THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS

 The Department of Environmental Protection (DEP) has taken the following actions on previously received applications for new, amended, and renewed National Pollutant Discharge Elimination System (NPDES) and Water Quality Management (WQM) permits, applications for permit waivers, and Notice of Intent (NOIs) for coverage under General Permits, as listed in the following tables. This notice of final action is published in accordance with 25 Pa. Code Chapters 91, 92a, and 102 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). The official file for each listed action can be reviewed at the DEP or delegated County Conservation District (CCD) office identified in the table for the action. DEP/CCD office contact information is listed as follows for Section I and is contained within the table for Section II. Additional information for permits issued under 25 Pa. Code Chapters 91 and 92a and Individual permits under 25 Pa. Code Chapter 102, including links to Individual Chapter 92a NPDES and WQM Permits, may be reviewed by generating the ''Final Actions Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law).

 The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, 717-787-3483. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law. For individuals who wish to challenge an action, the appeal must reach the Board within 30-days. A lawyer is not needed to file an appeal with the Board. Individuals who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at 717-787-3483 for more information. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at 717-787-3483. Important legal rights are at stake, however, so individuals should contact a lawyer at once.

 For actions taken on applications for pipelines that are regulated by the Federal Energy Regulatory Commission (FERC).

 Any person aggrieved by this action may challenge it in an appropriate legal forum. The State and Federal courts are currently split on whether the proper forum to challenge a Department permit, authorization or approval for a facility or activity subject to the Federal Natural Gas Act, 15 U.S.C.A. §§ 717 et seq., is the United States Court of Appeals for the Third Circuit or the Pennsylvania Environmental Hearing Board. See Delaware Riverkeeper Network v. Sec'y, Dep't of Envtl. Prot., 833 F.3d 360 (3d Cir. 2016); Delaware Riverkeeper Network v. Sec'y, Dep't of Envtl. Prot., 903 F.3d 65 (3d Cir. 2018), cert. denied, 139 S. Ct. 1648, 203 L. Ed. 899 (2019) and Cole v. Dep't. of Envtl. Prot., 1577 C.D. 2019 WL 2420667 (Pa. Cmwlth Ct. June 15, 2021) (Pet. for Allowance of Appeal pending); West Rockhill Twp. v. Dep't of Envtl. Prot., No. 1595 C.D. 2019 WL 2426014 (Pa. Cmwlth. June 15, 2021) (Pet. for Allowance of Appeal pending).

Plan Description:

 Schuylkill County Municipal Authority Gordon/Butler Act 537 Plan Update. The proposal consists of the expansion of the Schuylkill County Municipal Authority (SCMA)—Gordon Wastewater Treatment Plant (WWTP) from 0.6 MGD to 1.5 MGD to accommodate flows from SCMA's existing Gordon Borough and Butler Township WWTPs as well as anticipated development within the planning area. The existing Butler Township WWTP will be converted into a pump station (0.288 MGD capacity) and convey wastewater to the proposed, expanded Gordon—SCMA WWTP. A ten-inch forcemain and a twelve-inch gravity conveyance line will be constructed to convey wastewater from the proposed Butler pumping station to the Gordon WWTP. SCMA will continue to own, operate and maintain their portions of the collection and conveyance systems located in Gordon Borough and Butler Township. The proposed Gordon—SCMA WWTP will continue to treat wastewater from the service area that is currently serviced by the existing Gordon Borough WWTP, as well as the service area that is currently serviced by the Butler Township WWTP.

 The proposed project will be funded by the Authority using PENNVEST funds or a United States Department of Agriculture Rural Utility Service (RUS) loan. The authority will seek traditional municipal loans if either of these funding methods are unavailable.

 The Plan proposes to utilize funding from the United States Department of Agriculture (USDA) Rural Development Program to fully implement the Plan's selected alternative's activities. This review has not identified any significant environmental impacts resulting from this proposal.

Plan Description:

 Glen Summit Area Act 537 Plan. The Plan's selected alternative involves the replacement of sanitary sewer lines to address multiple issues with the existing collection system in the Glen Summit area of the Township. The existing collection system's lines are comprised of several different materials that are severely deteriorated and at the end of their useful life. Accordingly, the existing sanitary sewer lines are subject to significant Inflow and Infiltration (I/I) which places additional burdens on the wastewater treatment plant (WWTP) that is owned, operated, and maintained by MAJSA. There are also many conflicts with the location of the existing collection system, as trees and portions of homes and decks are directly above the existing sewer lines. The existing lines will be abandoned in place. The proposed collection system will be more aligned with the area's roadways (all necessary easements are in place) and capable of expansion, if desired. There are currently 65 developed/residential dwellings and 32 undeveloped/vacant parcels (97 total EDUs) in the planning area. There is potential for future development, but this is not anticipated. MAJSA will continue to own, operate, and maintain the collection/conveyance system in their service area, and the sanitary wastewater will continue to be treated at their WWTP.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Following Plans and Reports Were Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. The Department Has Taken Action on the Following Plans and Reports Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.

The Department issued the State Only Operating Permit for Amerikohl Aggregates, Inc. Moscipan Mine. The sources at the facility include the processing plant (crushers, screens, conveyors, and stockpiles) and diesel engines. The engines are subject to 40 CFR 60 Subpart IIII. The processing plant is subject to 40 CFR part 60 Subpart OOO. DEM-63-00947: MarkWest Liberty Midstream & Resources, LLC, Tower 1, Suite 1600, Denver, CO 80202, Hopewell Township, Washington County. On November 16, 2022, Markwest Liberty Midstream & Resources submitted a request for a de minims emission increase at its Lowry Compressor Station. This Notice is published per 25 Pa. Code § 127.449(i). The compressor station is a natural gas gathering station with natural gas-fueled compressor engines. The project is the completion of a manufacturer offered ''CAT Low Emission Engine Upgrade'' on Source ID # 105 (CAT3516 LE, 1,340-bhp, SI, NG-fueled, compressor engine) and the associated removal of two (2) natural gas-driven pneumatic devices. The upgrade will reduce NOx emissions at full engine capacity to a maximum of 0.5 grams per bhp-hour. Markwest Liberty will comply with requirements in DEM-63-00947.

DEM-26-00413B: Texas Eastern Transmission, LP, 915 N. Eldridge Parkway, Suite 1100, Houston, TX 77079, North Union Township, Fayette County. On January 16, 2024, Texas Eastern Transmission, LP submitted a request for a de minims emission increase at its Uniontown Compressor Station. This Notice is published per 25 Pa. Code § 127.449(i). The compressor station is a natural gas pipeline, transmission station with natural gas-fueled compressor engines. The project is the addition of a system of necessary piping components to connect seven (7), new, natural gas, cooling bays, at the station. Texas Eastern Transmission will comply with requirements in DEM-26-00413B. Operation of the new piping components will potentially emit 0.33 ton of VOC, 0.01 ton of all HAPs combined, and 361 tons of CO2e, per year. Potential air emissions from the facility will increase by the same amount. Therefore, under item Number ''36 Source(s) qualifying under § 127.449 as de minimis emission increases.'' of ''Section 127.14(a)(8) Exemptions that do not require the submission of an RFD form'' in the Department's Plan Approval and Operating Permit Exemption List (275-2101-003/July 1, 2021) on Page 8, the change is exempt from requiring Department authorization. However, the upgrade and operation of the equipment are subject to certain requirements for this exemption to be effective. The constructed equipment and these requirements will be incorporated into the State Only Operating Permit at a later time. There was one earlier emission change at the Uniontown Compressor Station since the initial SOOP was issued on July 14, 2020. On November 9, 2022, this emission change increased potential facility emissions by 0.001 ton of VOC and 2.5 tons of CO2e, per year.
