NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS
NPDES APPLICATIONS
PART I PERMITS Under the Federal Clean Water Act and The Clean Streams Law, the following parties have applied for an NPDES permit or to renew their current permit to discharge controlled wastewaters into the waters of this Commonwealth or to conduct other activities required by the NPDES permit. For renewal applications listed in Section I, the Department of Environmental Protection (Department) has made a tentative determination to reissue these permits for 5 years subject to effluent limitations and monitoring and reporting requirements in their current permits, with appropriate and necessary updated requirements to reflect new and changed regulations and other requirements. For all new permit applications, renewal application with major changes or applications for permits not waived by the EPA, the Department, based upon preliminary reviews, also made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications listed in Section II. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to this proposed permit action under the waiver provision 40 CFR 123.24(d).
Persons wishing to comment on the proposed permit are invited to submit a statement, to the office noted before the application within 30 days from the date of this public notice. Comments received within this 30-day comment period will be considered in the formulation of the final determinations regarding this application. The comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based. A public hearing may be held if the responsible office considers the public response significant. Following the comment period, the Department's Water Management Program Manager will make a final determination regarding these applications. Notice of this final determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board.
The renewal application, including proposed effluent limitations and special conditions, is available on file. For new permit applications, information submitted with the applications is available on file. The information may be inspected and arrangements made for copying at the office indicated above the application.

This proposed facility is located in Manor Township, Lancaster County.
Description of Proposed Activity: The Rohrer Dairy Farm LLC is an existing dairy and swine operation with a total AEUs of 1,557.9. An estimated quantity of total annual manure production is 95,088 tons. The operation consists of 750 milking cows, 100 dry cows, 385 heifers, 1,400 calves and 130 swine. The dairy manure is handled as both a liquid and solid. The liquid manure storage consists of a slotted floor barn with two pits 432 ft × 47 ft × 8 ft deep with a useable storage of approximately 2.3 million gallons. There is also a slurry store and three round concrete manure storages associated with the main dairy. The slurry store is 62 ft × 23 ft with a useable storage of 490,000 gallons. The round concrete structures are 32 ft × 12 ft with a combined useable storage of 216,000 gallons. The manure storage for the swine facility is a lagoon roughly 0.35 acres × 12 feet with a useable storage of 1.200 million gallons. All of the manure generated on the farm is used on the farm.
The receiving stream, Stamans Run, is in the State Water Plan watershed 7-J and is classified for: WWF.
The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25 year/24 hour rain storms, the CAFO general permit is a non-discharge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The general permit requires no other numeric effluent limitations and compliance with Pennsylvania Nutrient Management Act and the Clean Stream Law constitutes compliance with the state narrative water quality standards.
PA#0246875, CAFO, Robert B. Ruth and Dale Martin, Quail Ridge Farm, P. O. Box 9, 101 West Harrisburg Avenue, Rheems, PA 17570.
This proposed facility is located in Perry Township, Berks County.
Description of Proposed Activity: The Quail Ridge Farm is new swine facility with estimated total AEUs of 1,379.8. An estimated quantity of total annual manure production is 1,488 tons. The operation will consist of 2,800 sows, 336 sows with litter, four boars and 688 gilt finishers. The animals will be confined to two barns 365 days a year, 100% of the time. The gestation barn will be 87 feet wide and 718 feet long with a 9-foot deep reinforced, concrete, manure storage under the building. The total depth of the storage minus the freeboard from the lowest level of the pit fans is seven foot. The approximate total volume of the storage equals 3,270,720 gallons. The farrowing barns will be 82 feet wide and 458 feet long with a 2-foot shallow reinforced concrete storage under the building. The approximate total volume of the storage equals 561,838 gallons. The manure from the farrowing barn flows via gravity into the large storage under the gestation barn. The manure is pumped from the large storage into a tank truck for injection into the soil. Of the 2,975,860 gallons of manure generated on the farm, 1,055,870 will be used on the farm with 1,919,990 gallons exported from the farm to neighboring farms.
The receiving stream, UNT to Pequea Creek, is in the State Water Plan watershed 3-B and is classified for: HQ-CWF.
The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25 year/24 hour rain storms, the CAFO general permit is a non-discharge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The general permit requires no other numeric effluent limitations and compliance with Pennsylvania Nutrient Management Act and the Clean Stream Law constitutes compliance with the state narrative water quality standards.

This proposed facility is located in North Heidelberg, Berks County.
Description of Proposed Activity: The Gel-Bare Farms is an expanding dairy operation with a total AEUs of 1,328.5. An estimated quantity of total annual manure production is 23,678 tons. The expansion will include a new free-stall barn with milking parlor and a new manure handling system. After the expansion there will be approximately 600 Holstein milking cows with 100 dry cows, 350 heifers, 350 calves and four bulls. The new manure handling system will consist of a solid separator and a two stage HDPE lined liquid storage facility. Of the 5,866,257 gallons and 8,866 tons of manure generated on the farm none of this is exported from the farm but all used on the owned or rented farm..
The receiving stream, Tulpehocken Creek, is in the State Water Plan watershed 3-C and is classified for: TSF.
The proposed effluent limits for the operation/activity include: Except for the chronic or catastrophic rainfall events defined as over the 25 year/24 hour rain storms, the CAFO general permit is a nondischarge NPDES permit. Where applicable, compliance with 40 CFR Federal effluent limitation guidelines is required. The general permit requires no other numeric effluent limitations and compliance with Pennsylvania Nutrient Management Act and the Clean Stream Law constitutes compliance with the state narrative water quality standards.

This facility is located in Greene Township, Franklin County.
Description of activity: The application is for issuance of an NPDES permit for a new discharge of treated industrial waste.
The receiving stream, dry swale to Rocky Spring Branch, is in Watershed 13-C, and classified for trout stocking fishery, water supply, recreation, and fish consumption. The nearest downstream public water supply intake for Hagerstown, Maryland is located on the Potomac River. The discharge is not expected to affect the water supply.

Application No. PA 0246859, Concentrated Animal Feeding Operation (CAFO), Amos L. Hoover (Hickory Lane Farm), RD 1, Box 706, Blain, PA 17006.
Amos Hoover has submitted an application for an Individual NPDES permit for an existing CAFO known as Hickory Lane Farm, located on Hickory Lane in Jackson Township, Perry County.
The CAFO is situated near Sherman Creek in Watershed 7-A, which is classified for High Quality-Cold Water Fishes. The CAFO is designed to maintain an animal population of approximately 1,165 animal equivalent units (AEUs) consisting of 672 gestating sows, 98 sows with litter, 33 boars, 1,865 nursery pigs, 4,759 grower/finishes pigs, 77 gilt replacement, 104 gilt developer and 110 feeder cattle. The animals will be housed in one barn. Manure is piped to a clay-lined storage pond. The total capacity of the manure storage facilities is 4,070,662. A release or discharge to waters of this Commonwealth under normal operating conditions is not expected. Normal operating conditions are defined as conditions below a 25-year, 24-hour storm event.
The Department has conducted administrative and technical reviews of the application. Based on the preliminary review and application of lawful standards and regulations, the Department has made a tentative determination to issue an NPDES permit for the operation subject to the terms and conditions and monitoring and reporting requirements specified in the permit.
The permit application and draft permit are on file at the Southcentral Regional Office of the Department. Individuals may make an appointment to review the files by calling the File Review Coordinator at (717) 705-4732.
Persons wishing to comment on the proposed permit are invited to submit written comments to the above address within 30 days from the date of this public notice. Comments received within this 30-day period will be considered in formulating the Department's final determination regarding the application. All comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the basis of the comment and the relevant facts upon which it is based.
Following the 30-day comment period, the Water Management Program Manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time the determination may be appealed to the Environmental Hearing Board.
The Environmental Protection Agency permit waiver provision under 40 CFR 123.24(e) does not apply to this NPDES permit.

The receiving stream is in the Bald Eagle watershed (9-C) and is classified for the following uses: Warm water fishery and aquatic life, water supply and recreation.

The following effluent limitations are proposed for discharge to the receiving waters, Monongahela River and Unnamed Tributaries of Monongahela River, classified as warm water fisheries with existing and/or potential uses for aquatic life, water supply, and recreation.
