Order

   On September 24, 1997, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Corrections (Department). This rulemaking amends 37 Pa. Code Chapter 93. The authority for this regulation is the Prison Medical Services Act of 1996 (61 P. S. § 1014) and Act 53 of 1996 (71 P. S. § 310-3). The proposed regulation was published in the October 4, 1997 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on January 29, 1998.

   The regulation establishes a program requiring inmates in State correctional institutions and facilities to pay a fee to cover a portion of the actual costs of the medical services provided. Additionally, Act 53 of 1996 requires the Department to implement a system whereby inmates who are covered by medical insurance are to pay for their own medical needs through their insurance, consistent with the terms of the policy.

   We have reviewed this regulation and find it to be in the public interest. The Department estimates that implementation of the program will save the Commonwealth approximately $180,000 to $202,000 per year in the provision of medical services. In addition, the Department estimates that $380,000 per year will be generated from the copayments. This regulation is consistent with the Prison Medical Services Act of 1996 and Act 53 of 1996.

Therefore, It Is Ordered That:

   1.  Regulation No. 19-1 from the Department of Corrections, as submitted to the Commission on January 29, 1998, is approved; and

   2.  The Commission will transmit a copy of this Order to the Legislative Reference Bureau.
