Proposed Revisions to General NPDES Permit for Discharges from Hydrostatic Testing of Tanks and Pipelines (PAG-10)

   The Department of Environmental Protection (Department) seeks public comments on proposed revisions to the Department's General NPDES Permit (PAG-10) for Discharges from Hydrostatic Testing of Tanks and Pipelines for reissuance for another 5 years. The current General Permit will expire on June 25, 2004, and will continue to be in force until it is formally revised. The General Permit continues to be inapplicable to discharges to ''special protection'' waters under 25 Pa. Code Chapter 93 (relating to water quality standards). These discharges are required to be covered through an Individual Permit. This notice is under the authority of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and sections 1905-A, 1917-A and 1920-A of The Administrative Code of 1929 (71 P. S. §§ 510-5, 510-17 and 510-20).

   This notice provides the public and all stakeholders with a summary of proposed changes to the General Permit and seeks public comments on several program areas and issues. The Department will consider all input received in completing the revised permit documents.

   The following paragraphs summarize proposed major revisions to the General Permit:

   1.  General Edit/Update--The revisions provide a general edit/update of all permit documents (Notice of Intent (NOI) Instructions, NOI, the General Permit, Discharge Monitoring Report (DMR) Instructions, DMRs and Fact Sheet) to reflect the Department's current organization and publication standards.

   2.  Compliance History Review--The revisions now add a ''Compliance History Review'' information requirement block on the NOI. The NOI and Instructions have been revised to require permittee submission of a self-certification of compliance history status with all permits issued by the Department. This is a standard Department requirement for all NPDES permits and has been added to the revised permit documents.

   3.  Extension--Approval for coverage under the existing permit is extended beyond the permit expiration date. A new condition concerning issuance, reissuance or amendment of the General Permit makes the permittee responsible for complying with the revised, reissued or amended permit. If the permittee is unable to comply with the General Permit, an individual NPDES permit must be applied for within 90 days of publication of the revised General Permit.

   The Department invites public comments on the proposed revisions and seeks input on the documents. Comments must be submitted to the Department by April 15, 2004. If there is significant public interest in the General Permit or if requested, the comment period may be extended at the Department's discretion for an additional 15-day period. Only comments received within the specified comment period will be considered in completing the final documents for the General Permit. Persons wishing to comment should include their name, address and telephone number and a concise statement to inform the Department of the basis of the facts upon which the comments are based. If significant issues of public interest are raised, the Department may schedule a public meeting or hearing. Written comments should be submitted to gmaduka@state.pa.us or the previous address. Comments will not be accepted by facsimile or voice mail.

Following the specified comment period, the Department will review submitted comments, prepare a written comments and response document (CRD) and prepare the final documents for the General Permit. An availability of the final permit documents, as well as the CRD, will be announced in the Pennsylvania Bulletin.
