Proposed NPDES Permit Renewal Actions for Minor Sewage Discharges
The following parties have applied to renew their current NPDES permits to allow the continued discharge of controlled wastewater into the surface waters of this Commonwealth. The Department of Environmental Protection (DEP) has made a tentative determination to renew these permits and proposes to issue them, subject to their current permit effluent limitations, and monitoring and reporting requirements, with appropriate and necessary updated requirements to reflect new or changed regulations and other requirements. The updates may include, but will not be limited to, applicable permit conditions and/or requirements addressing combined sewer overflows (CSOs), municipal sewage sludge management, and total residual chlorine control (TRC). Any major changes to or deviations from the terms of the existing permit will be documented and published with the final Department actions.
The EPA, Region III, Regional Administrator has waived the right to review or object to these proposed permit actions under the waiver provision 40 CFR 123.6E.
Persons wishing to comment on the proposed permits are invited to submit a statement to the Field Operations indicated as the office responsible, within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in the formulation of the final determinations regarding these applications and proposed permit actions. Acknowledgment of Notices of Intent to Remediate
Sections 302 and 303 of the Land Recycling and Environmental Remediation Standards Act (the act) require the Department of Environmental Protection to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent to Remediate. An acknowledgment of the receipt of a Notice of Intent to Remediate identifies a site where a person proposes to, or has been required to, respond to a release of a regulated substance at a site. Persons intending to use the background or Statewide health standard to remediate a site must file a Notice of Intent to Remediate with the Department. A Notice of Intent to Remediate filed with the Department must provide a brief description of the location of the site, a list of known contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. A person who demonstrates attainment of one or a combination of the cleanup standards identified under the act will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by the Department and shall not be subject to citizen suits or other contribution actions brought to responsible persons not participating in the remediation.

Opening of the Administrative Record; Prompt Interim Response Under the Hazardous Sites Cleanup Act

Hellam Township, York CountyThe Department of Environmental Protection (Department or DEP), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305) is initiating a prompt interim response at the P & H Automotive site.
The P & H Automotive site is located along Route 463 in Hellam Township, York County, PA. The site is an abandoned auto body shop bordered by commercial property on the south, agricultural land use on the west and north and residential property on the east. There are approximately 25 drums of unknown material and an undetermined quantity of contaminated soil.
DEP considered several alternative interim responses including: 1) no action, under which all hazardous wastes and substances would remain in place; 2) limited action which would prevent access to the drums and contaminated soils; and 3) waste removal which involves taking action to remove drums and contaminated soils, as well as arranging for the treatment and/or disposal and cleaning of the concrete floor in the drum storage area.
The Department determined that the no action alternative (1) and limited action alternative (2) would not be protective of human health and the environment.
Therefore, DEP proposes to characterize and remove the hazardous wastes and substances from the site. This action (3) would remove the direct contact threat of exposure. This would also prevent the spread of contamination.
The Administrative Record which contains information about the site and which supports DEP's decision to perform a prompt interim response action at the site is available for public review and comment. The Administrative Record is located at Kreutz Creek Library, located at 66 Walnut Springs Road, York, PA and is available for review during normal hours of operation. The Administrative Record may also be reviewed at the Department's Southcentral Regional Office at One Ararat Boulevard, Harrisburg, PA from 8 a.m to 4 p.m. Monday through Friday, by contacting Barbara Faletti at (717) 657-4592. Extended Submission Date for County Recycling Coordinator Grant Applications under the Municipal Waste Planning, Recycling and Waste Reduction Act
The Department of Environmental Protection announces an extension of the deadline date for 1995 County Recycling Coordinator Grant applications under section 903 of the Municipal Waste Planning, Recycling and Waste Reduction Act (Act 101) (53 P. S. § 4009.903). The deadline date has been extended to 3 p.m., June 30, 1996. Applications received after that date will not be considered. Applications must be on forms provided by the Department. All grant awards will be predicated on the receipt of recycling fees required by section 701 of Act 101 and the availability of monies in the Recycling Fund.
Grant funds may not exceed 50% of the approved cost of the county recycling coordinator's salary and expenses incurred on or after January 1, 1995, to December 31, 1995. The following duties of county recycling coordinators will be considered approvable for reimbursement:
1. Proving technical assistance to municipalities on developing and implementing waste reduction and recycling programs.
2. Developing recycling and waste reduction public education programs.
3. Assisting municipalities in identifying recyclable materials to be marketed and locating markets.
4. Assisting municipalities in preparing recycling grant applications.
5. Assisting municipalities with developing and coordinating leaf collection and composting programs and identifying markets for compost.
6. Serving as contact for recycling questions within the county.
7. Identifying and encouraging opportunities for inter-municipal cooperation and cooperative efforts with other organizations to further waste reduction and recycling.
8. Collecting data on municipal recycling programs within the county and on commercial, institutional and municipal establishment recycling, and recycling at community activities, and reporting the data to the Department.
9. Speaking to school, community, business and government organizations about recycling and waste reduction.
10. Identifying sources of recyclable products and products made of recycled materials and encouraging the use of those items.
11. Developing recycling programs for special materials such as used oil, tires, household hazardous waste and white goods.
12. Developing education materials on household hazardous waste.
13. Develping waste reduction and reuse programs.
14. Assisting the county in developing and implementing the recycling components of the solid waste plan.
15. Participating in and coordinating where appropriate recycling training programs, workshops and conferences including household hazardous waste.
16. Maintaining communications with other recycling coordinators and municipal waste management professionals.

Code § 127.44, the Department of Environmental Protection intends to issue a plan approval to Blue Mountain Power, LP, 2500 City West Boulevard, Suite 150, Houston, Texas 77042, to construct an electrical generation plant and associated air pollution control devices as described in the Applicant's application of March 27, 1995, at their Blue Mountain Power Plant located at East Pumping Station Road, Richland Township, Bucks County.
Based on the information provided by the applicant and DEP's own analysis, this plant will not emit in excess of:
Nitrogen Oxides (NOx): 94.8 tons per year; Volatile Organic Compounds (VOCs): 31.5 tons per year; Carbon Monoxide (CO): 97.3 tons per year; Sulfur Oxides (SOx expressed
as SO2):64.2 tons per year; Particulate Matters (PM): 72.9 tons per year; Ammonia emissions (NH3). 71.3 tons per year. The plant is regulated under the Department's New Source Review Rules and Regulations, 25 Pa. Code Chapter 127, Subchapter E. It requires that the plant employ the current lowest achievable emission rate (LAER) for VOC and NOx emission control. If approval to construct the plant is granted, the Department will prohibit its operation until sufficient emission offset credits for VOC and NOx emissions are provided in accordance with the applicable requirements of Subchapter E. Copies of the application, DEP's analyses and other documents used in evaluation of the application are available for public inspection during normal business hours at the address shown below. In order to assure compliance with the applicable standards and to limit the Potential to Emit of air contaminants from the plant, DEP will place the following conditions on the Plan Approval:

4. one 9.7 million Btu per hour auxiliary boiler
5. one 2.33 million Btu per hour natural gas heater
6. two 2.4 MW (each) emergency diesel generators
7. one 280HP diesel fire pump
New Source Review Requirement
Prohibition on start up of the plant until emission offset credits of 41 tons per year of VOC and 122 tons per year of NOx are obtained.
Emission Limitations
1. From heat recovery steam generator stack at 100% base load
4.0 ppm NOx at 15% O2 while firing natural gas
8.4 ppm NOx at 15% O2 while firing No. 2 fuel oil
4.4 ppm VOC at 15% O2 while firing No. 2 fuel oil
16.0 ppm CO at 15% O2 while firing No. 2 fuel oil
10 ppm NH3 at 15% O2
2. Emission limits apply at all times except during startup and shut down and fuel transfer.
Operating Requirements to limit the Potential to Emit:
1. limited operating hours of the combustion turbine for firing No. 2 fuel oil to 1,080 hours per year
2. limited operating hours for using the duct burner to 2,928 hours per year burning natural gas only
3. special operating requirements for each air cleaning device.
Certified Emission Monitoring Requirements:
Certified emission monitoring is required for NOx, CO, NH3 emissions and the O2 content in the heat recovery system generator exhaust gases
Test Requirements:
To determine the emission rate for each pollutant listed in Emission Limitations
Recordkeeping Requirements:
Recordkeeping is required for operating hours and fuel usage.
Any person wishing to provide DEP with additional information they believe should be considered prior to the issuance of the Plan Approval may submit the information to the address shown below. Each written comment shall include the following:
1. Name, address and telephone number of the person submitting the comments.
2. Identification of the proposed Plan Approval (specify Plan Approval No. 09-328-009).
3. Concise statement regarding the relevancy of the information or any objections to issuance of the Plan Approval.

MINING ACTIVITY APPLICATIONS Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).
The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.
Written comments or objections, or request for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).
Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. Such NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52, and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chs. 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections, application number, and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor, application number, a brief summary of the issues to be raised by the requestor at the conference and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.
