 State Board of Nursing # 16A-5143: Licensure by Endorsement and Reactivation (amends 49 Pa. Code Sections 21.30a and 21.156a, and adds Sections 21.1101—21.1104)

State Board of Nursing—
Licensure by Endorsement and Reactivation
Regulation No. 16A-5143 (# 3362)

 On November 28, 2022, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Board of Nursing (Board). This rulemaking amends 49 Pa. Code Sections 21.30a and 21.156a, and adds Sections 21.1101—21.1104. The proposed regulation was published in the December 10, 2022, Pennsylvania Bulletin with a public comment period ending on January 9, 2023. The final-form regulation was submitted to the Commission on August 26, 2024.

 This regulation implements Act 41 of 2019 (Act 41) (63 Pa.C.S.A. § 3111) which requires licensing boards and commissions to issue a license, certificate, registration, or permit to an applicant who pays fees established by the board or commission by regulation, provided the applicant meets certain criteria for eligibility. Act 41 also requires boards and commissions that issue provisional licenses, certificates, registrations, or permits to set the expiration of the provisional endorsement license by regulation.

 We have determined this regulation is consistent with the statutory authority of the Board (63 Pa.C.S. § 3111, 63 P.S. § 212.1(k), and 63 P.S. § 667.6) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Regulation No. 125-247 (# 3397)

 On March 20, 2024, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Pennsylvania Gaming Control Board (Board). This rulemaking amends 58 Pa. Code Chapters 603a, 633a, 687a, 812a, and 819a. The proposed regulation was published in the April 20, 2024 Pennsylvania Bulletin with a public comment period ending on May 20, 2024. The final-form regulation was submitted to the Commission on September 12, 2024.

 This regulation provides standards for the issuance and use of Direct Bet Coupons and for interactive gaming progressive wagers. The regulation also amends certain provisions in table games rules and interactive gaming player account controls.

 We have determined this regulation is consistent with the statutory authority of the Board (4 Pa.C.S. §§ 1202(b)(30); 13A02 (1)-(2); and 13B02(a)(3), (6)-(7), and (9)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Insurance Department—
Insurance Producers
Regulation No. 11-262 (# 3398)

 On April 29, 2024, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Insurance Department (Department). This rulemaking amends 31 Pa. Code by reserving Chapter 37 and replacing it with Chapter 37a. The proposed regulation was published in the May 11, 2024 Pennsylvania Bulletin with a public comment period ending on June 10, 2024. The final-form regulation was submitted to the Commission on September 23, 2024.

 This regulation rescinds and reserves 31 Pa. Code Chapter 37 and adopts in its place new Chapter 37a to formally implement the act of December 6, 2002 (P.L. 1183, No. 147) (Act 147). The purpose of this rulemaking is to provide additional clarification and modernization, where necessary, regarding the implementation of Act 147.

 We have determined this regulation is consistent with the statutory authority of the Department (71 P.S. §§ 66, 186, 411 and 412) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
