LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected.

   For further information concerning the final report, please contact the Environmental Cleanup Program Manager in the Department Regional Office under which the notice of receipt of a final report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office listed.    Caparo Steel Company, 15 Roemer Boulevard, City of Farrell, County of Mercer, and Paul Wojciak of Environmental Management Associates, 10925 Perry Highway, Suite 23, Wexford, PA 15090, have submitted a Final Report concerning remediation of a site contaminated with Heavy Metals and Lead. The report is intended to document remediation of the site to the Statewide Health Standard.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Act (35 P. S. §§ 6026.101--6026.909) and Chapter 250 Administration of Land Recycling Program.

   Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act (act). Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report, and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   Pulsar Petroleum of Reading, Inc., Muhlenberg Township, Berks County. Storb Environmental, Inc., 410 North Easton Road, Willow Grove, PA 19090-2511 has submitted a remedial investigation report concerning the remediation of site soils and groundwater contaminated with BTEX and PHCs. The report was approved by the Department on November 7, 2000.

   Southwest Field Office:  John J. Matviya, Environmental Cleanup Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745, (412) 442-5217.

   Fuccillo Ford, Town of Hampton, Allegheny County. Fuccillo Ford, Route 11, Adams, NY, OP-TECH Environmental Services, 6392 Deere Road, Syracuse, NY 13220, and Paul Suozzi, 108 Sawyer Avenue, Tonawanda, NY 14150 has submitted a Final Report concerning remediation of site soil contaminated with PCBs, lead, heavy metals, solvents, BTEX, PHCs and PAHs. The Final Report demonstrated attainment of the Statewide Health Standard and was approved by the Department on September 18, 2000.

ENCROACHMENTS

   The Department of Environmental Protection has taken the following actions on previously received Dam Safety and Encroachment permit applications and requests for Environmental Assessment approval, and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).plan approval and has issued the following significant orders.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, 400 Market Street, Second Floor, P. O. To construct and maintain a 50-foot × 50-foot fenced compound containing a 150-foot high cellular monopole along with seven equipment cabinets on an elevated platform within the 100-year floodplain of the Lackawanna River. The project is located south of the intersection of Nay Aug Avenue and Electric Street (Scranton, PA Quadrangle N:  10.9 inches; W:  4.3 inches) in the City of Scranton, Lackawanna County.

   E48-297. Encroachment. T & S Development, 623 Selvaggio Drive, Nazareth, PA 18064. To construct and maintain the following water obstructions and encroachments in, along and across Nancy Run for the purpose of constructing Phases 9 and 10 of Emerald Hills residential subdivision; (1)  a pre-cast concrete open bottom arch culvert having a span of 30.9 feet and an underclearance of approximately 5.0 feet located along Washington Street; (2)  a pre-cast concrete open bottom arch culvert having a span of 33.2 feet and an underclearance of approximately 6.5 feet located along Bridge Lane, approximately 740 feet downstream of Washington Street; (3)  a 15-inch R.C.P. stormwater outfall structure and associated energy dissipater; and (4)  water, electric, telephone and cable television utility lines under and/or across Nancy Run. The project is located approximately 0.3 mile south of William Penn Highway (Nazareth, PA Quadrangle N:  6.2 inches; W:  9.5 inches) in Bethlehem Township, Northampton County.

   E35-327. Encroachment. Allied Services, P. O. Box 1103, Scranton, PA 18501. To remove the existing structure and to construct and maintain a 110-foot-long, 8.0-foot-diameter CMP stream enclosure in Leach Creek. The project is located along Smallacombe Drive, at the Allied Services Morgan Highway Campus, approximately 0.5 mile northwest of the intersection of S. R. 0307 (Morgan Highway) and S. R. 3011 (Keyser Avenue) (Scranton, PA Quadrangle N:  13.6 inches; W:  7.1 inches), in the City of Scranton, Lackawanna County.

   Northcentral Region:  Water Management--Soils and Waterways, F. Alan Sever, Chief, 208 West Third St., Williamsport, PA 17701.

   E17-351. Encroachment. Albert Yusnukis, Joe Fender Body and Frame Shop, 12 1/2 South Jared Street, DuBois, PA 15801-0367. To construct, operate and maintain a 2,500 square foot addition on the southwest rear of the existing business along South Jared Street. This permit also authorizes the demolition of an existing 1,350 square foot building bordering Pentz Run and West Washington Avenue. This project is located at the corner of South Jared Street and Spruce Alley (DuBois, PA Quadrangle, N:  21.8 inches; W:  2.15 inches) in the City of DuBois, Clearfield County. This permit was issued under Section 105.13(e) ''Small Projects.''

   E41-465. Encroachment. Paul W. Vollman, Jr., 691 Middle Road, Montgomery, PA 17752. To modify and maintain a road crossing of an unnamed tributary to West Branch, Susquehanna River, to provide access to a private residence. The road crossing shall be constructed with a metal culvert pipe that will have a minimum diameter of 54-inches and a minimum length of 18-feet. The project is located along the eastern right-of-way of SR 0054 approximately 3,836-feet east of Brouse and Middle Road Intersection (Muncy, PA Quadrangle N:  14.3 inches; W:  16.4 inches) in Clinton Township, Lycoming County. This permit does not authorize any activity to be conducted in wetlands. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E53-345. Encroachment. Homer Township Supervisors, 360 South Wood Road, Coudersport, PA 16915. To maintain a 5 foot 11 inch by 4 foot CMP culvert and a 5 foot by 10 foot reinforced concrete box culvert over an unnamed tributary of South Woods Branch Creek on Quimby Road approximately 0.2 mile and 0.6 mile east of the intersection of Quimby Road with Route 872 (Austin, PA Quadrangle N:  3.88 inches, W:  4.1 inches and 3.69 inches; W:  3.25 inches) in Homer Township, Potter County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E53-347. Encroachment. Roulette Chemical Engine Company Number 1, P. O. Box 172, Roulette, PA 16746. To remove the existing 50 foot by 95 foot building and to construct and maintain a 50 foot by 107 foot building to be used as a fire hall in the floodway of the Allegheny River adjacent to River Street approximately 100 yardssouth of the intersection of River Street with Main Street (Roulette, PA Quadrangle N:  4.6 inches; W:  3.9 inches) in Roulette Township, Potter County. This permit was issued under Section 105.13(e) ''Small Projects.''

   E57-089. Encroachment. Paul E. Heise, P.E., Pennsylvania Department of Transportation, Engineering District 3-0, P. O. Box 218, 715 Jordan Avenue, Montoursville, PA 17754-0218. To remove an existing bituminous overlaid timber deck steel I-beam bridge with an 18 foot 0 inch span, a curb to curb width of 12 feet 9 inches and a design underclearance of 3 feet 5 inches, to remove the left abutment and to construct and maintain a single span precast reinforced concrete slab superstructure with a curb to curb width of 18 feet 4 inches, a clear span of 18 feet 2 inches and a normal span of 15 feet 1 inch and an average underclearance of 4 feet 6 inches on a skew of 56 degrees over Big Run on SR 3003 approximately 2 miles north of Sonestown (Sonestown, PA Quadrangle N:  22.3 inches; W:  7.2 inches) in Davidson Township, Sullivan County.

   E59-407. Encroachment. Stephen L. Copp, R. R. 7, Box 312, Wellsboro, PA 16901. To operate and maintain a 5-foot wide by 60-foot long private foot bridge with a center span underclearance of 9 feet 10 inches over Asaph Run. This project is located 1/4 mile north on Asaph Road from the intersection with Marsh Creek Road, T-479 (Asaph, PA Quadrangle, N:  4.6 inches; W:  4.7 inches) Shippen Township, Tioga County. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

   E26-272. Encroachment. Pennsylvania Department of Transportation, Engineering District 12-0, P. O. Box 459, Uniontown, PA 15401. To remove the existing structure and to construct and maintain two 78-inch concrete pipe culverts in Stony Run (CWF), to repair, operate and maintain an existing 120 foot × 12 foot two span bridge across Indian Creek (CWF), and to place and maintain fill in a de minimis area of palustrine emergent wetland equal to 0.01 acre as part of the S. R. 0653 resurfacing project. This permit also authorizes the construction and maintenance of two outfall structures on S. R. 0653 each consisting of an 18-inch corrugated pipe along Stony Run at Stations 25+84 and 26+00. The project extends between the intersection of S. R. 0381 and S. R. 0653 and the Fayette-Somerset County line (Mill Run, PA Quadrangle N:  21.8 inches; W:  8.7 inches) in Springfield Township, Fayette County.

   E10-320. Encroachment. Zelienople Borough, 111 West New Castle Street, Zelienople, PA 16063. To construct and maintain a 48-inch diameter outfall along the left bank and rock riprap outlet protection in the channel of a tributary to Connoquenessing Creek immediately downstream of Jefferson Street approximately one block north of Beaver Street as part of a modification and improvement of the existing storm sewer system in the area of Beaver Street and Jefferson Street (Zelienople, PA Quadrangle N:  8.0 inches; W:  2.0 inches) in Zelienople Borough, Butler County.

ENVIRONMENTAL ASSESSMENT

   Southwest Regional Office:  Soils and Waterways Section, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

Permits Issued:

   Environmental Assessment No. EA63-001SW. Department of the Army, Pittsburgh District--Corps of Engineers, William S. Moorhead Federal Building, 1000 Liberty Avenue, Pittsburgh, PA 15222-4186. To construct and maintain 1,250 feet of streambank protection along Tenmile Creek (WWF). The stone protection will be a minimum of 30 inches thick, and approximately 8 feet in height. The project site is located within Tenmile Creek Park; approximately 1 mile from this watercourse's confluence with the Monongahela River (Mather, PA Quadrangle N:  19.0 inches; W:  2.2 inches) in East Bethlehem Township, Washington County.

WATER QUALITY CERTIFICATION


The Department of Environmental Protection has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   These actions of the Department may be appealed to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483, by any aggrieved person under The Environmental Hearing Board; (35 P. S. § 7514); and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law). Appeals must be filed with the Environmental Hearing Board within 30 days from the date of this issue of the Pennsylvania Bulletin unless the appropriate statute provides a different time period.    Dynamic Painting Corporation, 7 Willis Court, Hicksville, NY 11801. This project involves the power tool cleaning of 35,000 square feet and pressure washing and painting of approximately 200,000 square feet of the Tacony-Palmyra Bridge, which spans the Delaware Estuary--Zone 3 between Philadelphia, PA and Burlington County, NJ. Best Management Practices for bridge painting projects is proposed. Power tool cleaning will be done utilizing machines equipped with shrouds, hooked up to hepa vacuums. Mesh tarps will be used to catch any chips that could come off the bridge during cleaning. Potable water and cleaner will be used for pressure washing. It is expected that most of the water will dissipate into a mist. Certification Granted.

WATER ALLOCATIONS


Actions taken on applications filed under the Act of June 24, 1939 (P. L. 842, No. 365) (32 P. S. §§ 631--641) relating to the acquisition of rights to divert waters of this Commonwealth.

   WA63-83B. Water Allocation. Authority of the Borough of Charleroi, Washington County, PA. Modification order to expand the existing service area to include an area of Somerset Township immediately adjacent to Bentleyville Borough.

   WA2-131B. Water Allocation. Pittsburgh Water and Sewer Authority, Allegheny County, Pennsylvania. This permit grants:  the right to purchase, for public water supply purposes, 110,000 gallons per day (GPD) of water, on a peak month, 30 day average basis, from Tarentum Borough, Allegheny County.
