State Board of Veterinary Medicine—
Euthanasia
Regulation No. 16A-5726 (# 3336)

 On March 10, 2022, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Board of Veterinary Medicine (Board). This rulemaking amends 49 Pa. Code §§ 31.101—31.115 and 31.121—31.130. The proposed regulation was published in the April 2, 2022 Pennsylvania Bulletin with a public comment period ending on May 2, 2022. The final-form regulation was submitted to the Commission on April 29, 2024.

 This regulation implements the act of October 24, 2012 (P.L. 1452, No 182) (Act 182) by providing for the licensure of animal protection organizations to purchase and possess drugs for euthanasia, and of euthanasia technicians to administer drugs for euthanasia.

 We have determined this regulation is consistent with the statutory authority of the Board (3 P.S. § 328.304 and 63 P.S. §§ 485.5(1) and 485.13(a)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

State Board of Crane Operators—
Licensure by Endorsement—Crane Operators
Regulation No. 16A-7104 (# 3338)

 On March 10, 2022, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Board of Crane Operators (Board). This rulemaking amends 49 Pa. Code Sections 6.16 and 6.17. The proposed regulation was published in the April 2, 2022 Pennsylvania Bulletin with a public comment period ending on May 2, 2022. The final-form regulation was submitted to the Commission on April 19, 2024.

 This regulation implements Act 41 of 2019 (Act 41) (63 Pa.C.S.A. § 3111) which requires licensing boards and commissions to issue a license, certificate, registration, or permit to an applicant who pays fees established by the board or commission by regulation, provided the applicant meets certain criteria for eligibility. Act 41 also requires boards and commissions that issue provisional licenses, certificates, registrations, or permits to set the expiration of the provisional endorsement license by regulation.

 We have determined this regulation is consistent with the statutory authority of the Board (63 Pa.C.S. § 3111; 63 P.S. § 2400.302(5)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

 On May 11, 2022, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Board of Auctioneer Examiners (Board). This rulemaking amends 49 Pa. Code Sections 1.5, 1.27 and 1.28. The proposed regulation was published in the May 21, 2022 Pennsylvania Bulletin with a public comment period ending on June 20, 2022. The final-form regulation was submitted to the Commission on April 19, 2024.

 This regulation implements Act 41 of 2019 (Act 41) (63 Pa.C.S.A. § 3111) which requires licensing boards and commissions to issue a license, certificate, registration, or permit to an applicant who pays fees established by the board or commission by regulation, provided the applicant meets certain criteria for eligibility. Act 41 also requires boards and commissions that issue provisional licenses, certificates, registrations, or permits to set the expiration of the provisional endorsement license by regulation.

Bureau of Professional and Occupational Affairs—
Consideration of Criminal Convictions
Regulation No. 16A-66 (# 3361)

 On November 4, 2022, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Bureau of Professional and Occupational Affairs (Bureau). This rulemaking amends 49 Pa. Code Chapter 43b. The proposed regulation was published in the November 19, 2022 Pennsylvania Bulletin with a public comment period ending on December 19, 2022. At its April 18, 2024 public meeting, the Commission voted to disapprove the final-form regulation. On June 3, 2024, the Department submitted its report containing the revised final-form regulation to the Commission.

 This regulation provides for schedules of criminal convictions that may constitute grounds to refuse to issue, suspend, or revoke a license, certificate, registration, or permit for each of the 29 professional and occupational licensing boards/commissions.

 We have determined this regulation is consistent with the statutory authority of the Bureau (63 Pa.C.S. § 3117; 71 P.S. §§ 186 and 279.1(a)(7) and (8)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Regulation No. 57-335 (# 3330)

 On January 25, 2022, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Pennsylvania Public Utility Commission (PUC). This rulemaking amends 52 Pa. Code Chapter 59. The proposed regulation was published in the February 12, 2022 Pennsylvania Bulletin with a public comment period ending on May 12, 2022. The final-form regulation was submitted to the Commission on April 26, 2024.

 This final-form regulation establishes construction standards for hazardous liquid public utilities constructing new pipelines and converting, relocating or replacing existing pipelines. It also establishes reporting requirements, operations and maintenance standards, pipeline personnel and land agent qualifications, and corrosion control standards for all hazardous liquid public utilities.

 We have determined this regulation is consistent with the statutory authority of the PUC (66 Pa.C.S. §§ 501(b) and 1501) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
