Finding

[Saturday, February 3, 2007]Under section 2002(b) of The Administrative Code of 1929 (71 P. S. § 512(b)), the Chief Engineer for Highway Administration, Department of Transportation (Department) makes the following written finding.
The Federal Highway Administration (FHWA) and the Department are planning the construction of a 10 to 12 mile four-lane limited access highway connecting the four-lane Meyersdale Bypass to the four-lane US 219 in Somerset, PA.
This project will require the acquisition of approximately 117.20 acres from the 3,100 acres Swamp Creek Valley Historic District and the acquisition of approximately 10 acres from the 3,200 acres State Game Lands No. 50. Acquisition of land from the Swamp Creek Valley Historic District and State Game Lands No. 50 will constitute a use of the Section 2002 resource.
Information describing the project together with the associated environmental analysis is contained in the Final Environmental Impact Statement/Final Section 4(f) Evaluation that was prepared for this project. The FHWA issued a Record of Decision on November 14, 2006, for this project.
Based upon studies, there is no prudent and feasible alternative to the proposed action.
The environmental, economic, social and other effects of the proposed project as enumerated in section 2002 of The Administrative Code of 1929 have been considered. It has been concluded that there is no feasible and prudent alternative to the project as designed, and all reasonable steps have been taken to minimize the effects.
