Adjustment of the Coal Mining Reclamation Fee

[Saturday, December 5, 2009]The Department of Environmental Protection announces the adjustment to the Reclamation Fee. This adjustment is required by the regulations at 25 Pa. Code § 86.17 (relating to permit and reclamation fees). Effective January 1, 2010, the Reclamation Fee for calendar year 2010 will be $0. While the fee will not be assessed in 2010, the regulations require annual adjustments. The fee amount for subsequent years will be calculated in accordance with 25 Pa. Code § 86.17. Refer to this section of the regulations for further information about the process.
This adjustment is the result of calculations presented in a report that contains a financial analysis of the revenue and expenditures from the account for Fiscal Year 2008-2009 and provides projections for the 2009-2010 fiscal years. The report was reviewed with the Mining and Reclamation Advisory Board on October 22, 2009. Comments were received from one commentator.
