HAZARDOUS SITES CLEAN-UP UNDER THE ACT OF OCTOBER 18, 1988
Proposed Consent Order And Agreement Detroit Street Partners, L. P., Redevelopment Authority of the County of Washington, City of Washington, Washington County
The Department of Environmental Protection (Department), under the authority of the Hazardous Sites Cleanup Act (HSCA) (35 P. S. §§ 6020.101--6020.1305), has entered into a proposed Consent Order and Agreement (CO&A) with Detroit Street Partners, L. P. (Detroit) and the Redevelopment Authority of the County of Washington (Authority). The proposed CO&A resolves the liability of Detroit for reimbursement of costs expended by the Department at a used tire fire that took place in February 1997 at the National Granulating Company, Inc. (NGC) tire recycling facility. The facility was located at 41 Detroit Avenue in the City of Washington, Washington County (site). Secondly, the CO&A calls for site owner Detroit's transfer of site title to the Authority in anticipation of redevelopment of the site for the benefit of the surrounding community.
It is the Department's determination that Detroit owned the 11-acre site beginning 1991 and that it operated the site from 1991 until 1993 and from 1996 through the time of the 1997 fire. The Department believed that, as a result of the 1997 fire and its burning of over 2 million stockpiled used tires, Detroit was an owner and operator of a site at the time of a release of hazardous substances there and, further, was a generator of hazardous substances released at the site. Under section 701 of HSCA (35 P. S. § 6020.701) the Department believed Detroit jointly and severally liable for costs in the amount of $1,834,866 expended by the Department in addressing the fire and related soil, groundwater and surface water contamination.
The CO&A relieves Detroit of liability for all Department-incurred costs in exchange for Detroit's transfer of site title to the Authority. It is the hope of the parties that the Authority will find a private developer willing to purchase the site and put the site to a use of benefit to the surrounding community. In that instance, the CO&A calls for the Authority's sharing equally with the Department in any proceeds of the Authority's sale of the site.
Under section 1113 of HSCA (35 P. S. § 6020.1113) the Department is publishing notice of the CO&A and will provide a 60-day period for public comment on the CO&A beginning with the date of this publication. Copies of the CO&A can be obtained by contacting Terry Goodwald at (412) 442-4000. The proposed CO&A will be open for public comment from February 5, 2005, through April 7, 2005. Persons may submit comments into the record, during this time only, by sending them to Terry Goodwald, Department of Environmental Protection, 400 Waterfront Drive, Pittsburgh, PA 15222 or by delivering them in person to this office.
The Department has reserved the right to withdraw its consent to the CO&A if comments submitted during the public comment period disclose facts or considerations which indicate, in the Department's discretion, that the CO&A is inappropriate or not in the public interest.
LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).
Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, shall also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media, benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by provisions of the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.
