Finding
Lawrence County
[35 Pa.B. 306] Under section 2002(b) of The Administrative Code of 1929 (71 P. S. § 512(b)), the Deputy Secretary for Highway Administration, Department of Transportation (Department), makes the following written finding:
The Department plans to widen and rehabilitate approximately 2.9 km (1.8 miles) of Mercer Road between Mitchell Road to the south and Maitland Road to the north, in Neshannock and Wilmington Townships, Lawrence County. The roadway widening and rehabilitation requires the taking of approximately 0.33 ha (0.8 acre) from Pearson Park and the use of a Pearson Park parcel which qualifies as a Section 2002/Section 4(f) resource.
Mitigation measures to minimize harm to the resource include the following:
1. Access to Pearson Park will be maintained at all times. Signs will be posted during Phase 3 of construction, which requires a detour in front of Pearson Park that allows park users to access the park through the detour or access the park through an alternate entrance.
2. The proposed construction activities will be limited to the minimal area necessary to conduct the required roadway improvements.
3. Storage of construction equipment and materials will be restricted from the park.
4. All disturbed areas will be returned to pre-construction conditions when work is completed.
5. The Department will continue to coordinate with Neshannock Township regarding the project schedule and project impacts.
The Deputy Secretary has considered the environmental, economic, social and other effects of the proposed project as enumerated in section 2002 of The Administrative Code of 1929 and has concluded that there is no feasible and prudent alternative to the project as designed, and all reasonable steps have been taken to minimize the effect.
