WATER ACTThis notice provides information about persons who have applied to the Department of Environmental Protection (DEP) for a new, renewed, or amended NPDES or WQM permit, or a permit waiver for certain stormwater discharges, or have submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications and NOIs concern, but are not limited to, effluent discharges from sewage treatment facilities and industrial facilities to surface waters or groundwater; stormwater discharges associated with industrial activity (industrial stormwater), construction activity (construction stormwater), and municipal separate storm sewer systems (MS4s); the application of pesticides; the operation of Concentrated Animal Feeding Operations (CAFOs); and the construction of sewage, industrial waste, and manure storage, collection and treatment facilities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). More information on the types of NPDES and WQM permits that are available can be found on DEP's website (visit www.dep.pa.gov and select Businesses, Water, Bureau of Clean Water, Wastewater Management, and NPDES and WQM Permitting Programs).

PA0272612, Pesticides, SIC Code 4959, US DOI Fish and Wildlife Service, 5050 Commerce Drive, Ludington, MI 49431-9308.
Description of Existing Activity: The application is for a renewal of an NPDES permit for a discharge of lampricide to control invasive sea lamprey populations associated with the application of pesticides in tributary streams to Lake Erie in multiple townships, Erie and Crawford Counties.
The receiving streams are in State Water Plan 15X in the Lake Erie watershed and are classified under the following designated uses; Cold Water Fishes, Warm Water Fishes, Migratory Fishes and Special Protection for aquatic life, water supply and recreation. Applicators are required to follow product labeling instructions of pesticides, which may include provisions to reduce application doses and notify public water suppliers in the event applications are conducted near public water supply intakes. The discharges associated with the pesticide applications are not expected to affect public water supplies.
PA DEP has made a tentative determination to issue the NPDES permit subject to the terms and conditions of the permit. An anti-degradation analysis has been completed to document that pesticide application activities in High Quality (HQ) or Exceptional Value (EV) waters will be conducted in a manner that minimizes adverse environmental effects. The proposed permit contains conditions that require implementation of Pest Management Measures, Recordkeeping and Annual Reporting Requirements, Corrective Action Documentation and Reporting, and a Pesticides Discharge Management Plan.

Purpose of Major Amendment No. 2: Several changes were made for Major Amendment No. 2. These changes from the approved July 7, 2022 plans (Major Amendment No. 1) include: On Lot 14, Building # 4 main building total footprint was revised to 1,188,676 SF, a 65,335 SF parking garage was added at the eastern edge of the site, the pump house building was moved to the northern edge of the site, and the gatehouse was reduced to 520 SF. The associated loading docks, driveways, and storm sewer piping were updated per these changes. Likewise, the stormwater management calculations were updated to reflect the revised impervious coverage on Lot 14. Only minor changes were made to Lot 15 (Building 5) and Lot 16 (Building 6), including connection points of proposed gas, water, and industrial waste utilities to existing infrastructure. Additionally, MRC Basin A at the northwestern edge of the disturbance (near corner of Old Bordentown Road and S. Port Road) was added to manage stormwater from the southern shoulder of Old Bordentown Road and the northern portions of the proposed railroad tracks along S. Port Road. MRC Basin A outlets to a stormwater ditch north of Old Bordentown Road at a new Discharge Point (DP 002). The southernmost portions of the proposed railroad track drainage continue to outlet across S. Port Road to Dry Extended Detention Basins directed to DP 001. The stormwater management calculations were updated to reflect these changes. As a result of changes for Major Amendment No. 2, the Overall Limit of Disturbance/Project Site Boundary was increased by 4.48 acres to 310.19 acres.
