   This existing facility is located in Greene Township, Clinton County.

   Description of Proposed Activity: Schrack Farms contains a dairy Concentrated Animal Feeding Operation (CAFO) operated with the primary purpose of generating milk. The estimated population of the CAFO will be maintained at 610 milk cows and 468 replacement heifers, totaling 1,275 Animal Equivalent Units (AEUs).

   The receiving stream, Fishing Creek, is in the Bald Eagle Creek Watershed (SWP 9-C) and is classified for: High Quality--Cold Water Fishes (HQ-CWF).

   The proposed effluent limits for the operation/activity include: except for the chronic or catastrophic rainfall events defined as over the 25 year/24 hour rain storms, the CAFO permit is a nondischarge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The general permit requires no other numeric effluent limitations and compliance with Pennsylvania Nutrient Management Act and the Clean Stream Law constitutes compliance with the State narrative water quality standards.

   Description of Proposed Activity: discharge of treated I.W., noncontact cooling water and stormwater.

   The receiving stream, Connoquenessing Creek (Outfalls 001--005, 007--016), Sawmill Run (Outfalls 006 and 026), Rocklick Run (Outfalls 017--024) and Sullivan Run (Outfall 025), is in watershed 20-C and classified for: warm water fishes, aquatic life, water supply and recreation. For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride and phenolics, the existing/proposed downstream potable water supply considered during the evaluation is Zelienople Municipal Water Works on Connoquenessing Creek located at Zelienople, approximately 20 miles below point of discharge.

WATER QUALITY MANAGEMENT PERMITS

APPLICATIONS UNDER THE PENNSYLVANIA CLEAN STREAMS LAW

PART II PERMITS

   The following permit applications or requests for plan approval have been received by the Department of Environmental Protection (Department). The applications are listed in two categories. Section I lists all municipal and industrial permits and Section II lists oil and gas related permit applications.

   Persons wishing to comment on any of the applications are invited to submit a statement to the office noted above the application within 15 days from the date of this public notice. Comments received within this 15-day comment period will be considered in making the final decision regarding the application. The comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

   The Department reserves the right to hold a public hearing if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation of the area. If no hearing is held, the Department's Water Management Program Manager will make a final determination regarding the applications after a complete review. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

   A copy of the permit application or proposed plan is on file in the office indicated and is open to public inspection. Appointments to review the application may be made by contacting Records Management at the indicated telephone number.


I.  Industrial Waste and Sewerage Applications under The Clean Streams Law (35 P. S. §§ 691.1--691.1001).

   Description of Proposed Action/Activity: Phase I of the project involves construction of sanitary sewers and force mains to collect and convey sewage to the Waymart Area Wastewater Treatment Plant. Phase II of the project will include the upgrade of the WWTP from a 0.21 MGD facility to a 0.715 MGD facility and the installation of approximately 1,600 ft. of a gravity interceptor from the Borough. Phase II will also include a 14,000 ft. pipeline to convey the effluent to a discharge point located along Van Auken Creek downstream of Keen Lake in Canaan Township.

   Description of Proposed Action/Activity: Replacement of the Asland Heights Phase II pumping station with the Willow Creek Pump Station to serve the Bentley Croft Subdivision for conveyance to the York City Sewer Treatment Plant.

   This proposed facility is located in Silver Spring Township, Cumberland County.

   Description of Proposed Action/Activity: Construction/Operation of the Cumberland Valley Motors/Team Rahal Sewer Extension & Pump Station.


NPDES Stormwater Individual Permit

   The following parties have applied for an NPDES permit to discharge stormwater associated with a construction activity into waters of this Commonwealth. Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department of Environmental Protection (Department) proposes to issue a permit to discharge, subject to certain limitations set forth in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices (BMPs) which restrict the rate and quantity of sediment discharged.

   Where indicated, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).

   Persons wishing to comment on the proposed permit are invited to submit a statement to the appropriate Department Regional Office noted above the application within 30 days from the date of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate DEP Regional Office during the 30-day public comment period.

   Following the 30-day comment period, the appropriate Regional Office Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.

   The application and related documents, including the erosion and sediment control plan for the earth disturbance activity, are on file and may be inspected at the office identified in this notice.
