ENVIRONMENTAL HEARING BOARD

Marple Township v. DEP; EHB Doc. No. 97-281-MG

   The Department of Environmental Protection (Department) and Marple Township (Township) have agreed to a settlement of the above matter. The Department had ordered, on December 5, 1997, that the Township: (1) remove waste and leaves from the Langford and Sproul Road Sites; (2) complete specified work at the Sites; (3) return specified grant money; and (4) pay a civil penalty of $100,000. The Department further denied the Township's yard waste composting facility registration application.

   The parties have agreed to a settlement, the major provisions of which include: (1) that the Township, having already removed all visible waste from the Sites and having removed the leaves from the Langford Road Site, will stabilize and seed the area of the Langford Road Site impacted by the Township's leaf removal activity; (2) the Township will install a locking gate at the Sproul Road Site and a security barrier to prevent access to the Langford Road Site; (3) the Township will undertake specified additional work at the Sproul Site under specified conditions; (4) the Township will retain its grants; (5) the Township shall pay a civil penalty of $25,000; and (6) the Township may submit a permit application for a yard waste composting facility.

Rettinger, Esquire, Department of Environmental Protection, Office of Chief Counsel - Southeast Region, Lee Park - 555 North Lane, Suite 6015, Conshohocken, PA 19428-2283, and at the office of the Environmental Hearing Board, and may be reviewed by an interested party on request during normal business hours.

   A person believing himself aggrieved by the above settlement has a right to appeal to the Hearing Board, 2nd Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457.

   Appeals shall be filed within 20 days of this publication.

   The Environmental Hearing Board is empowered to approve this settlement which becomes final if no objection is timely made.
