NOTICE OF INTENT TO ISSUE A PLAN APPROVAL AND AMEND A TITLE V OPERATING PERMIT Under 25 Pa. Code §§ 127.1 and 127.11, the Department of Environmental Protection (DEP) intends to issue a plan approval to Agere Systems Inc. (William R. Knolle, Air Quality Engineer, 555 Union Blvd., Allentown, PA 18103) for their plant in Allentown, Lehigh County. The facility currently has a Title V Operating Permit No. 39-00001. The plan approval includes terms and conditions to assure the proper operation of the sources, which satisfy the state and federal requirements. It includes, at a minimum, the conditions related to source description, emissions limits for pollutants, monitoring, recordkeeping and reporting, temporary operations to facilitate shakedown and temporary operation period. This plan approval will be incorporated into the Title V Operating Permit through an administrative amendment at a later date.
Plan Approval No. 39-313-044 is for operation of VOC emitting sources. The emissions from the sources will be controlled by a carbon adsorption and condenser and shall have a Plantwide Applicability Limit of 87.7 tons of VOC per year. Although the sources covered by this plan approval may be located at a major facility, the installations/ modifications do not trigger major new source review or prevention of significant deterioration requirements.
Northwest Region: Air Quality Program, 230 Chestnut Street, Meadville, PA 16335-3481.
Under 25 Pa. Code §§ 127.44(b) and 127.424(b), that the Department of Environmental Protection (DEP) intends to issue a plan approval to American Refining Group (77 North Kendall Avenue, Bradford, PA 16701) for their plant in the city of Bradford, McKean County. The facility currently has a Title V Operating Permit No. 42-00004, which was issued November 13, 2000. This plan approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into the Title V Operating Permit through an administrative amendment at a later date.
The application is for an Isomer Unit that will take Light Straight Run (LSR) feed from the existing naphtha fractionator unit and treat it with platformer gases to boost the octane value of the LSR. The design maximum processing rate for the LSR is 1000 barrel per day. This process will not cause an increase in production nor will it cause an increase in emissions for any other process. The only emission point in this unit will be a natural draft gas fired heater. The draft is adjusted manually. There will be a number of potential fugitive emission points due to potential equipment leaks. There are two relief valves on the recycle gas system for protection of equipment. All relief valves will be connected to flare header such that any release that occurs at the startup, shut down, or upset, will be passed through the refinery flare. The fuel usage and emissions for natural gas and refinery gas are based on continuous operation of 8,760 hours per year. This source is subject to Federal NSPS Regulations, 40 CFR Part 60, Subpart J Standards of Performance for Petroleum Refineries. The applicable refinery gas is low sulfur fuel (<162 ppm). Subpart J requires the facility to comply with the H2S emission limit of 0.10 gr/dscf for the refinery fuel gas. The facility has proposed using an existing H2S CEMS monitoring the low sulfur stream from the stabilizer unit and achieve compliance with the requirements of Monitoring of Emissions and Operations (Subpart J Section 60.105). The refinery already implements LDAR for the equipment leaks. The new isomerization unit will be covered by the same program. There are no process vents associated with this unit. Existing storage vessels will be utilized for feed and product storage.
Under 25 Pa. Code §§ 127.44(b) and 127.424(b), that the Department of Environmental Protection (DEP) intends to issue a plan approval to Ellwood Quality Steels Company (700 Moravia Street, New Castle, PA 16101) for their plant in the City of New Castle, Lawrence County. The facility currently has a Title V Operating Permit issued December 27, 1999. This plan approval will, in accordance with 25 Pa. Code § 127.450, be incorporated into the Title V Operating Permit through an administrative amendment at a later date.
This plan approval application is for modification of Furnace No. 17. The modification will remove the existing 1942 vintage burners and controls and replace them with new burners and controls, which will utilize low NOx technology. The overall NOx emissions are expected to drop from 12.3 tpy to 4.6 tpy.
MINING ACTIVITY APPLICATIONS
Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); The Coal Refuse Disposal Control Act (52 P. S. §§ 30.51-30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).
The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District Mining Office indicated above each application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.
Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).
Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52, and 90.102) for iron, manganese, suspended solids, settable solids, alkalinity, and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.
Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401 The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)), requires the State to certify that the involved projects will not violate the applicable provisions of Sections 301--303, 306 and 307 of the FWPCA 33 U.S.C.A. §§ 1311--1313, 1316 and 1317 as well as relevant state requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application. The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Project description: The Erie-Western Pennsylvania Port Authority has requested a State certification under Section 401(a) of the Federal Clean Water Act (33 U.S.C.A. § 1341(a)) discharge of dredged material from the East Avenue Launch Ramp into the Lake Erie Harbor Confined Disposal Facility (CDF) will comply with the applicable provisions of Sections 301--307 of Federal Clean Water Act.
This request was necessitated by conditions imposed by the Department's Water Obstruction and Encroachment Permits E25-404A and E25-581 issued to the Erie-Western Pennsylvania Port Authority requiring Federal Water Act Section 401 certification for the disposal of dredged material into the CDF prior to each dredging and disposal event. The Erie-Western Pennsylvania Port Authority has sampled and tested the sediments in accordance with Attachment A ''Sample Collection and Testing Protocol'' of both Water Obstruction and Encroachments Permits E25-404A and E25-581. Laboratory testing was conducted in accordance with the US Army Corps of Engineer's Inland Testing Manual and the document ''Ecological Evaluation of Proposed Discharge of Dredged or Fill Material in Navigable Waters.'' Based upon this sampling and laboratory testing, the Erie-Western Pennsylvania Port Authority indicates that the approximately 500 cubic yards of basin sediments from the East Avenue Launch Ramp (Erie North, PA N: 3.6 inches; W: 8.9 inches) discharged into the Lake Erie Harbor Confined Disposal Facility (Erie North, PA N: 4.7 inches; W: 10.3 inches) will have a relatively insignificant impact on the water quality of Lake Erie. This 401 Water Quality Certification is only for this single activity. Any subsequent dredging of the East Avenue Launch Ramp basin and use of the CDF will require separate 401 Water Quality Certification.

NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM PROGRAM (NPDES)
INDUSTRIAL WASTE AND SEWERAGE WASTEWATER The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval.
Persons aggrieved by this action may appeal, under Section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS The following parties have submitted: (1) Notices of Intent (NOIs) for Coverage Under (1) General NPDES Permits to Discharge Wastewater into the Waters of the Commonwealth.
