 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

The proposal is located in Palmer Township, Northampton County and consists of the extension of the existing sanitary sewer system to 24 existing homes and 10 vacant lots in the area of Norma Street in the Township. The proposed sanitary sewer extension will be connected to the existing collection and conveyance system owned by the Township at existing Manholes B33 and B30. The sewage will be conveyed through Palmer Township, Wilson Borough, and ultimately treated at the existing Easton Area Joint Sewer Authority wastewater treatment plant (NPDES Permit No. PA0027235). Plan Description:

Garfield Avenue Extension Act 537 Minor Update Revision. The Plan's selected alternative involves a sanitary sewer extension to address malfunctioning and/or existing unpermitted on-lot systems in North Manheim Township along Garfield Avenue, West 2nd Mountain Road, North Manheim Road, and associated connecting streets. Out of the 55 on-lot systems in question, 21 were surveyed. The survey resulted in 3 confirmed malfunctions and 11 suspected malfunctions. The alternative option of maintaining the on-lot systems was dismissed due 74% of the systems facing potential malfunction, and 9% experiencing confirmed malfunction. The selected alternative involves the construction of approximately 4,820 linear feet of 8-inch PVC sanitary sewer, 1,125 linear feet of 6-inch SDR-26 PVC sanitary sewer lateral, and 30 EA of 4-foot diameter precast concrete manholes, wyes, laterals, cleanouts, utility coordinate, traffic control, and associated site restoration. It was determined that the expansion of the sanitary sewer service area in North Manheim Township was the most cost-effective, as the estimated cost of the project was $2,345,265.00. The Plan is approved.

The planning module for the Beaumont Springs, DEP Code No. A3-67931-302-3, APS ID 1124427, consisting of a proposed 45-lot multi-family and single-family residential subdivision on 16.04 acres is disapproved. Total estimated sewage flows are 13,000 gpd, and they were planned to be tributary to the Jackson Township collection and conveyance system and wastewater treatment plant. The proposed development is located between Stoverstown Road and Cedarlyn Drive at Lester Avenue in Jackson Township, York County. This plan is disapproved because the planning submission fails to address Chapter 71, Section 71.21(a)(5)(i)(B) and Section 71.52(a)(6)(ii). The sewage planning module for the proposed development indicates the additional wasteload will cause an overload in the Township's collection and conveyance system, but it does not indicate how consistency with Chapter 94 will be achieved. Furthermore, the module does not document the institutional arrangements, such as agreements between the developer and Township, that are necessary for the implementation of this plan revision.

Joseph T. Kiely, A3-67929-241-3s. The planning module for the proposed Joseph T. Kiely Small Flow Treatment Facility (SFTF) proposal, DEP Code No. A3-67929-241-3s, APS ID 1123447, consisting of a one lot single-family residential development on 1.214 acres is disapproved. Total proposed sewage flows are 400 gpd, and they will be tributary to a SFTF and with a discharge to an unnamed tributary of Kreutz Creek. The proposed development is located at the end of Woodshead Terrace, on the south side. This plan is disapproved because 1) The Pennsylvania Natural Diversity Index (PNDI) search included with the planning submission predates March 31, 2023 and does not ensure screening sensitive to the listing change for the Northern Long-Eared Bat. The United States Fish & Wildlife Service (USFWS) issued a final rule on March 31, 2023 to reclassify the Federal listing of the Northern Long-Eared Bat as an Endangered Species under the Endangered Species Act. The Northern Long-Eared Bat, listed as Threatened in 2015, now faces extinction due to the range-wide impacts of the white-nose syndrome, a deadly disease affecting hibernating bats across North America. Habitat screening for the Northern Long-Eared Bat is now required in all counties of the Commonwealth of Pennsylvania and must be completed by the applicant using the PNDI environmental review within the Pennsylvania Conservation Explorer. To ensure your project considers potential impacts to this Federally listed species, the U.S. Army Corps of Engineers is requiring projects reviewed prior to March 31, 2023 to be re-screened. 2) The planning submission lacks documentation of site conditions, particularly slope, that cause the lot in question to not be suitable for on-lot sewage disposal. 3) The planning submissions does not have a copy of the public notice, which is required in Section O of the Component 3s and by Chapter 71, Section 71.53(d)(6) for new land development submissions. 4) The planning submission fails to address operation and maintenance of the proposed Small Flow Treatment Facility as required by Section Q.1 of the Component 3s and by Chapter 71, Section 71.64.(c)(5). 5) For any future submission of this project, the planning review fee, as required by Section R of the Component 3s and by Chapter 71, Section 71.83(a)(4), will be: 1 proposed EDU × $35/EDU = $35.

The planning module for the Edith Rice Small Flow Treatment Facility (SFTF), DEP Code No. A3-01929-374-3s, APS ID 1118606, consisting of SFTF proposal to replace a malfunctioning on-lot disposal system serving an existing dwelling on 0.9108 acre is disapproved. Total estimated sewage flows are 500 gpd, and there is a proposed dry stream discharge to an unnamed tributary of Upper Rock Creek. The proposed development is located at 1480 Old Harrisburg Road in Straban Township, Adams County. This plan is disapproved because information requested in the Department's August 16, 2024 Technical Deficiency Letter was not addressed, particularly: 1) The mapping should show if there are any wells within 200 feet of the proposed discharge path to Rock Creek. If there are wells within that distance, a hydrogeologic study should be completed to determine if the future discharge will adversely affect the wells, and 2) Specifically, the applicant failed to supply a preliminary hydrogeologic study that provides documentation, data, calculations, and analysis to show the discharge will not negatively impact the three wells identified to be within 200 feet of the proposed discharge path as per Chapter 71, Section 71.64(c)(3). This analysis should include an estimation of zones of contribution around each well, and the nitrate-nitrogen impacts to these wells. Background nitrate-nitrogen from the wells and discharge channel surface water should be used in the evaluation.

The proposed development is located at 305 Basehoar School Road in Union Township, Adams County. This plan is disapproved because the site investigation testing performed on Lot 6 does not meet general site suitability criteria as outlined in Chapter 71, Section 71.62(a). Particularly, many of the limiting zones are not a minimum of 20 inches, as required by Chapter 73, Section 73.14(a)(5) for siting absorption areas other than Individual Residential Spray Irrigation Systems (IRSIS). Additional site investigation should be conducted in order to locate absorption areas that are consistent with Chapter 73.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Following Plans and Reports Were Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

The Department Has Taken Action on the Following Plans and Reports Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.
