The Following Plans and Reports Were Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).
Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.

2. A 5-feet high rectangular concrete box culvert will connect the inlet structure to a rectangular concrete channel downstream of Kenneth Street. This culvert will extend for a distance of 476-feet and replace an existing 42-inch RCP of approximately the same length. The culvert will transition from a width of 8-feet to a width of 6-feet at approximately 80-feet downstream of the inlet structure.
3. A 6-feet wide rectangular concrete channel will continue 120-feet from downstream of Kenneth Street to an unnamed alley.
4. A 6-feet wide by 5-foot high rectangular concrete box culvert will continue 25-feet under the unnamed alley connecting two sections of rectangular concrete channel and replace an existing 72-inch RCP of approximately the same length.
5. A 6-feet wide rectangular concrete channel will continue 120-feet from downstream of the unnamed alley to upstream of Beaver Street.
6. A 6-feet wide by 5-foot high rectangular concrete box culvert will continue 630-feet downstream of Beaver Street and running under Harvey Avenue and continuing 240-feet past Harvey Avenue to a trapezoidal reinforced earth channel. This will replace an existing culvert with sections consisting of 72-inch RCP, 72-inch CMP and a 6-feet wide by 6-foot high rectangular box culvert of approximately the same length.
7. A 6-feet wide trapezoidal reinforced earth channel will continue 178-feet downstream to a concrete channel.
8. A 10-foot wide rectangular concrete channel will continue 101-feet from the trapezoidal reinforced earth channel to the SR119 New Alexander Way Bridge. The initial 20-feet will be a concrete transition from the 6-foot wide trapezoidal channel to the 10-foot wide rectangular concrete channel.
9. The invert of the SR119 New Alexander Way Bridge will be paved with concrete for a length of 33 lineal feet. The interior dimensions between the bridge abutments is 9-feet width with a height of 5-feet to the existing low chord from the paved invert.
10. A 10-feet wide rectangular concrete channel will continue 49-feet to Roosevelt Way.
11. The Roosevelt Way Bridge will be replaced with a 10-wide by 4 1/2-foot high box culvert extending 42-feet downstream connecting the rectangular concrete channel to a reinforced earth channel with precast block walls. The box culvert will be slightly longer than the existing bridge that is an angled crossing.
12. A 10-foot wide a reinforced earth channel with precast block walls continue 215-feet from downstream of the Roosevelt Way box culvert to the confluence with Jacks Run.

Proposed Effluent Limitations: The draft permit requires implementation of an Erosion and Sediment Control (E&S) Plan and a Post-Construction Stormwater Management (PCSM) Plan and compliance with Federal technology-based effluent standards at 40 CFR Part 450.
Rate or Frequency of Discharge: Stormwater discharges during and following earth disturbance activities are precipitation-induced and will vary depending on factors such as the area of impervious surfaces, the size and placement of best management practices (BMPs) and the intensity of precipitation.
Project Description: The project involves the replacement of the SR 0376 bridge over Nine Mile Run, Frick Park & Commercial Street. The proposed improvement consists primarily of replacing the existing structure with an arched steel delta frame bridge and roadway improvements along Commercial Street. Both Commercial Street and SR 0376 will remain on the same existing alignment. The proposed construction will also include drainage improvements, guide rail updates, utility relocations and stormwater management facilities
This permit does not authorize any obstructions or encroachments to any regulated watercourse or floodway. All permitting required for impacts to regulated watercourses or their floodway are subject to 25 Pa. Code Chapter 105. Appropriate authorization for impacts which require permitting under Chapter 105 must be obtained prior to beginning earth disturbance.
All limitations, conditions, procedures, testing, and monitoring which is part of the Soil Management Plan (SMP) and/or any Act 2 remediation plan or site characterization provided with this application are to be followed. No deviation from the SMP is permitted without written authorization from the Department (DEP).
• The contractor shall develop a written SMP using the SMP guidelines provided with this application prior to beginning earth disturbance. The plan shall be submitted to the Department prior to conducting earth disturbance. Should this plan cause any alterations to the approved E&S/PCSM Plans, an amendment application shall be submitted immediately.
• If contaminants or conditions with the potential to cause pollution are found during construction which are beyond the scope of the SMP or Act 2 considerations, DEP and the County Conservation District shall be notified and measures implemented to contain potential pollution sources immediately upon discovery.
• Any contaminated material to be transported and disposed of off-site including but not limited to pumped groundwater may require permitting with DEP's Waste Management or Clean Water programs. These permits should be anticipated and shall be secured prior to earth disturbance.
Proposed BMPs which are design alternatives to the E&S and/or PCSM Manuals shall be maintained and their effectiveness documented appropriately to evaluate effectiveness during their first 4 weeks of use. After this period, documentation of performance shall be submitted to the Conservation District and Department for consideration. Should review of this information indicate that the BMP(s) are failing to perform adequately to meet the guidance in the Manual(s) and Chapter 102, the Plan(s) shall be modified to meet these requirements and an amendment may be required. The following BMPs are subject to this condition: Channel outfalls which collect sediment laden water discharging to stilling basins and rock filters, Rock Filter Level Spreaders.

Scrubgrass Reclamation Company, LP Solid Waste and Residual Waste Site, 2151 Lisbon Road, Kennerdell, PA 16374. The Site is located in Scrubgrass Township, Venango County.
On November 9, 2023, the Department of Environmental Protection (Department), under the authority of the Solid Waste Management Act of July 7, 1980, P.L. 380, as amended, 35 P.S. §§ 6018.101—6018.1003; and the Clean Streams Law, Act of June 22, 1937, P.L. 1987, as amended, 35 P.S. §§ 691.1—691.1001, entered into a Consent Order and Agreement (COA) with Scrubgrass Reclamation Company, LP (Scrubgrass) for the removal of waste coal ash that has accumulated at the Scrubgrass Power Plant in Scrubgrass Township, Venango County, PA.
Since 2007, Scrubgrass has been utilizing their conditioning area, constructed from coal ash, to allow new coal ash to go through an exothermic reaction prior to being loaded onto a truck to be transported offsite. The COA identifies and addresses coal ash that has accumulated for more than one year and exceeded the limits of that pad and requires removal of coal ash in accordance with an approved schedule. It also addresses approximately 3.52 acres of earth disturbance activities associated with constructing a small scale solar power facility that Scrubgrass conducted prior to obtaining all of the necessary permit from the Department. Specifically, the COA requires Scrubgrass to, among other things: (1) remove all of the coal ash under a schedule that provides for complete removal by January 1, 2026; (2) submit an administratively complete NPDES permit application for the solar project within 60 days of the COA; and (3) pay a civil penalty in the amount of $28,800.

Persons aggrieved by this action may appeal this action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law).
The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street P.O. Box 8457, Harrisburg, PA 17105-8457, 717-787-3483. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.
