LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995

PREAMBLE 3


The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8 and the administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by provisions of the act for compliance with selection of remediation to a Site-Specific Standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

   For further information concerning the plans and reports, contact the environmental cleanup program manager in the Department regional office after which the notice of the plan or report appears. If information concerning a final report is required in an alternative form, contact the community relations coordinator at the appropriate regional office.    The Department has received the following plans and reports:

   Southeast Region: Environmental Cleanup Program Manager, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428.

   403 West Lincoln Highway Site, Coatesville Borough, Chester County. William B. Gilchrist, P. G., Roux Associates, Inc., 1222 Forest Parkway, Suite 190, West Deptford, NJ 08066, on behalf of AMTRAK, Attn: Jack Schweitzer, 30th St. Station, 5th Floor, Box 13, Philadelphia, PA 19104, has submitted a Final Report concerning the remediation of site soil contaminated with diesel fuel, kerosene, leaded gasoline, unleaded gasoline and used motor oil. The Final Report demonstrated attainment of the Statewide Health Standard and was approved by the Department on October 29, 2003.

   Vacant Parcel--Germantown Avenue, City of Philadelphia, Philadelphia County. Jeffrey T. Bauer, Whitestone Associates, Inc., 1120 Welsh Rd., Suite 100, North Wales, PA 19454, on behalf of Michael Young, 229 W. Upsal St., Philadelphia, PA 19119, has submitted a Remedial Investigation/Final Report concerning remediation of site soil and groundwater contaminated with lead and PAH. The report did not demonstrate attainment of Site-Specific Standards and was disapproved by the Department on October 30, 2003.

   Southcentral Region: Environmental Cleanup Program Manager, 909 Elmerton Avenue, Harrisburg, PA 17110.

   Shippensburg Former Manufactured Gas Plant Site, Shippensburg Borough, Cumberland County. Corporate Environmental Solutions, 260 Millers Run Road, Bridgeville, PA 15017, on behalf of PPL Services Corp., 2 North Ninth Street, Allentown, PA 18101, submitted a Final Report concerning the remediation of site soils and groundwater contaminated with PCBs. The Final Report demonstrated attainment of both the Statewide Health and Site-Specific Standards and was approved by the Department on November 14, 2003.

DETERMINATION OF APPLICABILITY FOR RESIDUAL WASTE GENERAL PERMITS


Determination of Applicability for General Permit Issued under the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003), the Municipal Waste Planning, Recycling and Waste Reduction Act (53 P. S. §§ 4000.101--4000.1904) and residual waste regulations for a general permit to operate residual waste processing facilities and/or the beneficial use of residual waste other than coal ash.

   General Permit No. WMGR002D006.  Wecare Organics LLC, 9289 Bonta Bridge Rd., Jordan, NY 13080. For the beneficial use of wastewater treatment sludge generated by paper mills for use as a soil additive to: establish or re-establish agricultural productivity on disturbed land; establish herbaceous wildlife habitat; facilitate revegetation on disturbed land at permitted and abandoned mine sites. The Department issued the determination of applicability on March 11, 2002.

   General Permit No. WMGR002D007.  Hilltop Enterprises Inc., 1418 Hilltop Rd., Chester Springs, PA 19425. For the beneficial use of wastewater treatment sludge generated by paper mills for use as a soil additive to: establish or reestablish agricultural productivity on disturbed land; establish herbaceous wildlife habitat; facilitate revegetation on disturbed land at permitted and abandoned mines sites. The Department issued the determination of applicability on October 17, 2003.

   03-00228A:  Blairsville Wilbert Vault (P. O. Box 7, Blairsville, PA 15717) on November 14, 2003, to install a crematorium at their facility in the Borough of Blairsville, Indiana County. Condition No. 7 of this Plan Approval for this facility has been revised. This condition originally required temperature monitoring in the primary combustion chamber, secondary combustion chamber and the stack exhaust. The requirement to monitor the stack exhaust temperature has been removed.

   60-00004:  New Columbia Joist Co. (2093 Old Highway 15, New Columbia, PA 17856) on November 4, 2003, issued a revised operating permit, revision no. 1, for their steel joist manufacturing facility in White Deer Township, Union County. The revision of this permit is to incorporate conditions of equivalency for Armorchem 4500 gray primer (that is, the same primer that was used in the equivalency laboratory demonstration that was commenced on August 6, 2002, with an as supplied VOC content of between 3.25 and 3.30 pounds of VOC per gallon of coating) as provided for in 25 Pa. Code § 129.51(a). In addition, this Title V operating permit revision includes the requirements specified in 25 Pa. Code § 129.63(a) for the two parts washers identified in the Title V operating permit. This Title V operating permit contains all applicable regulatory requirements including monitoring, recordkeeping and reporting conditions.

   To replace, operate and maintain a 24-inch diameter gas transmission pipeline beneath an unnamed tributary to South Branch Oswayo Creek. Replacement of the 24-inch pipeline shall be conducted in dry work conditions by dam and pumping or fluming stream flow around the work area. Since the South Branch Oswayo Creek is a wild trout fishery, no replacement or future maintenance activities shall be conducted in or along the stream channel between October 31 and April 1 without prior written approval from the Fish and Boat Commission. The gas pipeline right-of-way is along the northern and southern right-of-way of SR 4008 approximately 600 feet east of T-356 and SR 4008 intersection. This permit does not authorize any temporary or permanent impact to wetlands that maybe along the gas pipeline right-of-way. This permit was issued under section 105.13(e) ''Small Projects.'' To operate and maintain: (1) a cast-in-place reinforced concrete box culvert having a normal span of 14.0 feet and an underclearance of 6.5 feet in Lamb Lick Run. The invert of the box culvert will be depressed 1.0 foot thus reducing the effective underclearance to 5.5 feet; (2) place and maintain R-7 rock riprap bank protection for a linear distance of 76.0 feet upstream and 56.0 feet downstream from the box culvert; and (3) operate and maintain a 15-inch diameter CCP stormwater outfall along the downstream left bank of Lamb Lick Run (WWF, perennial). Removal of the existing bridge and construction of the box culvert were authorized by Emergency Permit EP2603202. No vegetated wetlands will be impacted. The project is on SR 4040, Segment 0010, Offset 0683, Station 10+95.

   To conduct the following activities impacting a total of approximately 775 feet of a tributary to Wolfe Run (WWF) (including approximately 105 feet of channel for construction of an out of scope dam) associated with the construction of Shadow Creek Plan of Lots southeast of the intersection of Plains Church Road and Hope Road:

   1.  To install and maintain a 104-foot long, 13-foot wide by 4-foot high open bottom arch stream enclosure under Farmington Road extending east from Hope Road approximately 600 feet south of Plains Church Road.

   2.  To remove the existing structure and to install and maintain a 90-foot long, 13-foot wide by 5-foot high steel open bottom arch across Hope Road approximately 250 feet south of Plains Church Road.

   3.  To construct approximately 410 feet of realigned channel parallel to Hope Road extending upstream (south) from the culvert under Hope Road.

   To repair and maintain an existing 11-foot wide solid fill dock extending approximately 48 feet into the west side of Conneaut Lake at 11018 Aldina Drive approximately 0.8 mile north of SR 322. Work completed prior to obtaining this permit consisted of replacing the deteriorated wood perimeter with new plywood and posts.

   To construct and maintain a steel beam bridge having a clear span of 15 feet and an underclearance of 6 feet across Honey Creek (HQ-CWF) and to fill a de minimis area (0.01 acre) of wetland within the flood plain of Honey Creek for a private driveway extending south from Moravia-Petersburg Road approximately 0.1 mile west of Musser Road.

   To remove the existing structure and to construct and maintain a prestressed concrete adjacent box beam bridge having a clear, normal span of 24 feet and an underclearance of 7.7 feet across a tributary to Sugar Creek (HQ-CWF) approximately 0.4 mile north of SR 3004.
