THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

APPLICATIONS FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS UNDER THE CLEAN STREAMS LAW AND FEDERAL CLEAN
WATER ACT

 This notice provides information about persons who have applied to the Department of Environmental Protection (DEP) for a new, renewed, or amended NPDES or WQM permit, or a permit waiver for certain stormwater discharges, or have submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications and NOIs concern, but are not limited to, effluent discharges from sewage treatment facilities and industrial facilities to surface waters or groundwater; stormwater discharges associated with industrial activity (industrial stormwater), construction activity (construction stormwater), and municipal separate storm sewer systems (MS4s); the application of pesticides; the operation of Concentrated Animal Feeding Operations (CAFOs); and the construction of sewage, industrial waste, and manure storage, collection and treatment facilities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).  Section I identifies the following applications and NOIs that have been received by DEP:

 • Individual and General WQM Permit Applications Received—DEP provides a 15-day public comment period for Individual WQM Permit Applications for new and reissued permits. There is no public comment period for General WQM Permit NOIs.

 • General Chapter 92a NPDES Permit NOIs Received—There is no public comment period for General NPDES NOIs received.

 • All Transfer and Minor Amendment Applications/NOIs Received—Transfer and Minor Amendment Applications/NOIs received for Individual and General WQM Permits and Individual and General NPDES Permits, excluding PAG-01 and PAG-02, are identified but do not have public comment periods. DEP provides a 15-day public comment period for Individual WQM Permit Applications for amendments.

 Additional information on these applications and NOIs may be reviewed by generating the ''Applications and NOIs without Comment Periods Report'' or, for Individual WQM Permit Applications, the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

 Section II identifies individual NPDES permit applications received and draft permits indicating DEP's tentative determination relating to sewage, industrial waste, industrial stormwater, MS4s, pesticides and CAFOs. A 30-day public comment period applies to these applications and draft permits, except when a site-specific water quality criterion is used to establish effluent limitations, in which case a 45-day public comment period applies. The period for comment may be extended at the discretion of DEP for one additional 15-day period. Additional information, including links to draft permits and fact sheets that explain the basis for DEP's tentative determinations may be reviewed by generating the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice. Notification of 15-day extensions for comment will be provided in the ''Applications Received with Comment Periods Report'' (Comments column).

 Section III identifies individual NPDES permit applications received and draft permits indicating DEP's tentative determination relating to stormwater discharges associated with construction activities. A 30-day public comment period applies to these applications and draft permits. The period for comment may be extended at the discretion of the Department for one additional 15-day period. Additional information may be reviewed by generating the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

 Applications, NOIs and draft permits, where applicable, may be reviewed at the DEP office that received the application or NOI. Members of the public are encouraged to use DEP's website to obtain additional information as discussed previously.

 Comments received within the appropriate comment periods for WQM and NPDES permit applications will be retained by DEP and considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform DEP of the exact basis of a comment and the relevant facts upon which it is based.

 DEP will also accept requests or petitions for public hearings on applications. The request or petition must indicate the interest of the party filing and the reasons why a hearing is warranted. A hearing will be held if DEP determines that there is a significant public interest. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. DEP will postpone its final determination until after a public hearing is held.

 Project Description: Wright Brothers Construction VII LLC proposes to develop the Vanport Clean Fill Facility in a former sand and gravel quarry in Vanport Twp, Beaver County. The overall area of the quarry that will be filled is 7.64 acres (LOD). Because the quarry site currently does not discharge any stormwater, there will be no stormwater discharge from the site post-development. Stormwater will be managed with Stormwater Basin VP-3 (forebay, infiltration bay, water polishing bay) and Subsurface Infiltration Systems A and B. All stormwater is proposed to be infiltrated on site.

 Special Conditions: 1. Infiltration testing shall be performed after construction of PCSM BMPs to verify the accuracy of the assumed infiltration rates used in the design of PCSM BMPs. If a deviation occurs which will cause alterations to the function of these BMPs and/or not meet the requirements of the SWM Manual (or Chapter 102), a plan amendment must be submitted prior to submission of the Notice of Termination (NOT) for the permit. 2. This permit does not authorize any obstructions or encroachments to any regulated watercourse or floodway. All permitting required for impacts to regulated watercourses or their floodway are subject to 25 Pa. Code Chapter 105. Appropriate authorization for impacts which require permitting under Chapter 105 must be obtained prior to beginning earth disturbance. 3. Prior to the beginning of work, all public water supplies or other water-related activities located downstream that may be affected by turbidity increases or other water quality changes caused by said work shall be sufficiently notified in advance to allow for preparation of any water quality changes. These include, at a minimum, Vanport Township Municipal Water Authority at 724-775-1038 and Brighton Township Municipal Authority at 724-774-4803.

Plans permitted under PAC140042 were only partially constructed, which included an infiltration basin identified as the South Basin located northeast of the warehouse development. The proposed development will use the South Basin (BMP ID 02) to control stormwater before discharging to POI-2. The proposed development will also include an Infiltration Basin (BMP ID 01) to control stormwater before discharging to POI-3.
