   The Independent Regulatory Review Commission met publicly at 10:30 a.m., Thursday, January 5, 2006, and announced the following:

State Board of Vehicle Manufacturers, Dealers and Salespersons--Protest Proceedings;
Regulation No. 16A-608

   On March 29, 2005, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Board of Vehicle Manufacturers, Dealers and Salespersons (Board). This rulemaking amends 49 Pa. Code Chapter 19. The proposed regulation was published in the April 23, 2005 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on November 28, 2005.

   This regulation sets forth the procedural requirements for litigants to follow in vehicle protest matters before the Board. The procedural requirements supplement 1 Pa. Code Part II relating to General Rules of Administrative Practice and Procedure.

   We have determined this regulation is consistent with the statutory authority of the Board (63 P. S. §§ 818.4(a)(9), 818.7, 818.8, 818.13 and 818.27) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

State Board of Medicine--Licensure of Medical Doctors; Regulation No. 16A-4917

   On August 23, 2004, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Board of Medicine. This rulemaking amends 49 Pa. Code §§ 17.1, 17.2, 17.5 and 17.9. The proposed regulation was published in the September 4, 2004 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on November 28, 2005.

   This regulation amends the licensure requirements for foreign medical school graduates and licensure by endorsement.

   We have determined this regulation is consistent with the statutory authority of the State Board of Medicine (63 P. S. § 422.8) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Environmental Quality Board--Hazardous Waste Management System; Proposed Exclusion for Identification and Listing Hazardous Waste;
Regulation No. 7-393

   On November 22, 2004, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Environmental Quality Board. This rulemaking amends 25 Pa. Code § 261a.32. The proposed regulation was published in the December 4, 2004 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on November 23, 2005.

   This regulation will conditionally exclude Electric Arc Furnace Dust (EAFD) waste from the list of hazardous wastes in 40 CFR Part 261 for MAX Environmental Technologies, Inc. located in Yukon, Pennsylvania.

   We have determined this regulation is consistent with the statutory authority of the Environmental Quality Board (35 P. S. § 6018.105) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
