Extension of Erosion and Sediment Control General Permit (ESCGP-3) for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment Operations or Transmission Facilities

 Under 25 Pa. Code § 102.5(m) (relating to permit requirements), The Clean Streams Law (35 P.S. §§ 691.1—691.1001), 58 Pa.C.S. §§ 3201—3274 (relating to development), and sections 1905-A, 1917-A and 1920-A of The Administrative Code of 1929 (71 P.S. §§ 510-5, 510-17 and 510-20), the Department of Environmental Protection (Department) is, by this notice, extending for 2 months the availability of the current Erosion and Sediment Control General Permit (ESCGP-3) for Earth Disturbance Associated with Oil and Gas Exploration, Production, Processing or Treatment Operations or Transmission Facilities for notices of intent (NOI) that were submitted to the Department on or before October 11, 2024.

 The existing ESCGP-3 will expire on January 6, 2025. By this notice, the Department is administratively extending ESCGP-3 to March 7, 2025, for NOIs that were submitted to the Department on or before October 11, 2024. This notice does not impact persons that are currently operating under an ESCGP-3. Persons that are operating under a current ESCGP-3 may continue to operate until January 6, 2025, or the expiration date of coverage identified on the permit coverage approval page, whichever is later. Persons may not continue to seek coverage under the ESCGP-3 during this administrative extension except for NOIs submitted on or before October 11, 2024. The Department is extending the availability of this permit to adequately complete technical reviews of ESCGP-3 NOIs submitted to the Department on or prior to October 11, 2024.
