Solicitation of Public Comment on the Draft Pennsylvania Statement Implementing the Provisions of Section 271 of the Telecommunications Act of 1996 in Pennsylvania; Doc. No. I-00980075

   On December 18, 1997, the Commission entered an Opinion and Order in Docket M-00946840 (December 97 Order). The December 97 Order established the minimum requirements for submission of a Section 271 petition for review by the Commission. The December 1997 Order also closed the docket on that Section 271 proceeding.

   On April 6, 1998, New York's Public Service Commission (NYPSC) held a press conference and issued correspondence stating the conditions under which the NYPSC could support a Section 271 application in New York. The New York Statement pertained to Bell Atlantic--New York (BA-NY) and relied on commitments BA-NY made in a Pre-Filed Statement (New York Statement).

   On April 23, 1998, the Pennsylvania Public Utility Commission unanimously adopted a motion of Commissioner Rolka (the April 23 Order). The April 23 Order opened an investigation to determine whether the New York Statement could be useful in guiding Section 271 determinations in Pennsylvania.

   The April Order contained a Draft Pennsylvania Statement aimed at soliciting public comment on whether a Pennsylvania-version of the New York Statement would be useful to Pennsylvania. This notice solicits that public input.

   The Commission expects any Comment and Reply Comment to address any substantive, technical and policy questions. The standards, measurements, reports and prices adopted in the New York Statement might be inappropriate for Pennsylvania in light of our differing cost structure, procedures, service territories and the premerger environment. The Commission further invites BA-PA and any other party to propose additions, deletions, corrections and modifications to the Draft Pennsylvania Statement. The Pennsylvania Commission seeks creative proposals that prevent unsatisfactory performance and promote a sustainable competitive environment. The Pennsylvania Commission solicits comment on what, if any, conditions might warrant a ban on the connection of additional long-distance customers.

   The deadline for filing Comments is the close of business on May 28, 1998. The deadline for filing Reply Comments is the close of business on June 28, 1998.

   Persons or entities submitting any Comment or Reply Comment must file an original and 13 copies of any comment or reply comment with the Office of the Secretary in PUC Doc. No. I-00980075. Any party submitting a Comment or Reply Comment must also provide two copies to each Commissioner's office and two copies to the Law Bureau. Any party submitting a Comment or Reply Comment should file an electronic read-only version in Word 6 format clearly identifying the party, the docket number, the nature of the filing and the contact person.
