 26, 2023, and must be made with the Secretary, Pennsylvania Public Utility Commission, 400 North Street, Harrisburg, PA 17120, with a copy to the First Deputy Chief Prosecutor, Pennsylvania Public Utility Commission.

COMPLAINT The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:
1. That Barthel Trucking, LLC, Respondent, maintains a mailing address of 655 California Road, Littlestown, PA 17343.
2. On March 10, 2023, by Commission Secretarial letter, Respondent was issued a certificate of public convenience by this Commission authorizing trans-portation, as a common carrier, by motor vehicle, property, excluding household goods in use, between points in Pennsylvania at PUC utility code no. 8911412 at A-2022-3037061.
3. On June 23, 2023, PA PUC Enforcement Officer Matthew Ohlinger attempted to contact the Respondent, but Mr. Barthel, owner, was unavailable as he was in Louisianna, an email was also sent at that time. On July 28, 2023, and August 30, 2023, Mr. Barthel was scheduled for the Safety Fitness Review (SFR) and each time Mr. Barthel cancelled. On October 3, 2023, Mr. Barthel was scheduled to be at the Keystone Building in Harrisburg. Mr. Barthel did not appear to complete the SFR. Officer Ohlinger called phone numbers and texted and emailed messages with no response.
4. That Respondent, by failing to achieve a satisfactory evaluation on a safety fitness review, violated 66 Pa. § 501(c) and, for failure to maintain adequate, efficient, and safe service and facilities, violated 66 Pa. § 1501. The penalty for this violation is cancellation of the certificate held by Respondent with this Commission at utility code 8911412.
Wherefore, the Bureau of Investigation and Enforcement hereby requests that the Commission revoke the certificate of public convenience issued to Barthel Trucking, LLC, at PUC utility code number 8911412.

COMPLAINT The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:
1. That D and S Trucking, LLC, Respondent, maintains a mailing address of 450 East 375th Road. Dunnegan, Missouri 65640.
2. On March 22, 2023, by Commission Secretarial letter, Respondent was issued a certificate of public convenience by this Commission authorizing transportation, as a common carrier, by motor vehicle, property, excluding household goods in use, between points in Pennsylvania at PUC utility code no. 8926002 at A-2023-3038647.
3. On June 20, 2023 a first class and certified letter was sent to the address on file with the Commission and was delivered June 24, 2023, the letter stated that Officer David Gill had made several attempts to contact and for the Respondent to contact Officer gill within 10 days. No response has been received. Officer Gill then phoned the Respondent and spoke with Samuel Fisher, owner. Mr. Fisher indicated that D and S Trucking is no longer operating in Pennsylvania as the company has relocated to Missouri.
4. That Respondent, by failing to notify the Commission of the companies relocation and achieve a satisfactory evaluation on a safety fitness review, violated 66 Pa § 501(c) and, for failure to maintain adequate, efficient, and safe service and facilities, violated 66 Pa. § 1501. That Respondent, by failing to file an application with this Commission prior to abandoning or discontinuing service, violated 52 Pa. Code § 3.3819(a) and 66 Pa.C.S. § 1102(a)(2). The penalty for these violations is cancellation of the certificate held by Respondent with this Commission at utility code 8926002.
Wherefore, the Bureau of Investigation and Enforcement hereby requests that the Commission revoke the certificate of public convenience issued to D and S Trucking, LLC at PUC utility code number 8926002.

COMPLAINT The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:
1. That Lyft, Inc., Respondent, maintains its principal place of business at 185 Berry Street, Suite 5000, San Francisco, California, 94107.
2. On Respondent was issued a license by this Commission on February 9, 2017, at PUC utility code number 6416471, authorizing transportation of persons for compensation from one point to another within Pennsylvania in Transportation Network Company service.
3. On Respondent, on 23 September 2023, permitted a certain 2022 Toyota COA bearing registration number LWM8189 and having vehicle identification no. the last 4 digits being 6822 to be operated by driver Ying Yang.
4. That the vehicle described in paragraph 3 was inspected on the date specified by PUC Motor Carrier Enforcement Officer Joshua Corney on Hastings Road, College Township, Centre County, PA. The vehicle did not have the company placard displayed in the windshield.
5. That Respondent, by allowing a vehicle to operate while not having the proper company placard displayed on the vehicle as specified by the Commission, violated 66 Pa.C.S. § 2605(b)(8). The fine for this violation is $50.00.
Wherefore, the Bureau of Investigation and Enforcement Prosecutory Staff hereby requests that the Commission fine Lyft Inc. the sum of fifty dollars ($50.00) for the illegal activity described in this Complaint and order such other remedy as the Commission may deem to be appropriate.
