STATE CONSERVATION COMMISSION

PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed (National Pollutant Discharge Elimination System) NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. A list of CCD office locations is available at http://www.nacdnet.org/about/districts/directory/pa.phtml or can be obtained from the SCC at the office address listed or by calling 717-787-8821.

 Individuals wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30-days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. Comments should include the name, address and telephone number of the writer and a concise statement to inform the SCC of the exact basis of the comments and the relevant facts upon which they are based. PUBLIC WATER SUPPLY PERMITS

 Under the Pennsylvania Safe Drinking Water Act (35 P.S. §§ 721.1—721.17), the following parties have applied for Public Water Supply (PWS) permits to construct or substantially modify public water systems.

 Individuals wishing to comment on permit applications are invited to submit statements to the office listed before the application within 30-days of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding an application. A comment should include the name, address and telephone number of the writer and a concise statement to inform the Department of Environmental Protection (DEP) the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held after consideration of comments received during the 30-day public comment period.

Acknowledgment of Notice(s) of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent (NOI) to Remediate. An acknowledgment of the receipt of a NOI to Remediate is used to identify a site where an individual proposes to, or has been required to, respond to a release of a regulated substance at a site. Individuals intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a NOI to Remediate with DEP. A NOI to Remediate filed with DEP provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. An individual who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by DEP. Furthermore, an individual shall not be subject to citizen suits or other contribution actions brought by responsible individuals not participating in the remediation.

 Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the NOI to Remediate is published in a newspaper of general circulation in the area of the site. For the following identified site(s), proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30-days of the following specified date. During this comment period the municipality may request that the following identified individual, as the remediator of the site, develop and implement a public involvement plan. Requests to be involved, and comments, should be directed to the remediator of the site.

Onsite soil is impacted with select metals (including arsenic, lead, and antimony) at concentrations above PA DEP SHS. Groundwater onsite is impacted with chlorinated solvents, which appears to have migrated offsite near the north side of 9th Street slightly above applicable PA DEP SHS. Free product or light non-aqueous phase liquids (LNAPL) are present above the water table in a limited area of the north-central portion of the site. LNAPL does not appear to have migrated offsite. A fingerprint analysis of the LNAPL indicates it is a mixture of kerosene and lubricating oil or grease. The site was a former industrial facility, which manufactured gas meters and controlling equipment from 1895-2004. Machine shops operated onsite using cutting oils and chlorinated solvents as degreasers. The soil and groundwater impacts appear linked to historical manufacturing opera-tions formerly conducted onsite. There are currently no buildings onsite and impacts to both soil and groundwater are covered by an asphalt cap over the entire parcel with the perimeter surrounded by a chain-link fence. The current and anticipated future use of the property is commercial. The Notice of Intent to Remediate was published in Erie Times on September 25, 2024. Application received: September 30, 2024.

AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

 The Department of Environmental Protection (DEP) has developed an integrated plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for DEP, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.

 The DEP received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, DEP's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate DEP Regional Office. Appointments for scheduling a review must be made by calling the appropriate DEP Regional Office. The address and telephone number of the Regional Office is listed before the application notices.

 Individuals wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the DEP's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.

 Any individual wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if DEP, in its discretion, decides that a hearing is warranted based on the information received. Persons submitting comments or requesting a hearing will be notified of the decision to hold a hearing by publication in the newspaper, the Pennsylvania Bulletin or by telephone, when DEP determines this type of notification is sufficient. Requests for a public hearing and any relevant information should be directed to the appropriate DEP Regional Office.

 Permits issued to the owners or operators of sources subject to 25 Pa. Code Chapter 127, Subchapter D or E, or located within a Title V facility or subject to 25 Pa. Code § 129.51(a) or permits issued for sources with limitations on their potential to emit used to avoid otherwise applicable Federal requirements may be submitted to the United States Environmental Protection Agency for review and approval as a revision to the State Implementation Plan. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. Code Chapters 121—145, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

The Department intends to issue a plan approval for the upgrade of Compressor Engine Source 108 to improve combustion stability and performance of the engine at the Boom Compressor Station. The following is a brief description of the conditions that the Department proposes to place in the plan approval to ensure compliance with all applicable regulatory requirements: Pursuant to 25 Pa. Code § 127.443: 1. The nitrogen oxide emissions from Source 108 shall not exceed 1.5 grams per brake horsepower-hour, and, 2. Source 108 shall be equipped with Pre-Combustion Chamber ePPCTM, Electronic Port Fuel Injection (EPFI) and HyperBalanceTM Systems along with the installation of a turbocharger and an aftercooler. The plan approval will include all regulatory requirements, including testing, monitoring, recordkeeping, and reporting requirements. The facility is a State Only facility. If the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specification of the application for Plan Approval 59-00006C, the requirements established in the plan approval will be incorporated into State Only (Synthetic Minor) operating permit 59-00006 pursuant to the administrative amendment provisions of 25 Pa. Code § 127.450.  The Department of Environmental Protection intends to issue a plan approval to Mountain Gathering re-authorize the operation of Forward Compressor Station and modify permit conditions and requirements at their facility located in Forward Township, Butler County. Mountain Gathering Forward Compressor Station is a Natural Minor facility and natural gas compressor station under State Only Permit # 10-00381. Public notice is required for sources required to obtain a Plan Approval in accordance with 25 Pa. Code § 127.44.

 The following sources are affected by this Plan Approval:

 • Six (6) 1,775 BHP Caterpillar G3606TA compressor engines rated at 13.44 MCF/hr (Source 101—106) and associated Catalytic Combustion RGTB-2516F-D-15HF-HFX1 oxidation catalysts to control emissions (Source C101—C106).

 • One (1) 104 MMSCFD Natco TEG Dehydrator (Source 401) and associated Zeeco T20287F enclosed flare (Source C301) and BTEX Condenser (Source C401).

 This Plan Approval was submitted for the following reasons:

 1. To revise their site wide emission limit to 49 tpy VOC from 38 tpy VOC.

 2. To replace the oxidation catalyst pressure, drop requirements to periodic monitoring outlined in the latest GP5 requirements for compressor engines.

 3. Adding Promax as an authorized software to calculate emissions.

 Revising the emission limits of the TEG dehydrator to 7.46 tpy VOC.

 These requests and application were submitted due to a Notice of Violation issued to the applicant dated July 11, 2023. The violations were:

 1. Exceeding the site wide VOC limit of 38 tpy VOC with actual emissions of 38.17 tpy.

 2. Exceeding the source specific VOC limit of 2.12 tpy VOC with actual emissions of 3.19, 3.19, and 2.27 tpy VOC in 2019, 2020, and 2021 from source 401.

 3. Exceeding the pressure drop requirements of 2 in. of water across the oxidation catalysts on the engines.

 4. Other violations unrelated to the application.

 An updated site wide emissions calculation along with an updated site-specific gas analysis reveals that the site wide Potential to Emit (PTE) for VOC is 45.58 tpy. Going forward the site wide limit be 49 tpy VOC on a 12-month rolling basis. Recordkeeping will be required to show compliance with this limitation. Previously, the PTE of 2.12 tpy VOC for source 401 did not represent an accurate emission rate for the source. Updated PTE calculations reveal that the rate is closer to 7.46 tpy VOC. Going forward this will be the new emission limit for Source 401. The source is controlled by an enclosed flare and BTEX condenser.

 The applicant states that the oxidation catalyst pressure drop requirements in the current SOOP for the engines (Source 101—106) may not have been indicative of control device malfunctions. Going forward, the applicant proposes to do more stringent periodic monitoring for NOx and CO, similar to what is required for engines in the GP5. This includes annual performance testing and periodic monitoring every 2,500 hours of operation utilizing portable analyzers to detect emissions exceeding applicable limits. DEP agrees that this is acceptable, and will remove the catalyst pressure drop monitoring and instead include the periodic monitoring condition in this plan approval.

 Based on BAT, site wide PTE, and regulatory requirements the modified emission limits will be as follows:

 • All limits not modified by this plan approval remain in place.

 • 49 tpy VOC based on a 12-month rolling total site wide.

 • 7.46 tpy VOC for source 401.

 In accordance with 25 Pa. Code §§ 127.424, 127.425 and 127.521, the Department is providing notice that they intend to issue a natural minor State Only Operating Permit for the operation of a pet crematory located in North Strabane Township, Washington County.

 Sources of emissions consist of one Matthews International-Cremation Division (''Matthews'') IE43-PPII animal crematory incinerator with a 150 lbs/hr capacity and 750 lbs capacity per batch and one Matthews IEB-26 animal crematory incinerator with a 200 lbs/hr capacity and 750 lbs capacity per batch. Both units are equipped with a secondary chamber afterburner that meet current best available technology standards. MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed National Pollutant Discharge Elimination System (NPDES) permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. Alkalinity must always be greater than acidity.

 A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code § 77.522 are pH 6 to 9 and other parameters DEP may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

The proposed structure will utilize R-8 Rip Rap, choked R-4 Rip Rap as scour protection along the Integral Abutment Slopes. The project will utilize a detour to convey traffic during construction. The project will utilize a concurrent sandbag cofferdam system to convey the stream during construction. The project will temporarily impact 0.7 acre and permanently impact 0.01 acre of jurisdictional wetlands. The wetland impact is considered de minimis and does not require mitigation. The proposed bridge will be constructed on the same vertical and horizontal alignment. The proposed structure is beyond the thresholds to meet GP-11.  The applicant seeks to amend permit number E02052-1821, which granted consent to:

 1. Operate and maintain an existing docking facility along the right downstream bank of the Monongahela River (WWF-N) at River Mile 14.1, consisting of a 195` x 35` working barge and a 500` piling wall.

 2. Operate and maintain a stormwater settling pond for industrial discharges in association with the maintenance of the docking facility.

 3. Construct, operate and maintain a 94` x 87` construction conveyor located within the floodway.

 4. Perform maintenance dredging in the Monongahela River to an area of 500` x 87` (1 acre) and depth of 10.5` at the docking facility.

 This amendment proposes to:

 1. Construct and maintain a new 400` long by 50` wide by 32` high wharf, within and along the right descending bank of Monongahela River (WWF, N) and its floodway, at River Mile 14.1, within a portion of the area where maintenance dredging was previously authorized, consisting of a seawall with aggregate backfill, resulting in the loss of 0.164 acre of open water area along 400 linear feet (LF) of watercourse and 0.400 acre of permanent floodway impacts.

 2. Increase the depth of previously authorized maintenance dredging in the Monongahela River in a 150` long by 30` wide area along a portion of the new wharf detailed in item 1 from a depth of 10.5` to a depth of 14` below the normal pool elevation, resulting in 150 LF of temporary watercourse impacts.

 3. Perform new maintenance dredging in the Monongahela River in a 250` long by 30` wide area (0.178 acre) along the remaining portion of the new wharf detailed in item 1 to a depth of 14` below the normal pool elevation, resulting in 250 LF of permanent watercourse impacts.

 The amendment is for the purpose of allowing for the onloading and offloading of an additional barge at the Facility.

 Cumulatively, the amendment activities will result in an additional 400 linear feet of permanent watercourse impacts and 0.400 acre of permanent floodway impacts.

 As compensatory mitigation for permanent impacts to watercourses, specifically to shallow water habitat, the applicant will place substrate within a 170` long by 45` wide area of the Monongahela River, approximately 200' downstream of the project area and approximately 25 feet from shore, to improve shallow water habitat for fish spawning activity and foraging.

 The project site is located at 275 Center Street, McKeesport, PA 15132, McKeesport, PA USGS topographic quadrangle; N: 40°, 21`, 26"; W: -79°, 50`, 29"; Sub-basin 19A; USACE Pittsburgh District, in the City of McKeesport, Allegheny County.

 The applicant proposes to:

 1) Construct and maintain stream restoration along 1,694 linear feet (LF) an unnamed tributary (UNT) to Fish Run (CWF, A.K.A. Stream 1), and its floodway, which will be done in two distinct reaches, and consisting of multiple components as further described in the following items, which overlap:

 a. Construct and maintain habitat enhancement, grade control, and stream bank stabilization structures, consisting of 16 log vane, rock J-hooks; 6 rock vane, rock J-hooks; 2 rock cross vanes; 3 log cross vanes; 3 rock step pools; 1 log step pool; 27 rootwads; 1 habitat enhancement riffle; 30 linear feet (LF) of bank boulders; 17 LF of coir logs; 26 LF of toe wood protection; 275 LF of boulder toe protection; and 1,369 LF of stabilization matting within the aforementioned distinct reaches of Stream 1 or its associated floodway, resulting in 777 LF of permanent watercourse impacts and 0.773 acre of permanent floodway impacts;

 b. Construct and maintain stream realignments at 4 locations on the Stream 1, relocating a total of 573 LF of existing watercourse and creating approximately 539 LF of realigned watercourse;

 c. Construct and maintain stream bank grading, and floodway grading within the aforementioned two reaches of the Stream 1, its floodway, and wetlands A (Palustrine Emergent—PEM), B (Palustrine Forested—PFO), D (PEM), E (PFO/Palustrine Scrub Shrub—PSS), and G (PSS), resulting in 1,694 LF of permanent watercourse impacts, 0.773 acre of permanent floodway impacts, 0.067 acre of permanent PEM wetland impacts, 0.016 acre of permanent PSS wetland impacts, 0.0047 acre of permanent PFO wetland impacts, and 2.255 acres of temporary floodway impacts.

 2) Construct and maintain stream restoration within 463 linear feet of a UNT to Stream 1 (CWF, A.K.A Stream 2) and its floodway, which will also be done in two distinct reaches, which are separated by a pond, and consisting of habitat enhancement, grade control, and stream bank stabilization structures, consisting of 1 log step pool, 16 rootwads, 1 energy dissipater, and 3 rock cross vanes, and 112 LF of stabilization matting within the aforementioned distinct reaches of Stream 2 or its associated floodway; resulting in 257 LF of permanent watercourse impacts, 0.027 acre of permanent floodway impacts, and 70 LF of temporary watercourse impacts.

 3) Construct and maintain stream restoration along 73 linear feet of another UNT to Stream 1 (CWF, A.K.A Stream 3) and its floodway, consisting of 3 rock step pool grade control structures, at a location with an upstream drainage area less than 100 acres, resulting in in 73 LF of permanent watercourse impacts and 0.068 acre of temporary floodway impacts.

 4) Construct and maintain temporary road crossings of Stream 2's floodway, another UNT to Stream 1 (CWF, A.K.A Stream 4), and its floodway, and wetlands A, B, C (PSS), D, E, F (PSS), G, and H (PSS), resulting in 48 LF of temporary watercourse impacts, 0.440 acre of temporary floodway impacts, 0.271 acre of temporary PEM wetland impacts, 0.176 acre of temporary PSS wetland impacts, and 0.064 acre of temporary PFO wetland impacts.

 For the purpose of completing a stream stabilization and restoration project for UNT to Fish Run and its tributaries using natural stream design principles to reduce sediment loading, address erosion issues, and restore or improve habitat conditions, in order to generate Municipal Separate Storm Sewer System (MS4) sediment reduction credits needed to meet the requirements of the Borough's National Pollutant Discharge Elimination System (NPDES) Permit (permit number PAG136175).

 Cumulatively, the project will result in 2,024 LF of permanent watercourse impacts, 0.8 acre of permanent floodway impacts, and 0.087 acre of permanent wetland impacts. Additionally, the project will also result in 118 LF of temporary watercourse impacts, 3.058 acres of temporary floodway impacts, and 0.511 acre of temporary wetland impacts. On-site re-establishment of permanently impacted wetlands is proposed as compensatory mitigation for the project.

 The upstream extent of the project site is located approximately 330 feet east of Interstate-79 between Wedgewood Drive and Pioneer Drive (Emsworth, PA USGS topographic quadrangle; N: 40°, 35`, 44.64"; W: -80°, 5`, 33.94"; Sub-basin 18A; USACE Pittsburgh District) and the downstream extent of the project is approximately 600 feet Southwest of the cul-de-sac at the end of Shadowbrook Drive (Emsworth, PA USGS topographic quadrangle; N: 40°, 35`, 39.58"; W: -80°, 5`, 7.26"; Sub-basin 18A; USACE Pittsburgh District), in Franklin Park Borough, Allegheny County.
