[Saturday, December 7, 2024]Formal complaints have been issued by the Pennsylvania Public Utility Commission. Answers must be filed in accordance with 52 Pa. Code (relating to public utilities). Answers are due December 23, 2024, and must be made with the Secretary, Pennsylvania Public Utility Commission, 400 North Street, Harrisburg, PA 17120, with a copy to the First Deputy Chief Prosecutor, Pennsylvania Public Utility Commission.

Pennsylvania Public Utility Commission; Bureau of Investigation and Enforcement v. United Cab, LLC; Docket No. C-2024-3051154
COMPLAINT The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:
1. That United Cab, LLC, Respondent, maintains its principal place of business at 2304 Walnut Street, Harrisburg, PA 17103.
2. That Respondent was issued a certificate of public convenience to transport, as a common carrier, by motor vehicle, persons in call or demand service on July 20, 2012, at PUC number A-6312947.
3. That on September 12, 2024, PUC Enforcement Supervisor Timothy Troxell, Officers' Travis Griffith, Matthew Ohlinger and David Drago, conducted a patrol operation in the city of Harrisburg.
4. That PUC Enforcement Officer Travis Griffith conducted a Driver/Vehicle Compliance report (DVCR) on that date at 3695 Paxton Street, Harrisburg, Dauphin County, PA. The vehicle was a 2013 Dodge Caravan, registration number TX51421 the last 4 digits of the vehicle identification number being 2519, being driven by Jose Vega. Multiple violations were noted as follows:
a. The vehicle was marked incorrectly.
b. Vehicle moves on a level surface when parking brake is fully applied.
c. Dent greater that 4 inches on lower left rear door.
d. Inspection decal dated 6/24.
5. That following these inspections, Respondent was advised to submit criminal history and driver history reports. Officer Griffith did not receive those reports.
6. That Respondent allowed a vehicle to operate with a vehicle marked as PUC-A-6412947, rather than PA.P.U.C. No. A-6412947 on both sides of the vehicle, has violated 52 PA 29 § 71(a). The penalty for this violation is $50.
7. That Respondent allowed a vehicle to operate with a vehicle that moves on a level surface when parking brake is fully applied, has violated 52 PA § 29.402(1), 67 § 175.64(c)(1). The penalty for this violation is $50.
8. That Respondent allowed a vehicle to operate a vehicle with a dent greater than 4 inches, has violated 52 PA § 29.403(6). The penalty for this violation is $100.
9. That Respondent allowed a vehicle to operate with an expired inspection sticker has violated 52 PA 29.405. The penalty for this violation is $100.
10. That Respondent failed to provide criminal history and driver records has violated 52 PA § 29 504. The penalty for this violation is $100.
11. That Respondent failed to provide driver records has violated 52 PA § 505. The penalty for this violation is $100.
Wherefore, the Bureau of Investigation and Enforcement hereby requests that the Commission fine United Cab, LLC, the amount five hundred dollars ($500.00) for the illegal activity described in this Complaint and order such other remedy as the Commission may deem to be appropriate.

C. You may elect not to contest this complaint by paying the fine proposed in this Complaint by certified check or money order. Payment must be made to the Commonwealth of Pennsylvania and should be forwarded to:

COMPLAINT The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:
1. That EZ Taxi, LLC, Respondent, maintains its principal place of business at 2304 Walnut Street, Harrisburg, PA 17103.
2. That Respondent was issued a certificate of public convenience to transport, as a common carrier, by motor vehicle, persons in call or demand service on July 7, 2004, at PUC number A-706158.
3. That on September 12, 2024, PUC Enforcement Supervisor Timothy Troxell, Officers' Travis Griffith, Matthew Ohlinger and David Drago, conducted a patrol operation in the city of Harrisburg.
4. That PUC Enforcement Supervisor Timothy Troxell conducted a Driver/Vehicle Compliance report (DVCR) on that date at 21st and Berryhill Street, Harrisburg, Dauphin County, PA. The vehicle was a 2013 Chevrolet Malibu, registration number TX51576 the last 4 digits of the vehicle identification number being 5571, being driven by Johnnie Turner. A violation was noted: The vehicle age was greater than 11 years and not an alternative fuel vehicle:
5. That following these inspections, Respondent was advised to submit criminal history and driver history reports. Supervisor Troxell did not receive those reports.
6. That Respondent allowed a vehicle to operate with a vehicle aged over 10 years has violated 52 PA § 29.314(c). The penalty for this violation is $500.
7. That Respondent failed to provide criminal history records has violated 52 PA § 29 504. The penalty for this violation is $100.
8. That Respondent failed to provide driver records has violated 52 PA § 505. The penalty for this violation is $100.
Wherefore, the Bureau of Investigation and Enforcement hereby requests that the Commission fine EZ Taxi, LLC, the amount of seven hundred dollars (700.00) for the illegal activity described in this Complaint and order such other remedy as the Commission may deem to be appropriate.

COMPLAINT The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Investigation and Enforcement and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Investigation and Enforcement hereby represents as follows:
1. That Country Star Equine Transport, LLC, Respondent, maintains a mailing address at 257 Hill Road, New Holland, PA 17557.
2. That on February 26, 2024, by Commission Secretarial letter, Respondent was issued a certificate of public convenience by this Commission authorizing transportation, as a common carrier, by motor vehicle, property, excluding household goods in use, between points in Pennsylvania at PUC utility code no. 8926887 at A-2024-3046517.
3. That PA PUC Enforcement Officer David Drago attempted to reach the Respondent by phone, email and text. On August 13, 2024, a certified letter was mailed. No contact has been received.
4. That Respondent, by failing to respond to and achieve a satisfactory evaluation on a safety fitness review, violated 66 Pa § 501(c) & § 504. The penalty for this violation is cancellation of the certificate held by Respondent with this Commission at utility code 8926887:
Wherefore, the Bureau of Investigation and Enforcement hereby requests that the Commission revoke the certificate of public convenience issued to Country Star Equine Transport, LLC, at PUC utility code number 8926887.
