 Formal complaints have been issued by the Pennsylvania Public Utility Commission. Answers must be filed in accordance with 52 Pa. Code (relating to public utilities). Answers are due July 29, 2024, and must be made with the Secretary, Pennsylvania Public Utility Commission, 400 North Street, Harrisburg, PA 17120, with a copy to the First Deputy Chief Prosecutor, Pennsylvania Public Utility Commission.

COMPLAINT

 The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:

 1. That Courierstat 365, LLC, Respondent, maintains a mailing address of 20734 Route 19, Cranberry Township, PA 16066.

 2. That on August 18, 2023, by Commission Secretarial letter, Respondent was issued a certificate of public convenience by this Commission authorizing transportation, as a common carrier, by motor vehicle, property, excluding household goods in use, between points in Pennsylvania at PUC utility code no. 8925307 at A-2023-3042160.

 3. That PUC Enforcement Officer Vincent Gentile attempted to contact the Respondent by phone on February 5, 2024 through February 7, 2024, recording voicemails each time to contact the officer. On April 18, 2024, Officer Gentile called again, and the phone was no longer in service. On April 22, 2024, a certified letter was sent to the Respondent, which was returned to the Pittsburgh office on April 29, 2024. Officer Gentile has not received any response to these attempts.

 4. That Respondent, by failing to respond to and achieve a satisfactory evaluation on a safety fitness review, violated 66 Pa § 501(c) & § 504. The penalty for this violation is cancellation of the certificate held by Respondent with this Commission at utility code 8925307.

 Wherefore, the Bureau of Investigation and Enforcement hereby requests that the Commission revoke the certificate of public convenience issued to Courierstat 365, LLC, at PUC utility code number 8925307.

 D. If you file an Answer which contests the Complaint, the matter will be assigned to an Administrative Law Judge for hearing and decision. The judge is not bound by the optional fine set forth above.

COMPLAINT

 The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:

 1. That Latino Taxi Service, LLC, Respondent, maintains its principal place of business at 25 East Broad Street, West Hazleton, PA 18202.

 2. That Respondent was issued a certificate of public convenience for taxi authority by this Commission on October 11, 2017, at PUC No. 6320054 certificate A-2017- 2613993.

 3. That on February 29, 2024, PUC Officer Elliott Miller, was assigned a followup inspection of taxi number 88, a 2014 Honda CRV license plate PA TX50233. Arriving at Poplar Street, Hazleton City, Luzerne County, Officer Miller conducted a Driver/Vehicle Compliance Report on taxi 88, being driven by Mary Ortiz.

 4. The following violation was discovered. Both front tires on the vehicle were worn so that the tread wear indicators contacted the road in any two adjacent grooves.

 5. That Respondent, by operating a vehicle with two front tires that did not comply with safe operating conditions, violated 67 Pa. Code § 175.65. The penalty for this violation is $100.00 per violation for a total of $200.00.

 Wherefore, the Bureau of Investigation and Enforcement hereby requests that the Commission fine Latino Taxi Service, LLC the amount of two hundred dollars ($200.00) for the illegal activity described in this Complaint and order such other remedy as the Commission may deem to be appropriate.
