LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 2

The Following Plans and Reports Were Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

For further information concerning plans or reports, please contact the Regional Office Program Manager previously listed in the notice.

Individuals in need of accommodations should contact DEP through the Pennsylvania Hamilton Relay Service at (800) 654-5984 (TDD users) or (800) 654-5988 (voice users).

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 3

The Department Has Taken Action on the Following Plans and Reports Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property.  The project proposes to install approximately 8.4 miles of one (1) 30-inch steel natural gas between the existing Athena Well Pad and the proposed Odyssey Interconnect. A portion of Beaver Run downstream of the site is designated a naturally reproducing trout stream by the Pennsylvania Fish and Boat Commission and, therefore, considered a wild trout stream by the Pennsylvania Department of Environmental Protection (PADEP). Wetlands located in or along the floodplain of the reach of a wild trout stream or its tributaries are considered Exceptional Value (EV) wetlands. The Beaver Run Reservoir is also located downstream of a portion of the site. Wetlands located in or along the floodplain of streams flowing to the reservoir are also considered EV wetlands by the PADEP. The project also proposes impacts to tributaries to Steels Run, Thorn Run, and Porters Run, which are designated as High Quality (HQ) Cold Water Fishes (CWF). Additionally, Beaver Run is designated as Trout Stocking (TSF). Impacts to EV Wetland and HQ streams are proposed for the project.

Temporary and/or permanent impacts to 14 wetlands and 16 streams are proposed for the project due to one or more of the following work activities: excavation, construction access, outlet drains, bank rehabilitation, geohazard mitigation, timber mats, conventional boring, and erosion and sedimentation controls. Impacts to EV Wetland and HQ streams are proposed for the project. Approximately 0.122 acre of permanent impacts and 0.092 acre of temporary impacts to EV wetlands are proposed for authorization under this Joint Permit Application. To offset the 0.016 acre of permanent, conversion impacts to EV-Palustrine Scrub Shrub (PSS) wetlands, approximately 0.064 acre of PSS wetland will be replaced via onsite mitigation. Impacts to the floodways of Thorn Run and Tributary 43018 to Beaver Run are proposed for geogrid installation. All other wetland, stream, and floodway impacts are proposed to be registered under General Permit numbers GP036507223-003, GP056507223-014, and GP086507223-021. Proposed EV wetland impacts are as follows:
