Liquid Fuels Tax Funds; Intent to Promulgate Regulation and Request for Public Participation

   The Department of Transportation, Bureau of Municipal Services, pursuant to the authority contained in Act of June 1, 1956 (P. L. (1955) 1944, No. 655) (72 P. S. §§ 2615.1--2615.4), and consistent with the goals of Executive Order 1996-1, February 6, 1996, Regulatory Review and Promulgation, announces its intention to amend Title 67 of Department Regulations by amending Chapter 449, Liquid Fuels Tax Funds.

   The purpose of this rulemaking is to update and revise the regulations for changes made by statute and policy since the last revision in 1987. The recent creation of the Department of Community and Economic Development (Act of June 27, 1996 (P. L. 403, No. 58)), has outdated numerous sections of the regulations which relate to the former Department of Community Affairs and the forms required by it for annual reporting purposes. In addition, changes to municipal and county codes, effective September 8, 1990, have superseded certain provisions dealing with bidding thresholds, quotation procedures and evasion and need to be revised for clarity and consistency.

   The Department anticipates that this rulemaking will affect the The Department of Community and Economic Development; Engineering Districts; state associations and their constituencies, including the State Association of Boroughs, the State Association of Township Supervisors, the State Association of County Commissioners, and the Pennsylvania League of Cities and Municipalities.
