Findings

[Saturday, August 31, 2024]Under section 2002 of The Administrative Code of 1929 (71 P.S. § 512) establishing the Department of Transportation (Department), the Director of the Bureau of Design and Delivery, as delegated by the Secretary of Transportation, makes the following written findings:
The Department is planning the following projects. Environmental and Section 4(f) Documentation have been developed for the following identified projects to evaluate the potential environmental impacts caused by these projects. The Section 4(f) documents also serve as the Section 2002 Evaluation. The approved documents are available in the CE/EA Expert System at dominoappsbp. penndot.pa.gov/ceea/ceeamain.nsf. The environmental, economic, social and other effects of the proposed projects have been considered. Based upon studies, there is no feasible and prudent alternative to the use of the Section 2002 resources for the proposed projects identified, and all reasonable steps have been taken to minimize the effects.
• SR 0062, Section 13M—Sandycreek Township and the City of Franklin, Venango County.
Project Description: The project is for resurfacing as well as intersection, signal and ADA sidewalk improvements on State Route (SR) 62, SR 322 and SR 8.
Environmental Documents: CE 1b Evaluation approved on June 5, 2024, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on January 30, 2024.
Proposed Use of Section 4(f)/2002 Resource: Approximately 0.0237-acre of right-of-way (ROW) will be required from the approximately 26 city blocks of the City of Franklin Historic District, which is listed in the National Register of Historic Places (NRHP).
• SR 0006, Section 131—Wysox Township, Bradford County.
Project Description: The project is for intersection improvements at the SR 6 and SR 187 intersection.
Environmental Documents: CE 1b Evaluation approved on May 8, 2024, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on April 26, 2024.
Proposed Use of Section 4(f)/2002 Resources: Approximately 0.020-acre of ROW from Pipher's Bar and Diner and 0.016-acre of traffic signal easement from Lehigh Valley Railroad is required, both of which were determined eligible for listing in the NRHP.
• SR 0419 Section 02B—Heidelberg and Marion Townships and Womelsdorf Borough, Berks County.
Project Description: The project is the replacement of the North Third Street Bridge (SR 0419) over Tulpehocken Creek.
Environmental Documents: CE 2 Evaluation approved on May 24, 2024, and two Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on February 23, 2024.
Proposed Use of Section 4(f)/2002 Resources: Approximately 0.08-acre of ROW will be required from the Braun Mill property, which is determined eligible for listing in the NRHP. Approximately 0.43-acre of ROW will be required from the 14-mile corridor of Tulpehocken Creek Historic District, which is listed in the NRHP.
• SR 0611 Section WCW—Williams Township, Northampton County.
Project Description: The project is the replacement of the retaining wall supporting SR 611 alongside the Delaware Canal.
Environmental Documents: CE 2 Reevaluation approved on June 11, 2024, a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on May 13, 2024, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on August 16, 2023.
Proposed Use of Section 4(f)/2002 Resources: Approximately 0.09-acre of ROW will be required from the Delaware Division of the Pennsylvania Canal, which is listed on the NRHP and 0.08-acre from the approximately 830-acre Delaware Canal State Park, which qualifies as a Section 4(f)/2002 resource.
• SR 0073, Section MS2—Skippack Township, Montgomery County.
Project Description: The project is the replacement of the existing structure that carries Skippack Pike Bridge (SR 0073) over Skippack Creek.
Environmental Documents: CE 1b Reevaluation approved on May 2, 2024, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Public Parks, Recreation Areas, Wildlife and/or Waterfowl Refuges, State Forest Land and State Game Land approved on September 20, 2023.
Proposed Use of Section 4(f)/2002 Resource: The project will require approximately 1.168-acres of ROW from the 3,349-acre Evansburg State Park, which qualifies as a Section 4(f)/Section 2002 resource.
• SR 0347, Section 253—Scott Township, Lackawanna County.
Project Description: The project is the replacement of the existing structure that carries Justus Road (SR 0347) over Kennedy Creek.
Environmental Documents: ED BRPA Evaluation approved on May 16, 2024, and a Determination of Section 4(f) De Minimis Use Section 2002 No Adverse Use Historic Properties approved on April 4, 2024.
Proposed Use of Section 4(f)/2002 Resources: Approximately 0.026-acre of ROW will be required from the 61-acre farm located at 321 Justus Boulevard, which is determined eligible for listing on the NRHP.
