Availability of Technical Guidance
[31 Pa.B. 5760] Technical guidance documents are on DEP's website (www.dep.state.pa.us) at the Public Participation Center page. The ''July 2001 Inventory'' heading is the Governor's list of nonregulatory guidance documents. The ''Final Documents'' heading is the link to a menu of the various DEP bureaus and from there to each bureau's final technical guidance documents. The ''Draft Technical Guidance'' heading is the link to DEP's draft technical guidance documents.
DEP will continue to revise its nonregulatory documents, as necessary, throughout 2001.
Ordering Paper Copies of DEP Technical Guidance
DEP encourages the use of the Internet to view guidance documents. When this option is not available, persons can order a bound paper copy of the latest inventory or an unbound paper copy of any of the final documents listed on the inventory by calling DEP at (717) 783-8727.
In addition, bound copies of some of DEP's documents are available as DEP publications. Check with the appropriate bureau for more information about the availability of a particular document as a publication.

Draft Technical Guidance--Substantive Revision
DEP ID: 012-0200-001 Title: Policy for Consideration of Local Comprehensive Plans and Zoning Ordinances in DEP Review of Permits for Facilities and Infrastructure Description: DEP has amended its permit review process to consider, and under certain conditions, rely upon comprehensive planning and zoning ordinances in our decision making process on authorizations related to facilities and infrastructure. As of January 29, 2001, DEP has had a final policy in place to address the new legal obligations created by Act 247 as amended by Acts 67, 68 and 127 of 2000. This document is a draft substantial revision to the current policy. Specifically, the proposed revisions attempt to clarify some questions raised about interpretation and implementation of the final policy since it became effective and to offer an ''early opt-out option'' for those permit applicants meeting certain requirements. DEP ID: 550-3000-001 Title: Compliance Monitoring of Oil and Gas Wells and Related Facilities and Activities Description: DEP's Oil and Gas Management program will conduct inspections and compliance monitoring activities according to strategies and guidelines stated herein. The purpose of this guidance is to provide DEP staff interpretation of applicable laws and regulations, and to provide instructional guidance to oil and gas operators as well as DEP staff. DEP ID: 550-4180-001 Title: Civil Penalty Assessments in the Oil and Gas Management Program Description: In assessing civil penalties in unilateral penalty actions, and in calculating appropriate penalties in negotiated settlements, DEP's Oil and Gas Management Program will follow the policies stated and referenced herein when pursuing a settlement of complaints for violations or a penalty action. The purpose of this document is provide procedural guidance to DEP staff in calculating civil penalty amounts to seek in settlements or to assess in penalty actions for violations, and to provide advisory information to the regulated industry. Final Technical Guidance
DEP ID: 362-2207-008 Title: Administration of Fee Collection for Planning Module Reviews Description: The purpose of this guidance is to establish a standardized procedure for collecting fees for the review of planning modules for new land development (planning modules) in accordance with the requirements set forth in the Act 149 of 1994 amendments to the Sewage Facilities Act (Act 537). This guidance will assist DEP regional staff in the Act 537 program in the calculation, collection and disposition of fees received by DEP for reviewing of planning modules.
