[27 Pa.B. 4888] C-00970318. Pennsylvania Public Utility Commission, Bureau of Transportation and Safety v. CSX Transportation, Inc. A complaint has been made to the Pennsylvania Public Utility Commission, under the provisions of Public Utility Code, requesting that several of the railroad lines operated by CSX Transportation, Inc. in Somerset Township, Somerset County cross State Route 3025 and above referenced crossings are designated as AAR No. 145 159 W and AAR No. 145 160 R. Prior to July 26, 1996 the respondent removed railroad tracks on either side of the crossing designated as AAR No. 145 159 W, leaving railroad tracks only in the roadway and shoulder area. The tracks, ties and other material have been paved over. Since the removal of these tracks, CSX's Trains can no longer operate across this crossing. The present condition of the crossing constitutes a potential safety hazard in that the rails, ties and other track material under the roadway and shoulder paving will cause the roadway paving to crack and deteriorate. Prior to July 26, 1996, the respondent removed two of four sets of tracks at the crossing designated AAR No. 145 160 R expect in through the roadway and shoulder area so its trains no longer operate through the crossing on these two tracks.
The flashing light warning signals at the crossing have not been relocated since the removal of two of the four sets of tracks at the crossing area and need to be relocated since motorists now cross two sets of inactive tracks before they encounter a train movement which causes a safety hazard in that the placement of the flashing light signal does not conform with the criteria set forth in the Manual on Uniform Traffic Control Devices and the crossing surance is uneven. Since July 26, 1996 the respondent has refused to file an application with the Commission to abolish crossing AAR No. 145 159 W & alter crossing AAR No. 145 160 R despite requests from Transportation and Safety.
An initial hearing on this matter will be held Thursday, October 2, 1997, at 10 a.m. in the 11th Floor Hearing Room, Pittsburgh State Office Building, 300 Liberty Avenue, Pittsburgh, PA, when and where all persons in interests may appear and be heard, if they so desire.
