THE CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT
APPLICATIONS FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS This notice provides information about persons who have applied for a new, amended or renewed NPDES or WQM permit, a permit waiver for certain stormwater discharges or submitted a Notice of Intent (NOI) for coverage under a general permit. The applications concern, but are not limited to, discharges related to industrial, animal or sewage waste, discharges to groundwater, discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities or concentrated animal feeding operations (CAFOs). This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

For applications for new NPDES permits and renewal applications with major changes in Section II, as well as applications for MS4 individual permits and individual stormwater construction permits in Sections IV and VI, the Department, based upon preliminary reviews, has made a tentative determination of proposed effluent limitations and other terms and conditions for the permit applications. These determinations are published as proposed actions for comments prior to taking final actions.
Unless indicated otherwise, the EPA Region III Administrator has waived the right to review or object to proposed NPDES permit actions under the waiver provision in 40 CFR 123.24(d).
Persons wishing to comment on an NPDES application are invited to submit a statement to the regional office noted before an application within 30 days from the date of this public notice. Persons wishing to comment on a WQM permit application are invited to submit a statement to the regional office noted before the application within 15 days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the applications. Comments should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.
The Department will also accept requests for a public hearing on applications. A public hearing may be held if the responsible office considers the public response significant. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. The Department will postpone its final determination until after a public hearing is held.

Description of Activity: This application is for an existing sewage treatment facility serving Green Hill Mobil Home Park.
The receiving waters, Green Lane Reservoir is in the State Water Plan watershed 3E-Perkiomen and is classified for TSF, aquatic life, water supply and recreation. The nearest downstream public water intake/supply is Aqua Water Company, approximately 8 miles downstream on Perkiomen Creek.
The effluent limits for Outfall 001 are based on a design flow of 30,000 gpd.

Description of Proposed Activity: This application requests renewal of a NPDES permit for an existing discharge of stormwater from the applicant's Oxford facility, a treated wood products plant.
The receiving stream, an intermittent tributary to Little Elk Creek, is in the State Water Plan Watershed 7K and is classified for HQ-TSF, MF. There are no public water supply intakes identified downstream. The Pennsylvania/Maryland State Line is approximately 9 river miles downstream from the discharge point.

The following effluent limitations are proposed for discharge to the receiving waters, UNT to Grassy Run, classified as a WWF with existing and/or potential uses for aquatic life, water supply and recreation. The first existing/proposed downstream potable water supply is Albert Gallatin Municipal Authority located at Point Marion, PA, ≅ 6.0 miles below the discharge point.
Outfall 101: existing discharge, design flow of 0.006 mgd.

For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride, phenolics, sulfate and chloride, the existing/proposed downstream potable water supply, considered during the evaluation is the PA-NY State Line located on Allegheny River, approximately 1 mile below point of discharge.
The receiving stream, Tunungwant Creek, is in watershed 16-C and classified for WWF, aquatic life, water supply and recreation.
The proposed effluent limits for Outfall 001 are based on a design flow of 6.3 mgd.

PA0239755, Sewage. Linda J. Gilson SFTF, 5785 Lunger Road, Erie, PA 16510. This proposed facility is located at 5785 Lunger Road in Harborcreek Township, Erie County.
Description of Proposed Activity: The applicant requests an NPDES permit for the discharge of treated domestic sewage from an SFTF serving an existing single dwelling. Treatment consists of a septic tank, dosing tank, sand filter and chlorine disinfection.
For the purpose of evaluating effluent requirements for TDS, NO2-NO3, fluoride, phenolics, sulfate and chloride, there is no downstream potable water supply to consider between the discharge and Lake Erie.
The receiving stream, UNT to Six Mile Creek, is in the Lake Erie watershed and classified for CWF, MF, aquatic life, water supply and recreation.
The proposed effluent limits for Outfall 001 are based on a design flow of 0.0004 mgd.
