STATE CONSERVATION COMMISSION

PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed (National Pollutant Discharge Elimination System) NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. A list of CCD office locations is available at http://www.nacdnet.org/about/districts/directory/pa.phtml or can be obtained from the SCC at the office address listed or by calling 717-787-8821.

 Individuals wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30-days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. Comments should include the name, address and telephone number of the writer and a concise statement to inform the SCC of the exact basis of the comments and the relevant facts upon which they are based.  Under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17), the following parties have applied for Public Water Supply (PWS) permits to construct or substantially modify public water systems.

 Individuals wishing to comment on permit applications are invited to submit statements to the office listed before the application within 30-days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding an application. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

Acknowledgment of Notice(s) of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent (NOI) to Remediate. An acknowledgment of the receipt of a NOI to Remediate is used to identify a site where an individual proposes to, or has been required to, respond to a release of a regulated substance at a site. Individuals intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a NOI to Remediate with DEP. A NOI to Remediate filed with DEP provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. An individual who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by DEP. Furthermore, an individual shall not be subject to citizen suits or other contribution actions brought by responsible individuals not participating in the remediation.

 Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the NOI to Remediate is published in a newspaper of general circulation in the area of the site. For the following identified site(s), proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30-days of the following specified date. During this comment period the municipality may request that the following identified individual, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

 The Department of Environmental Protection (DEP) has developed an integrated plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for DEP, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.

 The DEP received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, DEP's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate DEP Regional Office. Appointments for scheduling a review must be made by calling the appropriate DEP Regional Office. The address and telephone number of the Regional Office is listed before the application notices.

 Individuals wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the DEP's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.

 Any individual wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if DEP, in its discretion, decides that a hearing is warranted based on the information received. Persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper, the Pennsylvania Bulletin or by telephone, when DEP determines this type of notification is sufficient. Requests for a public hearing and any relevant information should be directed to the appropriate DEP Regional Office.

 Permits issued to the owners or operators of sources subject to 25 Pa. Code Chapter 127, Subchapter D or E, or located within a Title V facility or subject to 25 Pa. Code § 129.51(a) or permits issued for sources with limitations on their potential to emit used to avoid otherwise applicable Federal requirements may be submitted to the United States Environmental Protection Agency for review and approval as a revision to the State Implementation Plan. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. Code Chapters 121—145, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

PLAN APPROVALS


Notice of Intent to Issue Plan Approval(s) and Notice of Intent to Issue or Amend Operating Permit(s) Under the Air Pollution Control Act (35 P.S. §§ 4001—4015) and 25 Pa. Code Chapter 127, Subchapter B. These Actions May Include the Administrative Amendments of an Associated Operating Permit.

20-00145D: Vitro Meadville Flat Glass, 5123 Victory Blvd, Cochranton, PA 16314, Greenwood Township, Crawford County. Application received: October 16, 2023.

 The Department of Environmental Protection intends to issue a plan approval to Vitro Meadville Flat Glass, LLC (Vitro) for the reactivation and initial operation of existing glass production equipment and the construction and initial operation of control devices at their facility in Greenwood Township, Crawford County. This is an existing Title V facility (TV20-00145). Public notice is required for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44.

 This project would reactivate Source 102 (Glass Melting Furnace 8-2) and the associated glass manufacturing equipment which supports it: Sources 109 (Wareroom Packers 1—3), 112 (Cullet Drop 0 Line 2), 133 (Surface Passivation 2), and 176 (W System Line 2). Vitro's restart of these sources is planned for the first half of 2025.

 Vitro intends to reactivate air emission sources later than five years after their deactivation. Reactivation of sources occurring five years or more after deactivation requires Department approval and the equipment must meet Best Available Technology (''BAT'') as described in 25 Pa. Code § 127.11a(b). Emission reductions will achieved through the use of oxyfuel firing furnace burners (NOx reduction), Dry Sorbent Injection (SOx reduction), and a baghouse (PM reduction).

 This plan approval will address the specific requirements of reactivation. The Plan Approval will contain testing, recordkeeping, emission restriction, reporting, and work practice requirements designed to keep the facility operating within all applicable air quality requirements.

 Issuance of an Operating Permit or incorporation of a Plan Approval into a current Operating Permit is contingent upon satisfactory compliance with the Plan Approval conditions, upon the source and control device being installed and operated as stated within the application, and upon satisfactory demonstration that the emissions from the source will not be in violation of applicable Rules and Regulations of the Department.

 The special conditions of the draft Plan Approval include the following (abbreviated version):

Site Level ADDITIONAL

 a) If at any time the Department has reason to believe that the air contaminant emissions are, or may be, in excess of any applicable air contaminant emission limitation, the owner or operator shall conduct such stack tests or source tests requested by the Department to determine the actual air contaminant emission rate.

 b) No person may permit air pollution as that term is defined in the act.

 c) All sources shall be operated and maintained in such a manner that no owner or operator may permit the emission into the outdoor atmosphere of any malodorous air contaminants from any source such that the malodors are detectable outside the property of the owner or operator on whose land the facility is being operated.

 d) All requirements of the current operating permit (20-00145 issued by the Department on December 6, 2021, Authorization # 1371348) remain in effect, as applicable, unless modified by this plan approval. The conditions of this plan approval supersede the conditions of previous authorizations.

Site Level RECORDKEEPING

 a) All records required must be maintained onsite for a minimum of 5 years and may be maintained in electronic format.

 b) The owner or operator of the facility shall generate and maintain records that clearly demonstrate to the Department that the facility is in compliance with all emission limitations. The Department reserves the right to request additional information necessary to determine compliance with the plan approval.

Site Level WORK PRACTICE

 a) The permittee shall install, maintain, and operate sufficient instrumentation and monitoring equipment in order to comply with the recordkeeping requirements of this plan approval.

Site Level REPORTING

 a) The owner or operator shall notify the Department's Air Quality Program within twenty-four (24) hours of the discovery of any malfunction.

 b) The owner or operator shall notify the Department, in writing, no later than five (5) business days after the following activities:

 1) Initial commencement date of construction of the source/control device(s).

 2) Any lapse in construction activity of eighteen (18) months or more.

SOURCE 102

Emission Restrictions

 a) Emissions from the source shall not exceed:

 (1) SOx: 22 lbs/hr, 1 hour average.

 (2) NOx: 5.5 lbs/ton glass pulled, over a 30 day rolling average.

 i. The NOx emission values from the CEMs are to be used for compliance, along with the quantity of glass pulled, to determine the daily average emission rate in pounds of NOx per ton of glass pulled.

 ii. The daily average emission rate is to be combined with the emission rates from the previous 29 days to arrive at the 30-day rolling average emission rate in pounds of NOx per ton of glass pulled.

 (3) Total particulate matter emissions (combined filterable and condensable) in the exhaust of the control device shall not exceed 0.005 grain per dry standard cubic foot of effluent gas.

 b) Visible emissions from the exhaust stack shall not exceed 10% opacity.

BAGHOUSE

Source Level WORK PRACTICE

 a) All gauges employed shall have a scale such that the expected normal reading shall be no less than twenty percent (20%) of full scale and be accurate within plus or minus two percent (+/- 2%) of full scale reading.

 b) The permittee shall maintain and operate the following:

 (1) A magnehelic gauge or equivalent.

 (2) A triboelectric leak detection system. The system shall sound an alarm if a leak is detected.

 c) The permittee shall maintain and operate the source and control device in accordance with the manufacturer's specifications and in accordance with good air pollution control practices. A copy of the control device manufacturer's operational and maintenance literature shall be maintained onsite at all times and shall be readily available.

 d) The permittee shall perform preventative maintenance inspections of the control device including, but not limited to, the following:

 (1) An annual visual inspection of the control device interior for dislodged filter media, filter media wear, and dust build-up inside the control device.

 (2) A daily inspection of the control device effluent for the presence of visible emissions.

 (3) A daily reading and recording of the pressure differential across the filter media.

 (4) A daily reading and recording of the triboelectric leak detection system status/value.

 (5) All manufacturer recommended maintenance activities which shall be performed on the control device at the frequency recommended by the manufacturer.

 e) The owner or operator shall keep sufficient quantity of spare cartridges, at a minimum of 20% of the total number of cartridges.

Source Level RECORD KEEPING

 a) The permittee shall record the following operational data from the control:

 (1) Pressure drop across the baghouse (daily).

 (2) Triboelectric leak detection system status/value (daily).

 b) Manual log entries shall include the following:

 (1) Time and date of observation.

 (2) Name, title, and signature of the person making the observation.

 (3) Any corrective action taken as result of the observation.

 c) The permittee shall maintain a quarterly inventory of the number of spare filter cartridges onsite.

 d) The permittee shall record all excursions from the specified operational parameters for the control devices, the corrective actions taken in response to an excursion, and the time elapsed until the corrective actions.

 e) The permittee shall maintain records of all monitoring downtime incidents. The permittee shall also record the dates, times and durations, probable causes and corrective actions taken.

 f) The permittee shall maintain records of all preventative maintenance, repairs, and inspections performed on the sources, monitoring equipment, and control devices.



Source Level REPORTING

 a) The permittee shall report all excursions and corrective actions taken to the Department, including the dates, times, durations and probable causes, every six (6) months.

 b) The permittee shall report all monitoring downtime incidents, their dates, times and durations, probable causes and corrective actions taken, every six (6) months.

Source Level TESTING

 a) Within 60 days of achieving the source's normal production rate but no later than one hundred and eighty (180) days of startup, the permittee shall perform stack testing of the source/control device to determine the PM emission rate (combined filterable and condensable). Testing load conditions shall be representative to within 10% of maximum load design capacity or to within 10% of the maximum achievable operating load. Stack testing shall be performed in accordance with the provisions of Chapter 139 of the Rules and Regulations of the Department of Environmental Protection.

 a) The permittee shall adhere to the control device's approved indicator range so that operation within the range shall provide reasonable assurance of compliance.

 (1) The permittee shall develop a maximum and minimum pressure drop indicator range.

 (2) Triboelectric leak detection status/value.

 b) The permittee may develop a new pressure drop range with a detailed request which is reviewed and approved by the Department. The Department, at its discretion, may approve or deny a request to adjust the required indicator ranges.

 c) The permittee shall maintain all monitoring equipment and stock spare parts as necessary for routine onsite repairs.

 d) The permittee shall ensure that at least 90% of the approved monitoring data has been properly and accurately collected.

Source Level ADDITIONAL

 a) The permittee shall develop and implement a Quality Improvement Plan (QIP) as expeditiously as practicable within 60 days if any of the following occurs:

 (1) For properly and accurately collected data, accumulated excursions exceeding two percent (2%) of the data.

 (2) Six (6) excursions occur in a six (6) month reporting period.

 (3) The Department determines after review of all reported information that the permittee has not responded acceptably to an excursion.

OXYFUEL

Source Level WORK PRACTICE

 a) The permittee shall replace the glass melt furnace burners with oxyfuel fired burners before startup.

 b) The permittee shall maintain and operate the source and control device in accordance with the manufacturer's specifications and in accordance with good air pollution control practices. A copy of the control device manufacturer's operational and maintenance literature shall be maintained onsite at all times and shall be readily available.

 c) The permittee shall install, maintain, and operate sufficient instrumentation in order to record the following:

 (1) The amount of fuel combusted by this source.

 (2) The amount of glass produced by this source.

 d) The permittee shall perform preventative maintenance inspections of the oxyfuel burners including, but not limited to, the following:

 (1) A burner adjustment and tuning at the interval recommended by the manufacturer.

 (2) A monthly visual inspection of the burner, oxygen supply system, and fuel supply system.

 (3) All manufacturer recommended maintenance activities which shall be performed on the control device at the frequency recommended by the manufacturer.

Source Level RECORDKEEPING

 a) The permittee shall maintain records of all preventative maintenance, repairs, and inspections performed on the burners.

 b) The permittee shall maintain records of:

 1) The amount of fuel combusted by this source.

 2) The amount of glass pulled by this source.

 3) Hours of operation.

 4) Idling, start-up, and shutdown durations.

Source Level TESTING

 a) Within 60 days of achieving the source's normal production rate but no later than one hundred and eighty (180) days of startup, the permittee shall perform stack testing of the source/control device to determine the NOx emission rate (lb/hr, lb/ton glass pulled). Testing load conditions shall be representative to within 10% of maximum load design capacity or to within 10% of the maximum achievable operating load. Stack testing shall be performed in accordance with the provisions of Chapter 139 of the Rules and Regulations of the Department of Environmental Protection.

DRY SORBENT INJECTION

Source Level WORK PRACTICE

 a) The permittee shall inject dry sorbent at the rate approved by the Department. The injection rate shall be determined using Department approved source stack testing data, manufacturer's data, Vitro's glass formulation, and glass production rates/data.

 b) The permittee shall maintain and operate the control device in accordance with the manufacturer's specifications and in accordance with good air pollution control practices.

 c) A copy of the control device manufacturer's operational and maintenance literature shall be maintained onsite at all times and shall be readily available.

 d) The permittee shall install, maintain, and operate sufficient instrumentation in order to record the following:

 (1) Daily sorbent injection rate (tons/day, recorded daily).

 (2) Sorbent injection rate (lbs/hour, recorded continuously).

 (3) Daily sorbent injection rate (the day's tons sorbent injected/the day's tons glass produced).

 (5) The baghouse inlet temperature (recorded continuously).

 e) The permittee shall perform preventative maintenance inspections of the control device including, but not limited to, the following:

 (1) Daily visual inspection of the sorbent hopper, metering system, feed system, and injection system.

 (2) A monthly inspection of all DSI system motors which determines their functional performance and any maintenance needed.

 (3) All manufacturer recommended maintenance activities which shall be performed on the control device at the frequency recommended by the manufacturer.

 f) The permittee shall maintain a 15 day supply of sorbent at all times. Maintaining less than 15 days of sorbent due to documented supplier upsets or product availability shall not be considered a failure to comply with this requirement.

Source Level RECORDKEEPING

 a) The permittee shall record the following operational data from the control device (these records may be done with strip charts recorders, data acquisition systems, or manual log entries):

 (1) Daily sorbent injection rate (tons/day, recorded daily).

 (2) Sorbent injection rate (lbs/hour, recorded continuously).

 (3) Daily sorbent injection rate (the day's tons sorbent injected/the day's tons glass produced).

 e) The permittee shall maintain records of all monitoring downtime incidents (other than downtime associated with monitoring system checks). The permittee shall also record the dates, times and durations, probable causes and corrective actions taken for the incidents.

 f) The permittee shall maintain records of all preventative maintenance, repairs, and inspections performed on the sources, monitoring equipment, and control devices. These records shall contain the following at a minimum:

 (1) Time and date of the task.

 (2) Name, title, and initials of the person performing the task.

 (3) A detailed description any maintenance/inspection/repair performed.

 (4) Any problems or defects found.

 (5) Any corrective action taken as result of the task.

Source Level TESTING

 a) Within 60 days of achieving the source's normal production rate but no later than one hundred and eighty (180) days of startup, the permittee shall perform stack testing of the source/control device to determine the SOx emission rate (lb/hr). Testing load conditions shall be representative to within 10% of maximum load design capacity or to within 10% of the maximum achievable operating load.

 b) Within eleven (11) to thirteen (13) months after the previous approved stack testing program, a stack test shall be performed in accordance with the provisions of Chapter 139 of the Rules and Regulations of the Department of Environmental Protection and previously listed Conditions (a)—(g).

 c) After the completion of 3 consecutive SOx stack testing programs (all compliant and as outlined in (a)—(g) previously listed), the required SOx stack testing frequency shall become:

 (1) Within twelve (12) to eighteen (18) months prior to the expiration of the facility operating permit.

 a) All gauges employed shall have a scale such that the expected normal reading shall be no less than twenty percent (20%) of full scale and be accurate within plus or minus two percent (+/- 2%) of full scale reading.

 (2) A triboelectric leak detection system recommended by the manufacturer. The system shall sound an alarm if a leak is detected.

 c) The permittee shall maintain and operate the source and control device in accordance with the manufacturer's specifications and in accordance with good air pollution control practices.

 d) A copy of the control device manufacturer's operational and maintenance literature shall be maintained onsite at all times.

The Department's review of the information submitted by Boylan Funeral Homes & Cremation Center, Inc. indicates that the air contamination source to be operated will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12. Based on this finding, the Department proposes to issue a plan approval for the proposed operation. The air contaminant emissions from the proposed source included in this project will not exceed the following rates in any 12 consecutive month period: 0.49 ton of nitrogen oxides (NOx, expressed as NO2) per year, 1.64 tons of carbon monoxide per year, 0.49 ton of volatile organic compounds per year, 1.15 tons of particulate matter less than 10 microns and less than 2.5 microns, 0.12 ton of hazardous air pollutants, 0.41 ton of sulfur oxides, and 25,707 tons per year of carbon dioxide equivalent. The facility is a State Only facility. In addition to the emission limitations, the following is a brief description of the types of conditions the Department intends to place in the plan approval in order to ensure compliance with all applicable air quality regulatory requirements. Monitoring and recording chamber temperatures, inspecting for malodors, limits on the hours of operation, monitoring hours of operation, and performing routine maintenance. 43-270O: CCL Container Hermitage LLC, 1 Llodio Drive, Hermitage, PA 16148, City of Hermitage, Mercer County. Application received: October 23, 2023. The Department intends to issue a plan approval for the construction and temporary operation of an aerosol/beverage can manufacturing line (Source 114) with the air contaminant emissions to be controlled by two (2) existing regenerative thermal oxidizers (Control Devices C06 and C08) and one (1) existing baghouse (Control Devices C15A) at the Hermitage facility. The Department's review of the information submitted by CCL Container Hermitage, LLC indicates that the proposed source will meet all applicable air quality regulatory requirements, including the Best Available Technology requirements of 25 Pa. Code §§ 127.1 and 127.12 and 40 CFR Part 60 Subpart WW pertaining to air contamination sources and the emission of air contaminants. Based on these findings, the Department intends to issue plan approval for the construction of the proposed source. The following is a brief description of the conditions that the Department proposes to place in the plan approval to ensure compliance with all applicable regulatory requirements: 1. Pursuant to the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the volatile organic compound destruction efficiency of Control Devices C06 and C08 shall be greater than 98% or less than 10 parts per million at 3% oxygen; 2. Pursuant to the best available technology requirement of 25 Pa. Code §§ 127.1 and 127.12, the permittee shall not permit the emission of particulate matter into the outdoor atmosphere from Control Device C15A associated with Source 114 in a manner that the concentration of particulate matter in the effluent gas exceeds 0.02 grain per dry standard cubic foot; 3. Pursuant to the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the permittee shall install a manometer, or equivalent, to measure the pressure drop across the enclosure of Source 114. The pressure drop must be greater than 0.007 inch of water column; 4. Pursuant to the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12, the permittee shall maintain the capture efficiency of permanent enclosure (PE) 100% for Source 114 at all times; and 5. Pursuant to the best available technology requirements of 25 Pa. Code §§ 127.1 and 127.12. The permittee shall not operate Source 114 without the simultaneous operation of Control Devices C06, C08 and C15A at any time. 09-0210C: Waste Management of Fairless, Inc., 1000 New Ford Mill Rd, Morrisville, PA 19067, Falls Township, Bucks County. Application received: August 10, 2023. This action is for the proposed expansion of the Fairless landfill. The current landfill is permitted for 47.4 million bank cubic yards, 27.9 million tons of municipal solid waste (MSW) and covers 330.5 acres. The expansion will add 63.5 acres to the footprint of the landfill, increase capacity by 27.18 million bank cubic yards and permit an additional 20.51 million tons of MSW to be placed in the landfill. This modification will result in the increase of VOC emissions, after closure, to a maximum of 39.6 tons per year of controlled VOC emissions. No other emissions from the landfill will increase above the current permitted limits. VOC emissions from the landfill are controlled by a cap system and a landfill gas (LFG) system. At closure, the cap will have a minimum capture efficiency of 92% and the LFG system must reduce the VOC emissions by 98% by weight or to 20 ppmdv as hexane. An interim LFG system will collect and reduce the VOCs by the same amounts as required by the final, permanent system. The plan approval includes monitoring, recordkeeping and reporting requirements related to VOC emissions, construction of the LFG system, and maximum permitted capacity of the landfill based on Federal and State regulations. Requirements that are not part of the RACT 3 determination will be excluded from the SIP submittal; this includes the provisions of the Department's presumptive RACT 3 requirements in accordance with 25 Pa. Code § 129.112, as they apply to existing sources. (b) Utilize reagent in the SCR systems at a rate that its optimized for NOx control while minimizing ammonia slip, and (c) Operate and maintain the SCR systems in accordance with manufacturer specifications and good operating practices for the control of the NOx emissions. • The permittee shall create and maintain records of: (a) The hourly heat input for each unit; (b) The specific hourly ammonia injection amounts for each unit; and (c) The specific hourly NOx emission rate for each unit. The Department intends to issue the Title V Operating Permit (TVOP 17-0001) and Acid Rain Permit (TIVOP 17-00001) renewal regarding the Shawville Generating Station. In addition, the DEP has made a determination to approve an alternative Reasonably Available Control Technology (RACT 3) plan submitted for the previously listed facility and seeks approval of an amendment to the State Implementation Plan (SIP). The Shawville Generating Station facility's sources are comprised of the natural gas-fired utility boilers associated with Source IDs 031—034, along with the ancillary sources including the 1-MW generator diesel engines associated with Source IDs P101—P103, the emergency generator diesel engines associated with Source IDs P104 and P120, the two fire pump diesel engines associated with Source IDs P106, the various space heaters associated with Source ID 038, the parts washers associated with Source IDs P121, the wastewater treatment operation associated with Source ID P116, and the cooling towers associated with Source IDs P201. The type and quantity of emissions on a combined facility wide basis are estimated to be equal to approximately: 1,740 tons/yr nitrogen oxides (NOx); 1,400 tons/yr carbon monoxide (CO); 11 tons/yr sulfur oxides (as SO2); 25.9 tons/yr volatile organic compounds (VOC); 30 tons/yr hazardous air pollutants (as hexane), 2,020,000 tons/yr carbon dioxide (CO2); and 130 tons/yr PM2.5 and PM10. The renewal TVOP 17-00001 application incorporates the newly applicable regulations that are codified in 40 CFR Part 97 Subpart GGGGG (5G) and removes the existing coal-firing provisions and equipment that were previously used. Moreover, the facility will continue to be subject to minor source requirements for VOCs, including appropriate testing, monitoring, recordkeeping, reporting and other appropriate conditions to verify compliance. As previously noted, the facility's utility boilers are major for NOx and will be subject to the final alternative RACT 3 case-by-case NOx requirements as discussed in detail as follows. Additionally, the Department hereby provides notice of the intent to also approve the renewal Title IV Acid Rain Permit application for the Shawville Generating Station. The facility's utility boilers are Phase I units as per 40 CFR 72.2. Moreover, the boilers will continue to operate with low NOx gas burners and supplementary combustion air in order to comply with the Title IV Acid Rain Permit requirements. Based upon EPA's Acid Rain Program Database, the SO2 allowance allocations are summarized as follows:

 The other applicable air quality regulations include the existing Plantwide Applicability Limit (PAL) conditions specified in 25 Pa. Code § 127.218 and 40 CFR 52.21(aa) and the existing RICE MACT requirements specified in 40 CFR Part 63 subpart ZZZZ. The PAL limits were derived from the past coal-firing operating periods and will be adjusted, later, following receipt of the required PAL permit renewal application. No changes have been submitted regarding the existing RICE MACT conditions. Moreover, all the existing Best Available Technology (BAT) requirements remain in effect. TVOP 17-00001 contains all applicable air quality regulatory requirements, including appropriate testing, monitoring, recordkeeping, reporting and work practice conditions to verify compliance. The requirements are derived from 25 Pa. Code Article III, Chapters 121—145, relating to the rules and regulations of DEP. The emission limits, throughput limitations and work practice standards along with testing, monitoring, recordkeeping and reporting requirements have been included in the operating permit to ensure the facility complies with all applicable Federal and State air quality regulations. MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed National Pollutant Discharge Elimination System (NPDES) permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (DEP) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code § 77.522 are pH 6 to 9 and other parameters DEP may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 MarCor 223, LLC is proposing the removal of the existing dilapidated concrete retaining wall in and along the 100-year floodway of the Delaware River and to construct and maintain at the same location a 95.3-feet long by 14.6 feet high retaining wall. The northern end of the new wall will return a length to 10.6 feet at the end of it. The new wall will have reinforced weep holes for drainage of water build up. Stone riprap is proposed along the base of the new retaining wall. The riprap will extend waterward of the new wall no more than 5.0 feet and have a slope of 1.5H:1V resulting in 476.5 square feet (0.011 acre) of permanent watercourse impact. Additionally, the applicant is proposing to remove the existing 2,637 square-foot residential duplex and construct a new 2,853 square-foot residential duplex within the floodway of the Delaware River (WWF-MF).  For the purpose of constructing Phase II to the Wisecarver Recreation Park, creating communal recreational opportunities in and along the eastern side of the Wisecarver Run Reservoir. The project will cumulatively and permanently impact 416 linear feet of stream, 1,260 square feet (0.03 acre) of wetlands, and 3,038 square feet (0.07 acre) to the reservoir. The project will cumulatively and temporarily impact 416 linear feet of stream.

 The project site is located along Wisecarver Run Reservoir and State Route 4035, (Waynesburg, PA USGS topographic quadrangle; N: 39°, 54`, 18"; W: -80°, 12`, 29.3976"; Sub-basin 19B; USACE Pittsburgh District), in Franklin Township, Greene County.

 The applicant proposes to:

 1. Construct, operate and maintain an 8" sanitary sewer line crossing of a UNT to Sewickley Creek (WWF) registered using a GP-5.

 2. Construct, operate and maintain an 8" sanitary sewer line crossing of Wetland 01 (PEM) registered using a GP-5.

 3. Construct, operate and maintain an 8" sanitary sewer line crossing of the floodway of a UNT to Sewickley Creek (WWF) and Sewickley Creek (WWF) registered using a GP-5.

 4. Construct, operate and maintain a temporary stream and wetland crossing of the previously mentioned UNT to Sewickley Creek and Wetland 01 registered using a GP-8.

 For the purpose of demolishing two aboveground tanks and installing approximately 220 linear feet of 8" sanitary sewer line. The project will permanently impact 4 linear feet (0.01 acre) of stream and temporary impact 14 linear feet (0.01 acre) of stream of stream. The project will permanently impact 0.01 acre of floodway and temporarily impact 0.46 acre of floodway. 0.01 acre of wetland impact are anticipated for the temporary stream crossing and proposed pipeline. The project will impact 0.76 acre of floodplain for the removal of aboveground tanks, and temporary storage and construction materials.
