THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
FINAL ACTIONS TAKEN FOR NPDES PERMITS AND WQM PERMITS The Department of Environmental Protection (DEP) has taken the following actions on previously received applications for new, amended, and renewed National Pollutant Discharge Elimination System (NPDES) and Water Quality Management (WQM) permits, applications for permit waivers, and Notice of Intent (NOIs) for coverage under General Permits, as listed in the following tables. This notice of final action is published in accordance with 25 Pa. Code Chapters 91, 92a, and 102 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). The official file for each listed action can be reviewed at the DEP or delegated County Conservation District (CCD) office identified in the table for the action. DEP/CCD office contact information is listed as follows for Section I and is contained within the table for Section II. Additional information for permits issued under 25 Pa. Code Chapters 91 and 92a and Individual permits under 25 Pa. Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law).
The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, 717-787-3483. Appeals must be filed with the Board within 30-days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law. For individuals who wish to challenge an action, the appeal must reach the Board within 30-days. A lawyer is not needed to file an appeal with the Board. Individuals who cannot afford a lawyer may qualify for free pro bono representation. Call the Secretary to the Board at 717-787-3483 for more information. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at 717-787-3483. Important legal rights are at stake, however, so individuals should contact a lawyer at once.

For actions taken on applications for pipelines that are regulated by the Federal Energy Regulatory Commission (FERC).
Any person aggrieved by this action may challenge it in an appropriate legal forum. The State and Federal courts are currently split on whether the proper forum to challenge a Department permit, authorization or approval for a facility or activity subject to the Federal Natural Gas Act, 15 U.S.C.A. §§ 717 et seq., is the United States Court of Appeals for the Third Circuit or the Pennsylvania Environmental Hearing Board. Notice is hereby given that the Pennsylvania Department of Environmental Protection (DEP) will hold a virtual public hearing on Tuesday, July 2, 2024, beginning at 6:00 PM.
The purpose of this hearing is to accept and record testimony concerning the Pennsylvania General Energy Co., LLC (PGE) Phase IV Pipeline project application to construct 19,925 linear feet of 12" natural gas pipeline and 19,887 linear feet of two flexsteel waterlines in Cummings & McHenry Townships, Lycoming County.
Individuals who wish to present testimony at the virtual hearing and for inclusion in the administrative record must contact Megan Lehman, Regional Communications Manager, by email at meglehman@pa.gov or by phone at 570-327-3659 before noon on Monday, July 1, 2024, to reserve a time to present testimony. A link for those testifying to access the virtual hearing will be provided upon registration. Verbal testimony is limited to 3 minutes for each witness. Video demonstrations and screen sharing by witnesses will not be permitted. DEP asks that organizations designate one speaker per group. Time may not be shared or relinquished to others.
Those wishing only to listen and not testify may join the hearing via phone or internet connection. Access information can be found on the Virtual Public Hearing web page found at www.dep.pa.gov (select ''Public Participation'' and ''Calendar of Events'') or by contacting Megan Lehman.
Persons unable to attend the public hearing can submit a written statement to the DEP by close of business on Monday, July 22, 2024. All comments, whether delivered orally during the virtual hearing or submitted in writing, carry equal weight and consideration with DEP. Written statements should be sent via the U.S. Postal Service to Pennsylvania Department of Environmental Protection, Eastern Oil and Gas District Office, 208 West Third Street Suite 101, Williamsport, PA 17701, or emailed to RA-EPEASTERNOGPRG@pa.gov. Each written statement must contain the name, address, and e-mail address or telephone number of the person submitting the comments, identification of the permit application (Phase IV Pipeline), and a concise statement of the objections to the permit application and the relevant facts upon which the objections are based.
