STATE CONTRACTS INFORMATION
DEPARTMENT OF GENERAL SERVICES
Act 266 of 1982 provides for the payment of interest penalties on certain invoices of "qualified small business concerns". The penalties apply to invoices for goods or services when payments are not made by the required payment date or within a 15 day grace period thereafter.
Act 1984-196 redefined a "qualified small business concern" as any independently owned and operated, for-profit business concern employing 100 or fewer employees. See 4 Pa.Code § 2.32. The business must include the following statement on every invoice submitted to the Commonwealth: "(name of business) is a qualified small business concern as defined in 4 Pa. Code 2.32."
A business is eligible for payments when the required payment is the latest of:
The payment date specified in the contract.
30 days after the later of the receipt of a proper invoice or receipt of goods or services.
The net payment date stated on the business' invoice.
A 15-day grace period after the required payment date is provided to the Commonwealth by the Act.

44-931595 Contractor shall supply One (1) 1,000 Gallon Aboveground Concrete Vaulted, Double Walled Storage Tank for District 2, Keewaydin Stockpile, SR 879, Clearfield County. Tank shall be constructed with a minimum of 3/16" thick carbon steel in accordance with UL Listed Standard 142 and meeting the requirements of NFPA 30 and fitted for grounding requirements of NFPA 78. Site preparation and tank installation will not be covered under this contract and will be furnished through a separate contract. AMD 65(1183)102.1 Acid Mine Drainage Abatement Project, Keystone. The principal items of work and approximate quantities include 2,850 cubic yards of grading, 521 cubic yards of ditch excavation, 725 square yards of R-4 rock lining, 120 tons of R-4 rock embankment, 3,800 square yards of impervious lining (PVC), 1,460 square yards of roadway surface material, 55 linear feet of corrugated polyethylene pipe, 2,252 tons of aggregate (high CaCO3 content), 2,690 linear feet of polyvinyl chloride (PVC) pipe, 5 gate valves, 18 ball valves, 1 flume, 1 concrete vault with siphon, 400 cubic yards of spent mushroom compost and 3 acres of seeding. This project issues on September 19, 2003, and bids will be opened on October 16, 2003 at 2:00 p.m. Payment in the amount of $10.00 must be received before bid documents will be sent. Funding for this project is available from the $24.7 million for Pennsylvania's 2002 AML Grant.
