APPLICATIONS
THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS UNDER THE CLEAN STREAMS LAW AND FEDERAL CLEAN
WATER ACTThis notice provides information about persons who have applied to the Department of Environmental Protection (DEP) for a new, renewed, or amended NPDES or WQM permit, or a permit waiver for certain stormwater discharges, or have submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications and NOIs concern, but are not limited to, effluent discharges from sewage treatment facilities and industrial facilities to surface waters or groundwater; stormwater discharges associated with industrial activity (industrial stormwater), construction activity (construction stormwater), and municipal separate storm sewer systems (MS4s); the application of pesticides; the operation of Concentrated Animal Feeding Operations (CAFOs); and the construction of sewage, industrial waste, and manure storage, collection and treatment facilities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376). More information on the types of NPDES and WQM permits that are available can be found on DEP's website (visit www.dep.pa.gov and select Businesses, Water, Bureau of Clean Water, Wastewater Management, and NPDES and WQM Permitting Programs).
Section Category I Individual and General WQM Permit Applications/NOIs Received, General NPDES Permit NOIs Received, and All Transfer and Minor Amendment Applications/NOIs Received II Individual NPDES Permits—New, Renewal, and Major Amendment Applications and Draft Permits for Discharges Relating to Sewage, Industrial Waste, Industrial Stormwater, MS4s, Pesticides and CAFOs III Individual NPDES Permit Applications for Discharges of Stormwater Associated with Construction Activity Section I identifies the following applications and NOIs that have been received by DEP:
• Individual and General WQM Permit Applications Received—DEP provides a 15-day public comment period for Individual WQM Permit Applications for new and reissued permits. There is no public comment period for General WQM Permit NOIs.
• General Chapter 92a NPDES Permit NOIs Received—There is no public comment period for General NPDES NOIs received.
• All Transfer and Minor Amendment Applications/NOIs Received—Transfer and Minor Amendment Applications/NOIs received for Individual and General WQM Permits and Individual and General NPDES Permits, excluding PAG-01 and PAG-02, are identified but do not have public comment periods. DEP provides a 15-day public comment period for Individual WQM Permit Applications for amendments.

Section II identifies individual NPDES permit applications received and draft permits indicating DEP's tentative determination relating to sewage, industrial waste, industrial stormwater, MS4s, pesticides and CAFOs. A 30-day public comment period applies to these applications and draft permits, except when a site-specific water quality criterion is used to establish effluent limitations, in which case a 45-day public comment period applies. The period for comment may be extended at the discretion of DEP for one additional 15-day period. Additional information, including links to draft permits and fact sheets that explain the basis for DEP's tentative determinations may be reviewed by generating the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice. Notification of 15-day extensions for comment will be provided in the ''Applications Received with Comment Periods Report'' (Comments column).
Section III identifies individual NPDES permit applications received and draft permits indicating DEP's tentative determination relating to stormwater discharges associated with construction activities. A 30-day public comment period applies to these applications and draft permits. The period for comment may be extended at the discretion of the Department for one additional 15-day period. Additional information may be reviewed by generating the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.
Applications, NOIs and draft permits, where applicable, may be reviewed at the DEP office that received the application or NOI. Members of the public are encouraged to use DEP's website to obtain additional information as discussed previously.
Comments received within the appropriate comment periods for WQM and NPDES permit applications will be retained by DEP and considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform DEP of the exact basis of a comment and the relevant facts upon which it is based.

DEP will also accept requests or petitions for public hearings on applications. The request or petition must indicate the interest of the party filing and the reasons why a hearing is warranted. A hearing will be held if DEP determines that there is a significant public interest. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. DEP will postpone its final determination until after a public hearing is held.

Project Description: The Stormwater Authority of the City of Chester (SAC) proposes to construct an approximately 4.5-acre stormwater wetland on an existing ballfield/park known as Veterans Memorial Park. This regional stormwater system will provide water quality treatment and flood control through extended detention for a drainage area of approximately 195.9 acres. The basin will be fed by stormwater flow in a shallow existing 66-inch by 84-inch corrugated metal pipe (CMP) culvert that will be diverted into the proposed basin and will sustain a 6-foot deep permanent pool of water. The maximum expected excavation depth is 21 feet. The volume stored in the basin will be drained by a proposed 18-inch RCP pipe connecting to a vault structure located in a railroad right-of-way. Total runoff volume and peak flow leaving the proposed stormwater wetland will decrease as compared to existing conditions. Various site furnishings such as a pedestrian bridge/fishing deck, gathering area, retaining wall and trails will provide additional project benefits such as habitat creation, passive recreation and educational benefits for city residents and park visitors. There are no FEMA floodways or floodplains in the project area. The national wetland inventory database shows no wetlands within the project area. However, in April 2020, and AKRF senior wetlands scientist delineated two small wetlands within the project area. The project also includes stormwater infrastructure improvements in the public right of way on the west side of the park (along Wilson Street and Ward Street). Please note that two separate but related sets of engineering drawings accompany this application, depending on the location of the proposed work. Work in Veterans Memorial Park, i.e. the proposed stormwater wetland, is depicted on drawings titled, ''Contract Drawings for Stormwater Authority of the City of Chester, Comprehensive Infrastructure Project Phase 3, Veterans Memorial Park Stormwater Wetland.'' Work in public street rights-of-way, i.e. storm sewer infrastructure improvements, is depicted on drawings titled, ''Contract Drawings for Stormwater Authority of the City of Chester, Comprehensive Infrastructure Project Phase 3, Right-of-Way Storm Sewer Improvements.''
