   The Department of Environmental Protection (Department) has taken the following actions on previously received Dam Safety and Encroachment permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   Persons aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, 400 Market Street, Floor 2, P. O.    E06-531. Encroachment. PennDOT, PA Department of Transportation, Engineering District 5-0, 1713 Lehigh Street, Allentown, PA 18103. To remove an existing structure and to construct and maintain a 16-foot x 4-foot precast concrete box culvert in the channel of a tributary to Willow Creek (CWF) at a point at SR 1011 (Fleetwood, PA Quadrangle N: 15.5 inches; W: 13.1 inches) in Maiden Creek Township, Berks County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E22-409. Encroachment. Robert Fried, 2323 Patton Road, Harrisburg, PA 17112. To place fill within a 0.046 acre wetland area which drains to a tributary to Manada Creek (WWF) and is located at the intersection of Route 39 and Old Jonestown Road (Hershey, PA Quadrangle N: 8.4 inches; W: 2.5 inches) for the purpose of construction of a commercial development in West Hanover Township, Dauphin County. The amount of wetland impact is considered de minimis and wetland mitigation is not required. This permit also includes 401 Water Quality Certification.

   E28-271. Encroachment. Trent Gadberry, 510 W. Loudon St., Chambersburg, PA 17201. To place and maintain a fill material within the right bank's 100-year floodway and provide a 24-inch revetment of an unnamed tributary to Conococheague Creek (CWF) in order to construct additional rental storage building located downstream of the Loudon Street Culvert (Chambersburg, PA Quadrangle N: 11.0 inches; W: 6.0 inches) in Chambersburg Borough, Franklin County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E67-673. Encroachment. James Hogg, 258 Kirstaln, Dallastown, PA 17313. To construct and maintain an outfall along the right downstream bank of a tributary channel to the East Branch Codorus Creek (HQ-CWF) from an off-stream farm pond overflow spillway. The pond is located west of White Oak Road between Sawmill and Hara Roads (Glen Rock, PA Quadrangle N: 11.25 inches; W: 4.75 inches) in Shrewsbury Township, York County. Issuance of this permit constitutes approval of the Environmental Assessment for the nonjurisdictional pond at project site.

   E67-681. Encroachment. Kinsley Equities, Richard Kinsley, R. D. 1, Box 131AA, Seven Valleys, PA 17360. To place fill in a de minimis area of wetlands equal to 0.04 acre adjacent to an unnamed tributary to the Little Conewago Creek (TSF) for the purpose of constructing proposed manufacturing/warehouse facility on Lot 96 of the Orchard Business Park located west of Expresso Way (York Haven, PA Quadrangle N: 9.5 inches; W: 17.0 inches) in East Manchester Township, York County. This permit also includes 401 Water Quality Certification.

   Northcentral Region: Water Management--Soils and Waterways, F. Alan Sever, Chief, 208 West Third St., Williamsport, PA 17701.

   E08-350. Encroachment. Paul E. Heise, District Engineer, PA Department of Transportation, P. O. Box 218, Montoursville, PA 17754. To remove and maintain sediment deposition for a distance of 434 feet to include 250 feet upstream of the structure, the 34 feet under the structure, and 150 feet downstream of the structure. A low-flow channel shall be constructed to maintain the streams pattern, profile and cross-section during low flow conditions throughout the work area. This permit also authorizes the installation of R-6 riprap along the stream banks to protect the stream from future bank erosion. The riprap will be constructed in a saw tooth pattern to maintain the low flow channel and to provide fish habitat (Troy, PA Quadrangle N: 4.76 inches, W: 5.69 inches) in Troy Borough, Bradford County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E17-336. Denied; Encroachment. J. Richard Fullington, Jr. and Loretta P. Fullington, 929 South Sixth Street, Clearfield, PA 16830. This application was to place and maintain fill in 0.3 acre of palustrine emergent wetland in order to expand an automobile dealership and provide parking for a school bus fleet. The project site is located on private property on the northwest side of S. R. 879, approximately 2,500 feet southwest of Exit 19 on I-80 (Clearfield, PA Quadrangle N:  6.3 inches; W:  4.1 inches) in Lawrence Township, Clearfield County. The application was denied.

   E53-338. Encroachment. Hyperion Telecommunications, Inc., d.b.a. Adelphia Business Solutions Operations, Inc., Main at Water Street, Coudersport, PA 16915-1141. To construct and maintain a 3-story, 250 car parking garage just north of the intersection of Niles Hill Road along Main Street partially in the floodway and below the 100-year flood elevation (8 2-square feet columns) of the Allegheny River (Coudersport, PA Quadrangle N:  5.65 inches; W:  2.75 inches) in Coudersport Borough, Potter County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E53-339. Encroachment. Kelly W. Crosby, 11 Quimby Road, Coudersport, PA 16915. To construct and maintain a 48-inch corrugated culvert pipe crossing and associated fill across South Hollow Stream located 2 miles south on SR 872 from the intersection with SR 6 (Sweden Valley, PA Quadrangle, N:  1 inch, W:  15 inches) in Eulalia Township, Potter County. This project proposes to impact 50 linear feet of South Hollow Stream which is designated a Cold Water Fishery and does not propose to impact any wetlands.

   E59-390. Encroachment. Le-Ma-Re Farms, R. R. 7, Box 106, Wellsboro, PA 16901. To remove gravel deposits from a reach of stream approximately 250 feet in length by 17 feet in width and construct and maintain one agricultural crossing and stream bank fencing. The project is located in and adjacent to an unnamed tributary to Wilson Creek in Coolidge Hollow beginning at the intersection of T-403 and Route 287 (Antrim, PA Quadrangle N:  12.2 inches; W:  5.3 inches) in Delmar Township, Tioga County.

   E60-140. Encroachment. Pennsylvania Department of Transportation, Engineering District 3-0, P. O. Box 218, Montoursville, PA 17754-0218. To remove gravel deposition from in and along White Deer Hold Creek to improve the hydraulic capacity of the existing S.R. 1012, Segment-Offset 0100/0355 bridge. The removal of the gravel deposition upstream of the S. R. 1012 bridge shall be limited to three areas that shall not exceed 150-feet upstream of the bridge centerline. The removal of the gravel deposition downstream of the S. R. 1012 bridge shall be limited to two areas that shall not exceed 200-feet downstream of the bridge centerline. The gravel deposition shall be removed to a point to within 6 inches of the water level at the time removal operations are commenced. The project is located along the western right-of-way of S. R. 0015 approximately 400-feet south of S. R. 2002 and S. R. 1012 intersection (Allenwood, PA Quadrangle N:  20.3 inches; W:  7.1 inches) in Gregg Township, Union County. This permit does not authorize any permanent or temporary impacts to jurisdictional wetlands associated to White Deer Hole Creek. This permit solely authorizes the one time removal of gravel deposition beyond the limits specified in the Department's ''Standards for Channel Cleaning at Bridges and Culverts.'' This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E32-401. Encroachment. Steven A. White, 1793½ Getty Avenue, Indiana, PA 15701. To construct and maintain a low flow crossing consisting of three, 30-inch diameter smooth interior polyethylene pipes, depressed 6 inches into the bed of Cheese Run (CWF) for the purpose of providing access to a proposed residential dwelling. The project is located on the southwest side of T-412, approximately 800 feet west of Trim Tree Road (T-430) (Ernest, PA Quadrangle N:  4.25 inches; W:  14.0 inches) in Armstrong Township, Indiana County. This permit was issued under section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E65-741. Encroachment. J. J. Gumberg Company, 1051 Brinton Road, Pittsburgh, PA 15221-4599. To construct and maintain the following structures for the purpose of development of North Huntingdon Square shopping complex: 1)  Extension of an existing concrete arch pipe under S. R. 30 in Tinkers Run Tributary No. 1 with a 76-foot long structural steel plate arch having a span of 12.8 feet and an underclearance of 8 feet; 2)  A 13-foot high, 922-foot long retaining wall on the right bank of Tinkers Run Tributary No. 1 starting just downstream of the culvert extension; 3)  An outfall structure from detention basin No. 2 and associated rip rap in wetlands; 4)  The aforementioned activities in combination will affect approximately 0.48 acre of wetlands (PEM). To compensate for wetland impacts, the permittee shall construct 0.48 acre of replacement wetlands (PEM). The project is located in North Huntingdon Square Shopping Center along S. R. 30, approximately 0.75 mile northwest of Turnpike Interchange No. 7 (Irwin, PA Quadrangle N:  12.45 inches; W:  8.25 inches) in North Huntingdon Township, Westmoreland County.
