Reporting of Special Schedule ''W'' Data Call Information; Notice 2024-14

 Each year, the Insurance Department (Department) conducts a workers' compensation Special Schedule ''W'' data call. This reporting is used to determine the assessments that fund the Subsequent Injury Fund, the Supersedeas Fund, the Workers' Compensation Administration Fund, the Uninsured Employers Guaranty Fund and the Office of Small Business Advocate.

 The data call was updated to remove the requirement to report on sections 9740 and 9741 of Part A and Parts B—E. Reporting only includes sections 1—5 of Part A. The Schedule ''W'' data call information is due in mid-April each year, typically on April 15th, unless April 15th falls on a weekend, in which case the due date is extended to the Monday immediately following April 15th.

 The Department continues to experience delays in receiving Schedule ''W'' reports. Late reporting creates significant challenges to timely determining the appropriate assessment of each insurer and self-insurer for the previously listed funds.

 Section 655 of The Insurance Company Law of 1921 (40 P.S. § 815) provides that any insurance carrier that fails to submit a timely Schedule ''W'' ''shall forfeit one hundred dollars for each day during which such neglect continues, and, upon notice by the Insurance Commissioner, its authority to do business shall cease while such default continues.''

 Insurers are reminded of the Department's jurisdiction to investigate potential violations for untimely Schedule ''W'' submissions and the Department's ability to enforce this requirement with the penalties identified in section 655 of The Insurance Company Law of 1921. The Department encourages insurers to ensure compliance with these requirements, which have been established to allow timely and accurate assessment determinations.
