 The Independent Regulatory Review Commission met publicly at 10 a.m., Thursday, August 15, 2024, and announced the following:

Pennsylvania Liquor Control Board—
Duties and Rights of Licensees
Regulation No. 54-104 (# 3372)

 On April 25, 2023, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Pennsylvania Liquor Control Board (Board). This rulemaking amends 40 Pa. Code §§ 5.30 and 5.32. The proposed regulation was published in the May 20, 2023 Pennsylvania Bulletin with a public comment period ending on June 19, 2023. The final-form regulation was submitted to the Commission on June 11, 2024.

 The rulemaking amends the Board's Amusement and Entertainment regulations by adding definitions, updating statutory citations, and increasing the prize limits for activity on licensed premises to be consistent with the Local Option Small Games of Chance Act.

 We have determined this regulation is consistent with the statutory authority of the Board (47 P.S. § 2-207(i)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Department of Military and Veterans Affairs—
Persian Gulf Conflict Veterans' Benefit Program
Regulation No. 13-7 (# 3408)

 On June 18, 2024, the Independent Regulatory Review Commission (Commission) received this regulation from the Department of Military and Veterans Affairs (Department). This rulemaking rescinds 43 Pa. Code Chapter 9. Notice of proposed rulemaking was omitted for this regulation; it will become effective upon publication in the Pennsylvania Bulletin.

 This final-omitted rulemaking deletes an obsolete Chapter of the Department's regulations.

 We have determined this regulation is consistent with the statutory authority of the Department (45 P.S § 1204(3)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
