Service of Notice of Motor Carrier Applications

   The following temporary authority and/or permanent authority applications for the right to render service as a common carrier or contract carrier in this Commonwealth have been filed with the Pennsylvania Public Utility Commission. Formal protests and petitions to intervene must be filed in accordance with 52 Pa. Code. A protest shall indicate whether it applies to the temporary authority application, the permanent authority application, or both. Filings must be made with the Secretary, Pennsylvania Public Utility Commission, P. O. Box 3265, Harrisburg PA 17105-3265 with a copy served on the applicant by February 10, 2003. Documents filed in support of the applications are available for inspection and copying at the Office of the Secretary between 8 a.m. and 4:30 p.m., Monday through Friday, and at the business address of the respective applicant.

COMPLAINT

   The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Transportation and Safety and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Transportation and Safety Prosecutory Staff hereby represents as follows:

   1.  That Hermann Transportation Services, respondent, maintains its principal place of business at 9 Distribution Way, South Brunswick, New Jersey 08852.

   2.  That, on the date of the violation alleged in this complaint, respondent did not hold a certificate of public convenience issued by this Commission.

   3.  That respondent, on June 10, 2002, at approximately 10:15 a.m., at Exit 37 (I-476), Pittston Township, Luzerne County, Pennsylvania, permitted a certain 1996 Volvo truck bearing New Jersey License No. AE529J, Vehicle Identification No. 4V4WDBJF3TN713001, to be operated. At that time, Enforcement Officer Andrew J. Turriziani found said vehicle to be transporting furniture from J C Penney Co., Inc., 905 Wheeler Way, Langhorne, Bucks County, Pennsylvania to Cawley Brothers, 211 Birch Street, Scranton, Lackawanna County, Pennsylvania, without authority. Respondent was warned previously on April 7, 1999.

   4.  That respondent, in performing the act described in Paragraph 3 of this complaint, violated the Public Utility Code, 66 Pa.C.S. § 1101, in that respondent transported property for compensation between points in the Commonwealth of Pennsylvania while not then holding a certificate of public convenience issued by this Commission. Penalty is $500.00.

   WHEREFORE, the Bureau of Transportation and Safety Prosecutory Staff hereby requests that the Commission fine Hermann Transportation Services, the sum of five hundred dollars ($500.00) for the illegal activity described in this complaint and order such other remedy as the Commission may deem to be appropriate.

   The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Transportation and Safety and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Transportation and Safety Prosecutory Staff hereby represents as follows:

   1.  That Cumberland Transportation Corp., respondent, maintains its principal place of business at P. O. Box 487, 5950 Fisher Road, East Syracuse, NY 13057.

   2.  That respondent was issued a certificate of public convenience by this Commission on April 27, 1994, at Application Docket No. A-00111133.

   3.  That respondent abandoned or discontinued service without having first submitted a letter to this Commission containing a statement that the service is no longer being rendered. Respondent has not reported intrastate revenue for the years 1999, 2000 and 2001.

   4.  That respondent, by failing to submit a letter to this Commission containing a statement that the service is no longer being rendered, violated 52 Pa. Code § 3.381(a)(5) and, by failing to maintain adequate, efficient and safe service and facilities, violated 66 Pa.C.S. § 1501.

   WHEREFORE, the Bureau of Transportation and Safety Prosecutory Staff hereby requests that the Commission revoke respondent's Certificate of Public Convenience at A-00111133.

COMPLAINT

   The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Transportation and Safety and other Bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Transportation and Safety Prosecutory Staff hereby represents as follows:

   1.  That Advanced Distribution System, Inc., respondent, maintains its principal place of business at P. O. Box 28228, 4181 Arlingate Plaza, Columbus, OH 43228.

   2.  That respondent was issued a certificate of public convenience by this Commission on June 28, 1995, at Docket No. A-00111987.

   3.  That, on August 17, 2001, respondent was sent an initial assessment of $71. Respondent failed to pay this assessment; therefore, a balance was due in the amount of $71.

   4.  That respondent has an outstanding assessment of $71.

   5.  That respondent failed to file objections to the assessment, pursuant to 66 Pa.C.S. § 510(c).

   6.  That respondent, by failing to pay the assessment, violated the Public Utility Code at 66 Pa.C.S. § 510(c).

   WHEREFORE, unless respondent pays the overdue assessment in full within twenty days of the date of service of this Complaint, the Bureau of Transportation and Safety Prosecutory Staff hereby requests that the Commission issue a Secretarial Letter which (1) cancels the Certificate of Public Convenience issued to respondent, (2) directs the Pennsylvania Department of Transportation to revoke the motor vehicle registration(s) issued to respondent, (3) notifies the Pennsylvania Department of Revenue that respondent's Certificate of Public Convenience has been revoked, (4) notifies respondent's insurance carrier that respondent's Certificate of Public Convenience has been revoked and (5) imposes an additional fine on the respondent.

   3.  That, on August 17, 2001, respondent was sent an initial assessment of $73. Respondent failed to pay this assessment; therefore, a balance was due in the amount of $73.

   4.  That respondent has an outstanding assessment of $73.

   5.  That respondent failed to file objections to the assessment, pursuant to 66 Pa.C.S. § 510(c).

   6.  That respondent, by failing to pay the assessment, violated the Public Utility Code at 66 Pa.C.S. § 510(c).

COMPLAINT

   The Pennsylvania Public Utility Commission (Commission) is a duly constituted agency of the Commonwealth of Pennsylvania empowered to regulate public utilities within the Commonwealth. The Commission has delegated its authority to initiate proceedings which are prosecutory in nature to the Bureau of Transportation and Safety and other bureaus with enforcement responsibilities. Pursuant to that delegated authority and Section 701 of the Public Utility Code, the Bureau of Transportation and Safety Prosecutory Staff hereby represents as follows:

   1.  That Douglas Ralph Carey, t/a D. C. Trucking, respondent, maintains its principal place of business at 841 Brickcrafters Road, New Oxford, Pennsylvania 17350.

   2.  That respondent was issued a certificate of public convenience by this Commission on March 30, 2001, at Application Docket No. A-00116236, F. 2.

   3.  That respondent, by Commission Secretarial letter dated February 12, 2001, was informed to submit a copy of a current satisfactory safety rating from the U.S. Department of Transportation or another state, within 180 days, or complete a safety fitness review by a Commission enforcement officer. On June 3, 2002, a safety fitness review was conducted by an enforcement officer of the Pennsylvania Public Utility Commission. As a result of that review, respondent's safety fitness evaluation was unsatisfactory. By letter dated July 10, 2002, respondent was notified that attempts to contact respondent by telephone to schedule a second safety fitness review had been unsuccessful. A satisfactory safety fitness rating must be achieved by respondent in order to maintain a certificate of public convenience to operate as a common carrier of property between points in the Commonwealth of Pennsylvania.

   4.  That respondent, by failing to achieve a satisfactory evaluation on their safety fitness review, violated 66 Pa.C.S. § 501(c) and, for failure to maintain adequate, efficient and safe service and facilities, violated 66 Pa.C.S. § 1501.

   WHEREFORE, the Bureau of Transportation and Safety Prosecutory Staff hereby requests that the Commission revoke Douglas Ralph Carey, t/a D. C. Trucking, certificate of public convenience at A-00116236, F. 2. Should respondent wish to again provide Pennsylvania intrastate transportation, the filing of a new application and a $100 fee is required. The application and fee shall be filed with the Secretary, Pennsylvania Public Utility Commission, P. O. Box 3265, Harrisburg, PA 17105-3265.
