Special Supplemental Food Program for Women, Infants and Children; Vendor Notice
[35 Pa.B. 77] The Department of Health (Department), to maintain funding provided to it by the Federal Department of Agriculture to operate the Special Supplemental Nutrition Program for Women, Infants and Children (WIC), is prohibited by Federal law from authorizing any new for-profit WIC vendor that expects to derive more than 50% of is annual food revenue from the sale of supplemental foods that are obtained with WIC checks. See section 780 of the Consolidated Appropriations Act of 2004 (act), the act of December 8, 2004 (Pub. L. No. 108-447, 118 Stat. 2809). The Secretary of Health and Human Services may approve the authorization of a vendor if the approval is necessary to assure participant access to program benefits. (Id.) The Department is providing notice that it intends to comply with the act.
