[National Pollution Discharge Elimination System Program (NPDES)]
DISCHARGE OF CONTROLLED INDUSTRIAL WASTE AND SEWERAGE WASTEWATER
(Part I Permits) The following parties have applied for an NPDES permit to discharge controlled wastewaters into the surface waters of this Commonwealth. Unless otherwise indicated on the basis of preliminary review and application of lawful standard and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge subject to certain effluent limitations and special conditions. These proposed determinations are tentative.
Where indicated, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision to 40 CFR 123.6E.
Persons wishing to comment on the proposed permit are invited to submit a statement to the office noted above the application within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant.
Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
The application and related documents, proposed effluent limitations and special conditions, comments received and other information are on file and may be inspected and arrangements made for copying at the office indicated above the application.

This application is for an amendment of an NPDES permit to relax effluent limitations for total residual chlorine to discharge treated sewage from a sewage treatment plant serving industrial and residential establishments in Kennett Township, Chester County. This is an existing discharge to West Branch Red Clay Creek.
The receiving stream is classified for the following uses: trout stocking fishery, aquatic life, water supply and recreation.

This application is for reissuance of an NPDES permit to discharge treated sewage from a sewage treatment plant in East Goshen Township, Chester County. This is an existing discharge to Ridley Creek with plant expansion for 0.4 mgd to 0.75 mgd.
The receiving stream is classified for high quality trout stocking fishery.

Kreider Farms has submitted an application for an individual NPDES permit for an existing concentrated animal feeding operation (CAFO) known as the Kreider Dairy Farm, located on Indian Village Road in Penn Township, Lancaster County. The CAFO is situated near an unnamed tributary to Chickies Creek, which is classified as a Warm Water Fishery. The CAFO is designed to maintain 6,242 animal equivalent units (AEUs) consisting of 1,615 milk cows, 250 dry cows, 1,275 replacement heifers and 900,000 layers.
No new facilities are proposed as part of this application. Manure generated at the CAFO is collected and pumped to a separator room where solids are separated from liquid manure. Solid manure is composted on the farm and either sold or spread on neighboring farms. Liquid manure is managed through a three-stage storage system consisting of one reinforced concrete storage tank (900,000 gallons) and two earthen impoundments with a combined capacity of approximately 9.5 million gallons. There will be no release or discharge to waters of the Commonwealth under normal operating conditions. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations including the Final CAFO Strategy, the Department has made a tentative determination to issue an individual NPDES permit (Document # 3620-PM-WQ00514) for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the draft permit.
The permit application and proposed draft permit are on file at the Southcentral Regional Office of the Department. Persons may make an appointment to review the files by calling Mary DiSanto, File Review Coordinator, at (717) 705-4732.
The Environmental Protection Agency (EPA) permit review waiver provision under 40 CFR 123.24(e) does not apply to this NPDES permit. The Administrator of EPA Region III may review or object to any proposed NPDES permit actions.

For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the downstream potable water supply (PWS) considered during the evaluation is the Danville Water Authority located at Danville.

For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, there are no potable water supplies (PWS) at or near the point of discharge, nor until Elk Creek reaches Lake Erie.
