THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

APPLICATIONS FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS UNDER THE CLEAN STREAMS LAW AND FEDERAL CLEAN
WATER ACT

 This notice provides information about persons who have applied to the Department of Environmental Protection (DEP) for a new, renewed, or amended NPDES or WQM permit, or a permit waiver for certain stormwater discharges, or have submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications and NOIs concern, but are not limited to, effluent discharges from sewage treatment facilities and industrial facilities to surface waters or groundwater; stormwater discharges associated with industrial activity (industrial stormwater), construction activity (construction stormwater), and municipal separate storm sewer systems (MS4s); the application of pesticides; the operation of Concentrated Animal Feeding Operations (CAFOs); and the construction of sewage, industrial waste, and manure storage, collection and treatment facilities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).  Section I identifies the following applications and NOIs that have been received by DEP:

 • Individual and General WQM Permit Applications Received—DEP provides a 15-day public comment period for Individual WQM Permit Applications for new and reissued permits. There is no public comment period for General WQM Permit NOIs.

 • General Chapter 92a NPDES Permit NOIs Received—There is no public comment period for General NPDES NOIs received.

 • All Transfer and Minor Amendment Applications/NOIs Received—Transfer and Minor Amendment Applications/NOIs received for Individual and General WQM Permits and Individual and General NPDES Permits, excluding PAG-01 and PAG-02, are identified but do not have public comment periods. DEP provides a 15-day public comment period for Individual WQM Permit Applications for amendments.

 Additional information on these applications and NOIs may be reviewed by generating the ''Applications and NOIs without Comment Periods Report'' or, for Individual WQM Permit Applications, the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

 Section II identifies individual NPDES permit applications received and draft permits indicating DEP's tentative determination relating to sewage, industrial waste, industrial stormwater, MS4s, pesticides and CAFOs. A 30-day public comment period applies to these applications and draft permits, except when a site-specific water quality criterion is used to establish effluent limitations, in which case a 45-day public comment period applies. The period for comment may be extended at the discretion of DEP for one additional 15-day period. Additional information, including links to draft permits and fact sheets that explain the basis for DEP's tentative determinations may be reviewed by generating the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice. Notification of 15-day extensions for comment will be provided in the ''Applications Received with Comment Periods Report'' (Comments column).

 Section III identifies individual NPDES permit applications received and draft permits indicating DEP's tentative determination relating to stormwater discharges associated with construction activities. A 30-day public comment period applies to these applications and draft permits. The period for comment may be extended at the discretion of the Department for one additional 15-day period. Additional information may be reviewed by generating the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

 Applications, NOIs and draft permits, where applicable, may be reviewed at the DEP office that received the application or NOI. Members of the public are encouraged to use DEP's website to obtain additional information as discussed previously.

 Comments received within the appropriate comment periods for WQM and NPDES permit applications will be retained by DEP and considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform DEP of the exact basis of a comment and the relevant facts upon which it is based.

 DEP will also accept requests or petitions for public hearings on applications. The request or petition must indicate the interest of the party filing and the reasons why a hearing is warranted. A hearing will be held if DEP determines that there is a significant public interest. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. DEP will postpone its final determination until after a public hearing is held.

 Matthew Horning has submitted an application for an Individual NPDES permit for a new CAFO known as Blue Lake Farm, located in West Buffalo Township, Union County.

 The CAFO is situated near Unnamed Tributary to Rapid Run (HQ-CWF, MF) in Watershed 10-C, which is classified for High Quality-Cold Water and Migratory Fish. The CAFO is designed to maintain an animal population of approximately 240.00 animal equivalent units (AEUs) consisting of 84,000 Layers, 25 Medium Breed Ewe, 30 Meat Goat Doe, 3 Pony Mature, 1 Medium Breed Ram, 2 Light Horse Mature, 45 Medium Breed Lamb, and 4 Beef Backgrounding Cattle. Solid manure is stored on the operation in three poultry house underbarn storages and a separate manure stacking shed. A release or discharge to waters of the Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 100-year, 24-hour storm event.

 The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.

A new pretreatment chemical feed building, chemical feed systems, instrumentation, supervisory control, and data access (SCADA) system and an emergency generator. The new treatment facility will meet the future water system demands and ensure compliance with future regulations. Once the membrane filtration system is operational and approval is granted by the Department, the current conventional filtration system will be removed from service and the existing filtration building will be demolished.

 Project Description: The Pennsylvania State University is proposing the demolition and reconstruction of the existing West Sideline of Beaver Stadium located in College Township, Centre County, PA. The renovation is to focus primarily on the West Side of the stadium, replacing that portion in its entirety and providing improved access for greatly improved circulation, new restrooms, upgraded concession offerings, and an updated broadcast level. Also included in this project are much needed improvements, including field lighting improvements to meet NCAA standards, East side vertical circulation improvements to improve and address accessibility needs/requirements, North and East side restroom and concession additions to supplement existing conditions. Outside the stadium, a new fence will be constructed to create a secure perimeter that is further from the entrances, which will positively impact fan entry. New plaza areas will be constructed inside this fence perimeter.

 Special Conditions: PCSM Stormwater Demonstration—Offsite Stormwater Management Offsetting Credit. The Post-Construction Stormwater Management (PCSM) demonstration for this project is made in part by utilizing excess capacity within existing and proposed offsite PCSM Stormwater Control Measures (SCMs) to address the stormwater requirements associated with the project authorized by this permit. Offsite PCSM SCMs include the following: 1) the ''PSU Barr Pit'' infiltration basin authorized by the general NPDES permit PAC140147, 2) the ''Bathgate Dam'' or ''Bathgate Detention Pond,'' a rate control wet pond and DEP regulated dam (D14-122), and 3) the ''Bathgate Infiltration Basin'' authorized by the individual NPDES permit PAD140002. Failure to construct, modify, operate, or maintain the offsite PCSM SCMs as required by Department of Environmental Protection (DEP) permits to satisfy all DEP administered regulatory requirements will result in DEP compliance and enforcement action. If this permit contains conditions or requirements which conflict with conditions or requirements within the authorizing permit for the previously listed enumerated Offsite PCSM SCMs, the more stringent and environmentally protective requirements apply; upon discovery of a conflicting condition or requirement, DEP shall be promptly notified and the subsequent corrective action plan implemented within the timeframe established by DEP.
