Finding

[Saturday, March 23, 2024]Under section 2002 of The Administrative Code of 1929 (71 P.S. § 512) establishing the Department of Transportation (Department), the Director of the Bureau of Design and Delivery, as delegated by the Secretary of Transportation, makes the following written finding:
The proposed South Bridge Alternative is the preferred alternative for the I-83 South Bridge Replacement project, SR 0083, Section 094 in Dauphin and Cumberland Counties. The preferred alternative would consist of: (1) replacing the existing South Bridge with a wider five-lane per direction bridge, widened to the south; (2) reconfiguring the Lemoyne Interchange on the West Shore of the Susquehanna River, including replacing the South Third Street Bridge over I-83 and the Norfolk Southern Railroad with a wider and longer structure; and (3) replacing the viaduct (bridge) from the Susquehanna River to Cameron Street, and reconstructing the Front Street/Second Street Interchange on the East Shore of the Susquehanna River.
The Environmental Assessment (EA) and EA comment responses have been evaluated by the Federal Highway Administration (FHWA) and were determined to discuss adequately and accurately the need, environmental issues, and impacts of the proposed project and mitigation measures that will be taken to minimize harm as stipulated in the EA. Based on the EA, the FHWA has issued a finding of no significant impact for the project. The Bureau of Design and Delivery has concluded that all State Environmental Evaluation Requirements, as published in section 2002 of The Administrative Code of 1929, have been satisfied.
The proposed project is anticipated to result in the following minor alterations of the Harrisburg City Parks, 7 Parkway Plan/Capital Area Greenbelt: the newly reconstructed piers for the South Bridge and Second Street off ramp; the temporary relocation of the upper portion of the Greenbelt Trail during construction; the temporary closure of the lower portion of the Greenbelt Trail during construction, and the tree removal; and right-of-way acquisition. The FHWA has determined that the proposed project constitutes a de minimis use of the Harrisburg City Parks, 7 Parkway Plan/Capital Area Greenbelt. Based on the documentation, it can be concluded that the harm to the resource has been minimized, all feasible and prudent alternatives have been explored to avoid impact upon the resource and the intent of section 2002(a)(15) of The Administrative Code of 1929 has been fulfilled as it relates to this project.
In the absence of a feasible and prudent alternative that eliminates any impact to section 2002 resources, it is recommended that the Department proceed with further development of this project.
