Tobacco Settlement Agreement Act; Tobacco Product Manufacturer Directory Act—Amendments

 The Office of Attorney General has obtained the consent of the participating manufacturers under the Master Settlement Agreement required by Act 9 of 2023 (P.L. 47, No. 9) and Act 11 of 2023 (P.L. 51, No. 11), amending section 3 of the act of June 22, 2000 (P.L. 394, No. 54) and amending sections 102, 301, 303, 304, 305 and 306 and adding sections 312 and 313 to the act of December 30, 2003 (P.L. 441, No. 64). These amendments and additions modify the definition of units sold to apply to all cigarettes and roll-your-own tobacco on which State excise tax is due, not just product on which the tax is paid; make importers jointly and severally liable with nonparticipating manufacturers (NPM) for escrow that is due; require NPMs to post a surety bond upon specified terms, conditions and amount, and set forth the terms and conditions for executing on the bond; further delineate circumstances under which the Commonwealth will exclude an NPM from the tobacco product directory; provide new certification requirements related to identifying importers, posting of surety bonds and an importer declaration and appointment of an agent for service of process; further delineate and extend the scope of permissible disclosure and information sharing; and provide for other definitions and modified terms.
